Struggling to get ny unemployment backpay for 14 months - need advice

Been fighting with the system since April 2021. I was approved for benefits in May 2021 but didn't actually see a payment until July. According to my claim history and payment dates, I'm still owed backpay for those missing months. I've tried calling hundreds of times, sent emails, used the message portal, and even reached out to my local representative. Absolutely no response from anyone. Can't get a single human on the phone. I've double checked all my documents and I definitely qualify for the missing payments. It's been over a year of trying to resolve this and I'm completely out of ideas. Anyone dealt with something similar or know how to actually speak to someone who can help?

Yuki Yamamoto

The only way I managed to get through was using claimyr.com - I was in the exact same boat (waiting 8 months for backpay) and was ready to give up. The service calls for you and connects you with a live agent. Best money I spent all year considering I got over $6k in backpay afterwards. Check out how it works: https://youtu.be/Rdqa1gKtxuE

yeah right, another 'miracle solution'... what's the catch? 🙄

No catch - it just calls for you and connects when someone answers. I was hesitant too, but after 8 months of trying everything else, I had nothing to lose. Got my backpay issue resolved in one call.

wait hold up - does this actually work or is it just the usual BS? i've tried literally everything else

It worked for me! They just automate the calling part so you don't have to sit there hitting redial for hours. When an agent picks up, it forwards to your phone. Solved my backpay issue in one call.

how long did you wait for the callback? the ny unemployment phone system is basically designed to make you give up 💀

About 2 hours for me, but that was mid-morning on a Tuesday. Better than the 150+ calls I'd been making daily with zero success.

I was in a similar situation last year. Try calling exactly at 7:58am - that's when the lines open and you might get lucky. Also, try the 'file a new claim' option even if you don't need to - sometimes it routes you to a different department that can actually help with backpay.

I've been trying the early morning trick for weeks with no luck. What option did you select in the menu when you got through?

I selected option 1, then 3, then 2. It's a maze but sometimes that route has fewer people trying it. Good luck!

Honestly the ny unemployment system is completely broken. I went through this exact nightmare for 10 MONTHS. What finally worked for me was contacting my state assembly person. They have direct lines to DOL and can escalate your claim. Google your district rep and email them with all your info.

I second this. My assembly person got my issue fixed in 3 weeks after I spent months getting nowhere on my own.

Thanks for this! Did you email them or call their office? And what kind of info did they need from you?

I emailed first, then they called me back. They needed my name, address, claim ID, and brief explanation of the issue. They also had me sign a release form so they could talk to DOL on my behalf.

This varies wildly depending on your district. My rep was useless and just sent form responses. Ended up using claimyr.com instead and got through to an actual human who fixed it.

Listen, the backpay system is a MESS right now. Here's what you need to know to actually get your money: First off, document EVERYTHING. Screenshots of your payment history, approval dates, everything. When you do finally reach someone, you need this evidence ready. The regular phone lines are basically useless at this point. You have several options that might actually work: 1. Contact your state representative or senator. They have direct channels to DOL and can often resolve backpay issues faster. 2. Try using claimyr.com - it's a service that will call for you and connect when a human answers. This saved me weeks of frustration. 3. File a formal complaint through the DOL website. It creates a paper trail they can't ignore. 4. If you're really desperate, some people have had success with the social media approach - tweet at NYSDOL and your story might get picked up. The key is PERSISTENCE. The system is designed to make you give up. Don't. Your money is sitting there waiting for you. And remember - backpay is different from regular benefits. Make sure whoever you speak with understands you're specifically asking about BACKDATED payments from your approval date, not just regular weekly benefits.

This is incredibly helpful, thank you! I'll definitely check out that claimyr site. How long did it take you to get your issue resolved once you got through to someone?

Once I actually spoke to a real person, it took about 3 weeks for the money to hit my account. The key was getting past the first line reps to someone who could actually access the backpay system. Don't take "we'll make a note in your file" as an answer!

Just a heads up - if you were approved in May 2021 but didn't get paid till July, you are DEFINITELY owed those back weeks. Don't let them tell you otherwise. I've seen so many people just give up on their backpay.

bruh i swear the unemployment office secretly hired people to make their phone system as frustrating as possible 😤 they WANT you to give up on your money

no literally!! i think they get bonuses for every person who gives up 🤡

It's called "procedural denial" - create a system so frustrating that eligible people just give up trying.

