NY unemployment suddenly canceled my benefits claiming I committed fraud?
I'm freaking out right now. After collecting unemployment for about 8 weeks, I logged into my account this morning to certify and saw a notice saying all my benefits have been forfeited due to "identity fraud." I never committed any fraud! I've been filing exactly as instructed since I got laid off from my restaurant job in February. They're claiming I need to pay back $3,780 that I already received and used for rent and bills. I've tried calling the NY unemployment office 27 times today but can't get through to anyone. The automated system just disconnects me. I've sent 3 emails through their contact portal but only got generic automated responses. They didn't even send me a letter about this beforehand - just suddenly cut everything off with no warning. How is this possible? Has anyone else had this happen? I'm legitimately myself, have all my documentation, and have been honest on every certification. I can't afford to pay back anything when I'm still unemployed. What should I do?

I had the exact same thing happen to me last month! I was on UI for 12 weeks after getting let go from my retail job and suddenly they said I committed fraud and owed $4,200 back. turns out someone had filed another claim using my social security number in another state. you need to report identity theft ASAP and dispute the determination. they eventually fixed mine but it took 4 weeks of pure hell.

Did you have to talk to someone on the phone? That's what I'm struggling with most - I literally cannot get a human on the line no matter what time I call!

yeah talking to an actual person was the key. I couldnt get through either until I tried claimyr.com - they called for me and connected me to an agent when they picked up. cost some $ but saved my sanity and benefits

100% worked for me. Got a call back within like 2 hours and the agent was able to put a hold on my repayment while they investigated. Best money I ever spent considering I was about to lose thousands.

I've never heard of this claimyr thing, but if it actually gets you to a human at ny unemployment I might try it. Been trying for 2 weeks straight with no luck ๐ฉ

After trying for THREE WEEKS to get someone on the phone at unemployment, I finally found a service that actually works! Used claimyr.com and they called for me, stayed on hold, then connected me when an agent picked up. It was the only way I could talk to a live agent. I was in exactly the same situation - they accused me of fraud but it was a mistake. Talking to an agent got my $ unlocked so fast. Check out their explainer video here: https://youtu.be/Rdqa1gKtxuE

I've been seeing that site mentioned a lot lately. Is it just another way to get scammed when I'm already dealing with this fraud mess?

they don't ask for any personal info about your claim, just connect you with the actual unemployment office. saved me from losing 6 weeks of benefits when I was flagged for fraud

This is happening ALL OVER right now. NY unemployment has a massive identity verification backlog. I work at a legal aid office and we're seeing dozens of these cases weekly. Here's what you need to do: 1) Document everything - screenshot that message about forfeiture 2) File an identity theft report with the FTC at identitytheft.gov 3) Request a fraud investigation through your unemployment portal 4) Call unemployment - yes I know it's nearly impossible, but you MUST speak to someone 5) Gather all your proof of identity (birth certificate, SS card, passport if you have one, driver's license, several utility bills) The system is completely overwhelmed with actual fraud cases, so legitimate claimants are getting caught in the net. Do NOT pay anything back until you've gone through the appeals process! If you absolutely cannot get through on phones, claimyr.com has been effective for many of our clients as a way to reach a live agent. It's worth considering if traditional methods aren't working. Just be persistent and document everything.

Thank you for the detailed response. I've already started the FTC report. Would sending documents through the message portal help or is that useless without talking to someone first?

Definitely upload any documents you can through the portal, but in my experience you'll still need to speak directly with an agent to get this resolved. They need to manually flag your account for proper review.

is there a timeframe for how long these reviews take? my cousin's been waiting 6 weeks after being accused of fraud

It's taking 3-8 weeks typically, but cases where the claimant successfully speaks to an agent get resolved faster - usually 7-15 days after the conversation.

the whole NY unemployment system is a joke. I got falsely accused of fraud in December and im STILL fighting it. They want me to repay $7k when I did nothing wrong! good luck getting a human on the phone - i tried for WEEKS.

Did you use the same device/IP address to log in each time? Sometimes their system flags accounts for fraud if you suddenly log in from a new location or device. Worth mentioning when you finally reach someone.

That actually might be it! I was using my home wifi for weeks then certified from my phone on cell data last week when my internet was down. That was right before this happened.

Yep, that'll do it. Their fraud detection system is hair-trigger sensitive right now. When you talk to an agent, explain that circumstances first thing.

you NEED to appeal this ASAP! there should be a "request for hearing" option somewere in ur account. NY unemployment is giving people like 30 days to appeal these decisions. dont wait!!

same boat. I got flagged last week. called 50+ times. finally got thru yesterday and they said it was a "system flag" that needs manual review. keep trying to call!

This is yet another reason why the entire unemployment system needs to be rebuilt from the ground up. We're using technology and processes from 20 years ago and expecting it to handle modern problems. I'm sorry you're dealing with this nightmare.

Contact your state representative IMMEDIATELY. This worked for me when I had a similar issue. Find your NY state assembly person and senator, email AND call their offices explaining the situation. They have special contacts at unemployment who can escalate cases.

This is the right answer! My state rep got my issue fixed in 5 days after I spent weeks trying on my own.

you need to check if someone filed taxes using your SSN. happened to me - someone filed unemployment in my name while i was still working, then when i actually needed benefits i got accused of fraud. check your credit reports ASAP

I know everyone's gonna say "call call call" but let's be real - you're not gonna get through. I wasted 3 weeks trying before I used claimyr.com and got a callback same day. The agent was able to see it was a system error that flagged my account. Two days later my benefits were reinstated and I didn't have to repay anything.

I actually used this service last month when I couldn't resolve an issue with my claim. It's just a call service that waits on hold for you. Got me through to someone who fixed my claim after weeks of trying on my own.

do NOT pay anything back until you've gone through the entire appeals process!! they are sending these notices out by mistake to thousands of people. my neighbor got the same thing, fought it, and got her benefits restored + back pay

That's a relief to hear. I was panicking about how I'd ever pay back that amount when I'm still jobless. Did your neighbor have to hire a lawyer?

no lawyer needed. she was able to talk to someone directly at unemployment who helped her fill out the right forms to contest it. but getting through on the phone was the hardest part

classic new york unemployment nonsense. they LOVE to accuse people of fraud with zero evidence. happened to me in 2019 (pre-pandemic) and it took 4 months to fix. the system is designed to frustrate you into giving up.

Make sure you didn't accidentally answer a certification question wrong. I nearly had this happen because I misunderstood a question about being "available for work" during a week I had a medical appointment. Even one wrong answer can trigger fraud flags.

I triple-check all my answers every week, but maybe I slipped up somewhere? It's so stressful when one tiny mistake can cost you everything.
