Missing one payment from NY unemployment backpay - calling for weeks with no results
Got an email back in April saying my backpay was approved, but they're still missing one payment from when I received all my other backpay from late 2021. I've been calling almost every day for the past 3 weeks and keep getting the same response: "We're working on it." This is getting ridiculous. I'm short about $580 that they owe me and nobody seems to be able to actually help. I've spoken to at least 7 different agents who all promise to "make a note" or "escalate" but nothing changes. Has anyone successfully resolved a missing payment issue? Should I be asking for a supervisor or banking unit specifically? I'm beyond frustrated at this point.

Same exact thing happened to me, but mine was from October 2021. They missed one week that was about $625. I spent almost 2 months calling and getting nowhere with regular agents telling me "its in process" or "just be patient" 🙄

•Did you ever get it resolved? I'm about to lose my mind dealing with these people!

•Yeah but only after I finally got through to a supervisor. Regular agents cant actually do anything with missing payments it seems. Just keep asking for a supervisor EVERY time

•how long did it take after supervisor got involved? been waiting 3 weeks after mine 'escalated' it 😡

•After supervisor it was like 9 business days. But the key was making sure they actually created a 'monetary determination review' not just a regular note on my account

After weeks of getting nowhere on the phone, I tried Claimyr.com and finally got connected to someone who could actually help. The agent put me through to their payment resolution team and my missing payment (it was $740 in my case) hit my account 5 days later. Talking to an agent got my money unlocked so fast after wasting so much time on hold. Check out their explanation video if you're curious: https://youtu.be/Rdqa1gKtxuE

•this sounds like an ad lol. does this actually work? im super skeptical of these services

•I was skeptical too tbh. But I was desperate after 3 weeks of calling myself. It literally just calls for you and connects when a human picks up. No magic just saves hours of hold time

•wait so its just a service that waits on hold for you? that actually sounds amazing cuz i cant tie up my phone all day waiting

Andre Laurent
•Yep exactly that. They call and wait on hold, then when someone actually answers they call your phone. Saved me from having to listen to that hold music for 3+ hours

•I mean yeah the system is broken but they're offering a solution. I'd rather pay a bit to get my $740 than never get it at all 🤷♀️

You need to specifically ask for the MONETARY DETERMINATION UNIT. Regular agents can't help with backpay that's been approved but not paid. I went thru this exact thing in Feb and it was a nightmare untill I found the right department.

its insane how they can just hold onto OUR MONEY for months and act like its no big deal. i had to threaten to call my state representative before they finally processed my missing payment. the whole ny unemployment system is such a joke

•Contacting your state rep is actually good advice. My cousin works for a state senator and says unemployment cases are like half their constituent work these days

•yep! i literally emailed my assembly person and cc'd ny unemployment and magically my issue was fixed within 48 hrs after months of nothing 🤔

•Which representative did you contact? I'm willing to try anything at this point

•whoever represents your district. just google "who is my state assembly member NY" and put in your address. their websites usually have casework forms

I've been dealing with NY unemployment for over 2 years now and here's what I've learned works best for backpay issues: 1) Don't just call the main line. Always ask for a supervisor immediately. 2) When you speak to anyone, get their ID number or name and write it down with date/time. 3) Use the message portal on the website to document your issue IN WRITING - this creates a paper trail. 4) Ask specifically for the "Monetary Determination Unit" or sometimes called "Backpay Resolution Team" 5) If it's been more than 30 days since approval email, mention that you're preparing to contact your state representative and the Department of Labor ombudsman. 6) For anyone struggling with hold times, check out claimyr.com - it's a service that waits on hold for you then calls when an agent picks up. Saved me countless hours. 7) Be polite but FIRM. Don't let them brush you off with "we're working on it" - ask for specific timeframes and next steps. The system is frustrating but persistence pays off eventually. Good luck!

•This is super helpful, thank you! I'm definitely going to try asking for the Monetary Determination Unit tomorrow. Do you know what hours they're available?

Mei Zhang
•They're supposed to be there 8-5 weekdays but honestly it's hit or miss. Try calling right when they open for best results.

