Is 4 months too long for ny unemployment back pay after identity fraud?

Just renewed my unemployment claim after my benefit year ended and it was approved in about 10 days. However, I'm still waiting on back pay from almost 4 months ago. Someone committed fraud on my account and I had to go through the whole identity verification process. Every time I call, the reps just tell me its "under review". Makes zero sense that they approved my new claim before resolving the back pay issue. I'm due around $7,800 in missed payments. Has anyone had any luck getting their back pay expedited? Or am I just supposed to keep waiting forever while bills pile up? This system is completely broken.

Sadly 4 months isnt even that long in NY unemployment time. I waited SEVEN months for my back pay after someone stole my identity. Had to verify everything with 50 documents and still took forever. Keep calling every week, thats what finally got mine moving.

Try calling right when they open at 8am. I had luck getting through that way. The identity theft backlog is crazy right now - apparently there was a huge fraud ring targeting NY unemployment that's caused massive delays for everybody.

Have you tried submitting additional identity documents? Sometimes they need more than what you initially sent. Go overkill - send birth certificate, passport, utility bills, everything. That's what finally worked for me.

This whole "it's under review" excuse is just NY unemployment's way of kicking the can down the road. You need to be PERSISTENT and call every day. Ask to speak to tier 2 specialists. Don't take no for an answer.

The ny unemployment system is a mess. My ID was stolen last yr & took 6 MONTHS to fix. Request a SUPERVISOR every time you call. Regular agents can't override fraud holds. Also try emailing their fraud department directly: laborfraud@labor.ny.gov

Went through the exact same thing last month. What finally worked for me was getting through to an actual claims specialist (not just the call center people) and having them submit an internal expedite request. You have to specifically ask for this though, they won't offer it.

Have u filed a fraud report with the police? I had to do that before ny unemployment would take my case seriously. Once I had a police report number they escalated my claim.
