Stuck waiting for ny unemployment back pay for 8 weeks - anyone seen this error?

So frustrated with the system right now. I got laid off in August when my company downsized and I applied for benefits immediately. I was approved after about 3 weeks but there was some weird glitch where they didn't process my first 6 weeks properly. When I check my payment history, those weeks show as 'pending backdate review' with a weird error code. I've been trying to get this resolved since October and it's now December - that's over $2,800 that I'm owed! I've called at least 20 times but can never get through to a real person. The automated system just tells me my claim is 'under review' and to wait. Has anyone else dealt with this 'pending backdate review' status and actually gotten their back pay? I'm about to miss another rent payment and I'm getting desperate.

Yep, I dealt with this exact thing. 'Pending backdate review' is basically their code for 'we're gonna make you wait forever.' I had to wait almost 3 months for my backpay from July to september. honestly no, the agent just typed some stuff and fixed it in like 5 minutes. that's what makes it so infuriating!! the fix is easy but getting to someone who can do it is impossible

The backdate review is such bs. Been dealing with this since september and STILL waiting. The stupid message just sits there taunting me everytime I check for updates. NY unemployment system is completely broken. Maybe we should all show up at their office and demand our money lol.

OMG I HAD THIS EXACT PROBLEM!!!! The 'pending backdate review' is literally THE WORST. I ended up having to file an official complaint through the Governor's office after waiting 13 weeks. Within 3 days of filing the complaint, miraculously my backpay was processed. Try that route if nothing else works.

I actually just got my back pay resolved last week after waiting about 7 weeks. What finally worked was using claimyr.com to get through to a real person (after trying to call myself for weeks with no luck). The agent told me that the system automatically flags certain backdate requests for manual review, and they're super backed up. But once a human looked at mine, they fixed it right away and I got paid within 48 hours. Defintely recommend trying to get a human on the phone however you can.

this is just how ny unemployment operates now. they make everything so confusing and difficult on purpose to discourage people from claiming what they're owed. i had to wait 11 weeks for my backdated payments. if you can get thru to a real person they CAN fix it, but good luck with that 🤡

The EXACT same thing happeend to me and they owed me almost 4k. what worked for me: 1) tweet at NYSDOL 2) call at 7:29am EXACTLY 3) email your state senator. the twitter thing surprisingly got me a DM from them asking for my info. worth a shot!

I read somewhere that 'pending backdate review' happens when they think there might be an overlap with another benefit you received or with wages from part-time work. Do you have anything like that in your situation? They're super paranoid about paying benefits for weeks where you earned any money at all.

Not that I know of. I was fully employed until August, then completely unemployed. No part time work or other benefits. That's why it's so frustrating!

Dude I feel your pain. I had to wait over 2 months for backpay from ny unemployment. it was almost $5k they owed me and i was about to be evicted. I tried calling 5-6 times a day with no luck. Saw another post about this last week. Call volume is crazy high right now because they're implementing some new system that's causing all kinds of glitches. The 'backdate review' is apparently one of the most common issues. smh ny unemployment always finds new ways to make our lives miserable

Not to be that person, but have you tried calling your local assembly member or state senator? I was in a similar situation (waiting 9 weeks for back pay, about $3,100) and was getting nowhere with regular calls. My state senator's office has a person who deals specifically with unemployment issues. I filled out their help form and had my back pay within 10 days.

yeah man welcome to the club 🤦‍♂️ this happened to me too. tried calling for weeks and getting the same bs automated message saying my claim was under review. Then I saw someone recommend claimyr.com on here, used it and finally got a real person. She told me my account had a fraud flag on it (even though I did nothing wrong) and that's why my backpay was stuck in review. She removed the flag while I was on the phone with her and my money showed up 3 days later. talking to an agent got my $ unlocked so fast.

apparently their system automatically flags certain claims if anything looks 'unusual' - in my case it was because I moved during the claim period. but the agent said it happens all the time for stupid reasons and most are false flags

I have a theory that they do this on purpose to save money. If you make the process painful enough, some percentage of people will just give up. I waited 15 weeks for my backdated payments and had to threaten legal action before they finally processed it. The system is working exactly as designed - to be frustrating.
