Is 4 months too long for ny unemployment back pay after identity fraud?
Just renewed my unemployment claim after my benefit year ended and it was approved in about 10 days. However, I'm still waiting on back pay from almost 4 months ago. Someone committed fraud on my account and I had to go through the whole identity verification process. Every time I call, the reps just tell me its "under review". Makes zero sense that they approved my new claim before resolving the back pay issue. I'm due around $7,800 in missed payments. Has anyone had any luck getting their back pay expedited? Or am I just supposed to keep waiting forever while bills pile up? This system is completely broken.

Sadly 4 months isnt even that long in NY unemployment time. I waited SEVEN months for my back pay after someone stole my identity. Had to verify everything with 50 documents and still took forever. Keep calling every week, thats what finally got mine moving.

seven months?? That's insane! Did you do anything specific when calling that finally worked?

honestly just being persistent. I called 3 times a week for 2 months straight. the system is designed to wear you down so you give up. don't give up!!

This is why I stopped trying to call NY unemployment directly. Complete waste of time. Use claimyr.com instead - they wait on hold for you and connect you directly to an agent.

After dealing with the same nightmare for months I found a service that calls NY unemployment for you and connects you with a real person (claimyr.com). Got through to someone who actually helped me resolve my identity fraud issue and release my payments. Best money I ever spent after waiting 3+ months for back pay. They have a YouTube video explaining how it works: https://youtu.be/Rdqa1gKtxuE

Does this really work? Seems sketchy tbh

100% worked for me. They just make the calls and connect you when someone answers. You talk directly to unemployment yourself. Saved me like 5 hours of being on hold.

not an app, just a service that waits on hold instead of you wasting your whole day. my back pay came through 1 week after talking to an actual human at unemployment

no they just call and wait on hold, then connect you when a real person picks up. you handle the actual conversation with unemployment yourself

You need to specifically ask for a "BACKDATE REQUEST FORM" when you call. Don't let them just tell you it's "in review" - that's their way of making you go away. I had to be super assertive about getting this form to fix my backdating issue after fraud on my account.

Bruh NY unemployment is such a joke. They froze my account for "identity verification" after someone tried to claim using my info. Took 5 MONTHS to get my money. They don't care that people can't pay rent or buy food. System is designed to make people give up.

facts 💯 they hope we'll just go away

its literally criminal how they treat people. we pay into this system our whole working lives and then when we need it they treat us like we're the criminals

I had to call my state senator's office to finally get it fixed. Try that if you've been waiting forever.

Here's what worked for me after 3 months of waiting: First, document EVERYTHING. Every call, every person you talk to, dates, times, what they told you. Second, call and specifically request to speak with a SUPERVISOR. Regular agents can't release payment holds for identity issues. Third, if that doesn't work, contact your state assembly person or senator. Their office can reach out directly to special liaisons at unemployment who can actually fix things. Fourth, email the commissioner's office directly with all your documentation. Be professional but firm. Fifth, if you're struggling to even get through on the phone, use claimyr.com - they wait on hold and connect you with an agent. Total game changer for me. The key is persistence and escalation. Don't just accept "it's under review" as an answer. Good luck!

Thank you for this detailed advice! I've been documenting everything but hadn't thought about contacting my state rep. Will definitely try that.

I can confirm the state rep route works. My assemblyman's office got my back pay released after I was stuck in limbo for months.

I'm in the exact same position! Identity theft, new claim approved but 5 months of backpay still "under review" 🤦♂️ NY unemployment is just hoping we'll go away. Keep calling!

Try calling right when they open at 8am. I had luck getting through that way. The identity theft backlog is crazy right now - apparently there was a huge fraud ring targeting NY unemployment that's caused massive delays for everybody.

Have you tried submitting additional identity documents? Sometimes they need more than what you initially sent. Go overkill - send birth certificate, passport, utility bills, everything. That's what finally worked for me.

This whole "it's under review" excuse is just NY unemployment's way of kicking the can down the road. You need to be PERSISTENT and call every day. Ask to speak to tier 2 specialists. Don't take no for an answer.

Tier 2 specialists are the only ones who can actually do anything. The regular reps just read scripts.

The ny unemployment system is a mess. My ID was stolen last yr & took 6 MONTHS to fix. Request a SUPERVISOR every time you call. Regular agents can't override fraud holds. Also try emailing their fraud department directly: laborfraud@labor.ny.gov

Went through the exact same thing last month. What finally worked for me was getting through to an actual claims specialist (not just the call center people) and having them submit an internal expedite request. You have to specifically ask for this though, they won't offer it.

Have u filed a fraud report with the police? I had to do that before ny unemployment would take my case seriously. Once I had a police report number they escalated my claim.

No I haven't done that yet. Did you file online or go to the station?