•Does that claimyr thing actually work? I've spent countless hours on hold with unemployment and I'm at my wits end

•Yeah it actually does. I was suspicious at first but it saved me so much frustration. They just wait on hold so you don't have to.

NYSDOL is complete trash. They owed me backpay for 6 weeks and took 5 MONTHS to pay it after approval. My advice - call early morning (like 7:55am right before they open), ask immediately for a supervisor, and refuse to get off the phone until you get a specific timeframe. Worked for me after dozens of failed attempts.

•I'll try this tomorrow morning, thanks for the tip!

Have you tried contacting them through social media? I know it sounds weird but I DM'd them on twitter after months of phone hell and got a response in 2 days. Worth a shot 🤷♂️

Ethan Wilson
•I don't have Twitter but maybe I'll create an account just for this. Did you DM the official NYSDOL account?

Liam McConnell
•Yep, their official account. They seemed to care more about public complaints than private ones lol. The trick is to be polite but clear about how long youve been waiting

i filed a complaint with the ny state comptroller's office and got my missing payment within a week. try it here: https://www.osc.state.ny.us/claims

•I tried this route and got nowhere 😑 just a form letter saying to contact DOL directly

•weird, maybe it depends on your specific situation. worth a try tho since it only takes like 10 min to file

This is why I ended up using claimyr.com after 2 weeks of getting nowhere. Got someone on the phone who actually knew what they were talking about, and she told me that backpay that's been approved but not paid needs to go through a separate process. Regular agents literally CAN'T help - they're just reading scripts. You need someone from the monetary unit.

•another vote for claimyr! that service saved my sanity. got my outstanding payment fixed after months of nothing

Fun fact: If they owe you backpay for more than 90 days after approval, you can potentially claim interest on it too. Not many people know this. Its in the fine print of the approval letter.

Ethan Wilson
•Wait, really? Mine's only been about 3 weeks since approval but that's good to know if this drags on!
0 coins
Dylan Mitchell
•Yep! It's not much (like 1% or something) but it adds up if they're holding thousands of your dollars for months. Just antoher way they try to screw us over 😒

Sofia Gutierrez
•This is actually not true. I asked about interest and the supervisor laughed at me. Said there's no provision for that in NY unemployment.

•bruh my agent literally told me this and i got an extra $27 on my $1400 backpay. maybe depends on the situation or which agent you get?

heres a trick - call and immediately say "I need to speak with a tier 2 specialist about a backpay discrepancy" - they'll transfer you past the first level agents who cant do anything. dont waste time explaining to the first person who answers

i used to work for DOL (quit becuz it was hell). here's what you need to know - backpay that shows as "approved" still needs to go through payment processing which is a separate dept. regular agents CANNOT speed this up no matter what they tell you. you need to specifically request the "backpay resolution team" and don't take no for an answer.

Ethan Wilson
•This is super helpful insider info, thank you! Is there a direct number for the backpay resolution team?
0 coins
Fatima Al-Maktoum
•no direct number unfortunately, they're internal only. but if you keep insisting, a supervisor can transfer you. be prepared to wait on hold another 30+ mins for the transfer tho 🙃

•this explains so much! i've been getting the runaround for weeks with everyone telling me different things

•yep the left hand doesnt know what the right is doing there. most agents are just temps with 2 weeks training who read from scripts

Anyone have any luck filing a formal complaint with the NY Dept of Labor Commissioner's office? I'm considering it for my missing payments.

Liam McConnell
•I tried this route. Got a generic response after 3 weeks saying they'd "look into it" and then nothing. Total waste of time.

•Ugh that's disappointing but not surprising 😑 The whole system is designed to make us give up

My bf was in the same situation and finally got it resolved by going IN PERSON to a Department of Labor office! Not many people realize you can do this. He went to the one in Brooklyn and spoke to someone face to face.

Ethan Wilson
•This is brilliant, I didn't know you could go in person! Are they open regular business hours? Do you need an appointment?
0 coins
Dmitry Petrov
•Most locations are open 8:30-4:30 but GET THERE EARLY. Like 7:30am early. They only take a certain number of people each day. No appointment system that I know of.