For anyone dealing with backpay issues - you NEED to specifically request a "backdate review" when you get someone on the phone. Don't just ask about missing payments. The regular agents often don't know how to handle backdating and will just tell you to keep certifying.

0 coins

-

Ethan Brown

Thank you! I've never heard of asking for a backdate review specifically. Do you know if there's a specific department that handles these?

0 coins

-

26d

Sofia Martinez

Yes - ask to speak with the claims specialists or backdating unit. The frontline reps usually can't help with this type of issue. Be prepared to be on hold for a transfer though!

The whole NY unemployment system is designed to frustrate you into giving up. I'm not saying it's a conspiracy BUT IT'S DEFINITELY A CONSPIRACY 👀

-

Ava Thompson

Not even a conspiracy at this point, it's just facts lmao they save millions by making the system impossible to navigate

THIS! Every dollar they don't pay out is money the state gets to keep. Simple economics.

After waiting 6 months for backpay I found out that in my case they were holding it because one of my weekly certifications had a question marked wrong. Check all your certifications for errors.

0 coins

-

Ethan Brown

That's interesting - how did you find out it was a certification error? And who told you about it?

I finally got through to someone using claimyr.com and they were able to look at my full file and spot the issue. The online system doesn't show you these kind of flags.

Have you tried the unemployment office trick where you select the option for "filing a new claim" even though you don't need to? Sometimes those agents can help with backpay issues and that queue is shorter.

dude i feel ur pain. spent months trying to get my backpay from march-june. finally reached someone who said there was a "hold" on my account that no one bothered to tell me about. the system is BROKEN

same happened to me!! how did you finally get through to someone? i'm going insane over here 😭

used claimyr.com - they do the calling for you and connect when a human answers. only way i got a real person after 200+ calls on my own

Have you tried the DIRECT NUMBER? The regular customer service line is useless. Try 1-888-209-8124 but use the Spanish option then press 9 for English. Sometimes this bypasses the worst of the queues.

Ethan Brown

I'll try this tomorrow morning, thanks! Have you had success with this method personally?

0 coins

-

It worked for me once out of maybe 20 tries - still better odds than the regular line. Early morning is definitely best.

my brother was in THE EXACT same situation. he contacted our state senator's office and they fixed it in 2 weeks. don't waste time with the regular phone lines - they're designed to make you give up.

you're probably dealing with the infamous "backpay glitch" - happened to thousands of ppl including me. they approve you but the system doesn't auto-generate the backpay. you need a specialized agent to manually release those funds.

0 coins

-

Amina Bah

This! It's a known issue their tier 1 reps won't admit exists. You need to get to a supervisor or claims specialist.

0 coins

-

26d

Ethan Brown

How do you get to these specialized agents? Every time I call I just get the general helpline people who can't do anything.

0 coins

-

26d

Amina Bah

You have to specifically ask for a supervisor who handles backdating issues. Be polite but firm. If they say no supervisors are available, ask when one will be and request a callback.

Welcome to the backpay support group 😂 we're all suffering together. I waited 11 months to get mine. What eventually worked was calling at EXACTLY 7:59am and 57 seconds... literally timed it to hit the lines the moment they opened.

-

Natasha Petrova

11 MONTHS??! Omg they should be paying interest at that point 🤦‍♂️

-

Right?! I calculated I lost about $700 in potential interest if I'd been able to invest that money. But at least I finally got the base amount.

so I see we're all living the same nightmare... the backpay system is criminal. took me 7 call attempts using claimyr.com before I got someone who actually knew what they were talking about. the first 6 agents had no idea how to handle backdating.

i work in a related field (not unemployment but similar govt agency) and I'll tell you a secret - the agents CAN see your backpay status but many don't know how to access that screen in the system. Ask specifically for someone who can check the "payment history backend" not just the regular payment screen.

0 coins

-

Ethan Brown

This is super helpful insider info! Is there specific terminology I should use to make sure I get to the right person?

-

Ask for a "tier 2 payment specialist" or someone who can access the "payment adjudication system" - those keywords might help get you to the right department. Good luck!
