Will my overpayment affect getting my ny unemployment benefits restored?
My unemployment benefits were suddenly stopped on October 12th without any explanation. I've been trying to get them turned back on for three months now. When I finally reached someone at the department after countless calls, they mentioned something about an overpayment from last year that I wasn't even aware of. Apparently I was overpaid about $1,880 because I accidentally reported my hours wrong for a part-time job. Would this be why they're taking forever to restore my benefits and release all my backpay? I'm owed benefits from mid-October through now and desperately need that money for rent and bills. I've submitted all the requested documents twice already but still no progress. Anyone deal with something similar?

Yes! That's exactly what happened to me. They stopped my benefits in August because of a $2,100 overpayment from like 6 months before. Took them 14 weeks to restart my payments after I set up a repayment plan. The system is designed to punish you first, ask questions later. 😡

Yeah they finally did but they took out like 25% of each payment to cover the overpayment. Better than nothing I guess

Yup it's definitely because of the overpayment. They put a hold on everything until you deal with that issue first. The stupid part is they don't even tell you clearly thats whats happening. You gotta call them and set up a payment plan. They can take a portion from future benefits or you can pay it monthly.

The overpayment unit number should be on any letters they sent you about the overpayment. If you didn't get a letter, definitely use claimyr.com to get to a rep who can transfer you to the right department.

Have you tried contacting your state rep? Sometimes they can light a fire under DOL to move things along. Worked for me when I was in a similar situation.

Just google "find my NY state representative" and put in your address. Send them an email explaining your situation. They usually have staff that specifically handles constituent issues with state agencies.

Make sure you APPEAL if you think the overpayment was a mistake! You only have a limited time to do this. I got hit with a $2400 overpayment and got it reduced to $600 after I proved some of their calculations were wrong.

Check if there's an option on your online account to set up a payment plan for the overpayment. Sometimes you can do it without even talking to anyone. Otherwise good luck getting through on the phone... took me 30+ calls over 3 weeks 😫

it's not like other services - they just call and wait on hold for you then connect you with the actual DOL agent. you talk directly to unemployment, not some third party. saved me hours of hold time.
