If NY unemployment puts you under review, can you still get backpay even if you stop claiming?

So my claim got flagged for review in November last year after I was collecting for about 2 months. I got a strange notice saying my identity couldn't be verified even though I had already done all the ID verification stuff back in September when I first filed. I tried calling but gave up after being on hold for hours multiple times. I was pretty frustrated and just stopped claiming in December figuring it wasn't worth the hassle since I was starting to get some freelance gigs anyway. Now I'm wondering if I could still get the backpay for October and November (about $1700 total) that I was supposed to receive before the review started. Has anyone been through this and still gotten their backpay even after they stopped claiming for a while? Do I need to reopen my claim or just try to get through to someone on the phone to resolve the review?

I was in a similar situation earlier this year. My account got flagged in February and I stopped claiming in March cuz I just couldn't deal with the BS anymore. Finally got ahold of someone in July using claimyr.com and they sorted everything out. Got all my backpay from the weeks I certified before I gave up. YES. You can and should get your backpay. I went through almost exactly this. Was on UI for 3 months, then got flagged for a so-called "identity issue" even tho I had already verified everything. I got so annoyed I stopped claiming for like 6 weeks. When I finally reached an agent (took forever), they released all my backpay for the weeks I had previously certified. Just make sure you have documentation of those weeks if they ask for it.

Yep you can get backpay on weeks you already certified for even if you stop claiming. But you gotta get through to someone to resolve the ID verification issue first. Their systems been extra buggy lately with these reviews. Make sure you have all your ID docs ready (SSN card, license, birth certificate, etc) when you talk to them.

Here's what you need to know about NY unemployment reviews and backpay (I used to work in a related field): If you've already certified for those weeks before the review started, you ARE eligible for backpay regardless of whether you continued to certify after that. The system basically puts those payments in a holding pattern until the review is cleared. However, there's a critical distinction: you can only get paid for weeks you've properly certified for. If you haven't certified for certain weeks, those are likely gone unless you can prove good cause for not certifying (very difficult). Don't give up - your money is still there waiting, they just need to clear the hold.

Usually comes all at once as a lump sum, but sometimes it's split into 2-3 payments over a few days. Depends on how many weeks we're talking about.

There's technically a one-year limit to resolve claim issues, but most reviews get handled much sooner than that. The key is getting someone on the phone who can actually help.

Just went thru this last month! I stopped claiming in April after my account got flagged but I had certified for March. Finally got thru to someone in June and they released my March payments after fixing the ID issue. So yes, you'll get paid for weeks you certified for even if you stopped claiming later. The trick is getting someone on the phone who knows what they're doing.

Protip: call ur state assembley person. Mine contacted unemployment for me and my issue got fixed in a week after being stuck for months. They have special contacts at nysdol to escalate cases.

Dealing with the same exact issue right now! Been under review since January and gave up claiming in March. Finally used claimyr.com last week to get through to someone (totally worth it) and they told me all my back weeks were still valid and would be processed once they clear the ID issue. They're sending me a docusign link to upload more ID verification documents. Fingers crossed it works out for both of us!

Theres a 99% chance u wont ever see that money unless u get a real person on the phone who can fix the issue. Sadly thats just how it is with ny unemployment. They make it impossible to actually speak to anyone.

I know someone who had this exact situation. They actually got ALL their back pay 6 months later after finally getting through to an agent. The key is having certified for those weeks BEFORE your account was flagged. If you already certified, that money is still in the system waiting for you. Don't give up!

I work with a legal aid office that helps people with unemployment issues. YES, you can still get backpay for weeks you properly certified for, even if you stopped claiming later. The review does not cancel your eligibility for those weeks. But you MUST contact them to resolve the ID verification issue. The fastest way is to get an agent on the phone, which I know is extremely difficult. Keep detailed records of all your attempts to contact them.
