NY unemployment took money for "forfeit days" that I already paid back last year!

Just discovered ny unemployment deducted money from my last two payments claiming I had "forfeit days" from an overpayment situation. The crazy thing is, I already paid back this exact overpayment in November 2022! I got a notice back then saying I had reported my hours wrong for three weeks in May, and they took the money directly from my bank account. Now they're taking it AGAIN from my current benefits claiming these are forfeit days I still owe. I checked my records and the amount they took matches exactly what I already paid. Called the unemployment office five times this week but can't get through to an actual person. The automated system just tells me about my claim status which I already know. Has anyone dealt with this double-charging situation? I'm missing about $840 that I desperately need for rent this month.

This happened to me too! They took 4 weeks from me in July saying I had forfeit days from 2021, but I had proof I paid the overpayment already. The system is completely broken. I finally got it fixed but it took forever.

Had to actually speak to a real person. That was the ONLY way. I tried emails, messages through the portal, nothing worked. Getting someone on the phone is like winning the lottery these days.

Yeah basically they have some system that autodials and waits on hold so you don't have to. When a human finally answers, it connects to your phone. I was done in 20 mins after the agent picked up and they fixed my issue immediately.

The forfeit days thing is a complete nightmare. I had something similar where they applied an old issue to my new claim. You HAVE to get through to a tier 2 specialist. Regular call center people cant fix this type of problem.

I work in a legal aid office and we've seen a huge spike in these forfeit day issues recently. There seems to be a system glitch causing old penalties to reappear. Document EVERYTHING - dates, confirmation numbers, previous payments. When you eventually get someone on the phone, be prepared with all this information.

Do both. File an appeal through the portal to get in the queue (it creates a paper trail), but also try to reach someone by phone. The phone resolution will be faster if you can actually get through.

When this happened to me, I had to contact my state assembly person. Emailed their office with all my documentation and they helped push it through. Got my money back in about 10 days. Try that route if you cant get through on the phone!

The repayment system and the forfeit day system are separate, and one isn't recognizing that you've already paid. If you're having trouble getting someone on the phone, try claimyr.com - they'll wait on hold and connect you when a real person answers. Saved me hours of frustration. Don't give up! This is YOUR money and they made the mistake, not you. Also make sure to file a formal appeal right away - there's usually a 30-day window to contest these decisions.

Yeah, have your bank statements ready showing the previous withdrawal/payment. Also any correspondence about the original overpayment. If you have a confirmation number from when you paid, that's golden. Good luck!

File a complaint with the NY Attorney General's office online. Sounds extreme but it works. My brother had this exact issue and filing that complaint got it resolved in 2 weeks. They hate when other agencies start looking into their mess.

My cousin works at unemployment and says theyre dealing with a major system update that messed up a bunch of old records. Apparently a ton of people are having this issue rn. He says just keep calling until you get through. Mornings are best.

Check if your bank can show proof of the previous payment. I had to get an official bank letter showing the transaction from last year and upload it to my ny unemployment account along with a written statement. It took 3 weeks but they eventually reversed the forfeit days and paid me back.

they did this to me too!!! its the worst. call your state senator's office NOW. explain the situation and they can help. my senator's office has a dedicated person who deals with unemployment issues and they fixed mine in a week when i couldnt get anywhere for a month by myself

word of advice: RECORD EVERYTHING. keep copies of all notices, take screenshots of your payments and account. ny unemployment "lost" my proof of payment twice and tried to tell me i never paid anything. keep digital AND paper copies.

Is it possible you have a different overpayment? Sometimes people get confused because they had more than one issue. Double check all your DOL correspondence to make sure this isn't a separate overpayment.

i faxed them my documents (yes FAXED because sometimes their online system doesnt work) and they fixed my issue. try sending a fax with all your proof. sounds ancient but sometimes the old ways work better with them
