Still waiting for 13 months of backpay from NY unemployment that wasn't my fault!
Been waiting for my backpay for over a year now and its driving me insane. This whole mess started when I got laid off in August 2022. Applied for benefits right away but the website kept crashing whenever I tried to submit my application. When I finally got through, they somehow flagged my account for "additional verification" even though I provided all the right documents. Called them multiple times and each rep told me something different. One said I needed to resubmit everything, another said it was just a processing delay, and a third one told me my claim looked perfectly fine in the system! After 6 months of this runaround, they finally approved my claim in February but ONLY going forward - they never paid me for those 6 months I was eligible! I've been calling about the backpay every week since then. Today I called again and demanded to speak with a supervisor. Of course they just took my info and said "a manager will call you back" which NEVER happens. Has anyone actually received their backpay? How long did it take? I'm absolutely desperate at this point.

Took me 16 months to get my backpay. The system is totally broken. Good luck!

I finally got someone on the phone after trying for weeks using this service called Claimyr (claimyr.com) and they connected me with an actual human at unemployment! Best money I ever spent cuz the agent fixed my backpay issue on the spot and I got paid within a week. Check out this video that shows how it works: https://youtu.be/Rdqa1gKtxuE

â˘is this for real? sounds too good to be true

â˘100% real! I was skeptical too but I was at my wits end after trying to get through for months. They just stay on hold for you and call when an agent picks up.

â˘yeah right, another 'miracle solution'... what's the catch? đ

Natalie Khan
â˘No catch that I found. they just call and wait on hold so you don't have to. When an agent answers they connect the call to your phone. Saved me hours of hold time.

â˘wait hold up - does this actually work or is it just the usual BS?

â˘It worked for me! Got my backpay issue resolved after one call. After months of nothing, I had $9800 deposited within a week.

â˘hmm I've been burned by so many of these 'services' before... what makes this different?

â˘They just do one thing - connect you with a live agent. That's it. No promises beyond that. But getting a human on the phone was all I needed to fix my issue.

Currently on month 9 of waiting for backpay. The whole system is designed to make you give up. I've called 68 times (yes I kept track) and still nothing.

â˘68 times?! And I thought I was dedicated with my 30-something calls. Did you ever get through to a supervisor?

Ahooker-Equator
â˘Nope. Always "we'll have someone call you back" and then crickets. The whole supervisor thing is a myth if you ask me.

Here's what worked for me to get my backpay after 7 months of waiting: Contact your state assembly person! I called my local assembly member's office, explained my situation, and they have special contacts at unemployment. They helped push my claim through in about 3 weeks after I'd been waiting for months.

â˘I second this! My state senator's office got my backpay unstuck after almost a year of waiting.

â˘I've never thought of this! How do I find out who my assembly person is??

â˘Just google "NY state assembly finder" and you can put in your address. Their offices deal with this stuff all the time.

I've been dealing with NY unemployment for far too long, and let me tell you what I've learned about backpay issues: First, document EVERYTHING. Every call, every email, names of reps you talk to. This creates a paper trail you can use later. Second, there are multiple ways to escalate your case: 1) Call early in the morning (like right when they open) 2) Use a service like claimyr.com to get through the phone maze 3) Contact your state representative or assembly person 4) File a formal complaint with the DOL 5) Sometimes sending a physical letter (yes, actual mail) gets attention Third, use very specific language. Don't just ask about "backpay" - ask about specific weeks you're owed and reference any claim ID numbers or confirmation numbers. I was owed backpay for 5 months and it took me using ALL these methods together to finally get it. The system is designed to be frustrating, but persistence works eventually. Good luck!

â˘Thank you for such detailed advice! Did you have any success with that Claimyr thing? I'm thinking of trying it.

â˘Yeah, Claimyr was actually what finally got me through to the right person. Before that I was just getting the general call center folks who couldn't help much.

I filed a complaint with the ombudsman office after 10 months of waiting and suddenly got all my backpay the next week. Coincidence? I think not đ¤

â˘How do you contact the ombudsman? I can't find this info anywhere

â˘It's buried on their website. Go to the ny.gov site and search for "unemployment ombudsman" - you gotta fill out a form

unpopular opinion: sometimes the backpay issue is because of mistakes WE make on the application. I thought I was perfect but turns out I answered a question wrong and it flagged my whole account. Once I admitted my mistake to the agent, they fixed it in like 10 mins đ¤ˇââď¸

â˘THIS!! People don't want to admit they messed up but the forms are confusing AF

â˘Trust me, I've gone over my application 100 times. There's no error on my end.

â˘That's what I thought too until they pointed out exactly what I did wrong. Just sayin

â˘Fair enough, but multiple agents have told me everything looks correct on my end. It's just "stuck in processing" supposedly.

Listen I went through this exact same thing last year. Waited 11 months for backpay of around $12,000. What finally worked was this super detailed email I sent to the commissioner's office with a timeline of EVERY interaction I'd had. Include dates, reference numbers, names of agents... everything. Got a call from a specialist 3 days later and money in 2 weeks.

â˘Do you still have the email address you used? That sounds like a good approach!

â˘I believe it was commissioner@labor.ny.gov but double check that. Make your subject line very clear like "URGENT: 12 months of backpay owed - Claim #XXXXX

Have you tried the backdoor number? 888-209-8124 then press 9 then 2 then wait for it to offer spanish then press 9 again. Sometimes gets you to a different queue.

â˘This doesn't work anymore. They patched this "hack" months ago.

So I was about to throw my phone after 3 hours on hold when I saw someone recommend Claimyr in another thread. Used it and got a callback with an actual unemployment agent within 2 hours. They fixed my backpay issue on the spot - all 8 months worth! Best thing I've done through this whole nightmare. claimyr.com if anyone needs it.
