NY unemployment payments suddenly stopped in August - how to get backpay after returning to work?

My unemployment benefits unexpectedly stopped in August. I immediately refiled that same month but haven't seen a single payment since then. I've been diligently certifying every week from August through October while trying to get this resolved. Finally found a new job and started working last week, but now the system won't let me certify anymore since I'm employed. How am I supposed to get all my backpay from those 3 months? That's like $5,400 I'm owed! I've tried calling multiple times but keep getting disconnected or stuck on hold forever. The online messaging system just gives me generic responses. I need this money to catch up on bills I fell behind on while waiting for this to get fixed. Anyone know what steps I should take now that I'm working again but still need those missed payments?

same exact thing happened to me back in april. had to wait almost 4 months for back pay. the key is you HAVE to talk to a real person. I tried all the usual ways - calling 500 times a day, sending messages through the portal, even sent actual mail lol. its not a fix for unemployment itself. they just dial for you and stay on hold so you dont have to. when someone picks up, they call your phone. saved me hours of hold music torture

You need to call and specifically ask for "BACKDATE PAY". Dont let them transfer you around. Insist that you need to speak with someone who can process backdate payments. Sometimes the first rep you talk to doesn't have the authority.

Went through a similar nightmare last year. Here's what worked for me: 1) Call right when they open at 8:00am 2) Keep detailed records of every week you certified 3) Make sure you mention that you continued to certify while the issues were being resolved 4) Ask specifically for a Tier 2 specialist who can handle backdate claims 5) Be prepared to explain why your benefits stopped (they'll try to blame you) 6) If regular phone lines don't work, try the fraud department - sounds weird but they answer faster and can transfer you 7) If all else fails, contact your state assembly person - mine got it resolved in 2 weeks after I struggled for months The system is designed to frustrate you into giving up. DON'T. That money is rightfully yours. Also, services like claimyr.com can get you through to a human without the hours of hold time. Was skeptical but it worked when I was desperate.

It sounds counterintuitive but fraud dept has way shorter hold times & they can transfer you to regular claims. They're just a backdoor into the system basically.

The exact same thing happened to my roomate and we're in NY too. He filed an appeal and still nothing after 2 months. finally he went nuclear and emailed every single person in the DOL directory he could find plus the governors office. Some lady from benefits review called him back the next day and fixed everything. Try that if ur desperate enough.

I call bullshit on ny unemployment saying people cant get backpay. legally they have to pay you for any week you were eligible and properly certified. The problem is GETTING TO SOMEONE who will actually process it!!! the whole system is rigged to wear people down so they give up. its criminal 🤬🤬🤬

Actually not true. They only have to pay for weeks within a certain timeframe. If you wait too long you can lose eligibility for those weeks.

Check if your benefit year ended. That's usually what happens - your BYE (benefit year end) date comes up and they automatically stop payments until you refile, but then the new application gets stuck in review. Call and tell them specifically you need them to check if your new claim is pending review.

mine took about 5 weeks, but my friend's took 3 months. It's totally random it seems. Definitely call them tho, sometimes they can expedite it if you explain your situation

I create a spreadsheet of all my certifications with dates and confirmation numbers. when I finally got through to someone I rattled off all those details and they could see I was serious. had my backpay within a week. Be organized and dont take no for an answer.

Did you get an email or letter saying your claim needed additional review? Sometimes they send these to your online message center only and dont email you. Worth checking

Make sure when u call u dont take no for an answer. Half the agents don't know what they're doing or are just lazy. Ask for a supervisor if they try to brush you off. You certified those weeks so ur entitled to that money
