Identity theft on ny unemployment claim - someone filed taxes using my SSN

I'm freaking out right now. I filed for unemployment in October after being let go from my job, and everything seemed fine for about two months. Yesterday, I logged into my account to claim my weekly benefits and found out someone had hijacked my unemployment claim! They changed the direct deposit info to some bank I've never heard of. I immediately called the fraud department but got stuck in the automated system for hours. This morning I checked my email and found a notification about tax forms being available. When I logged in to check, there was a 1099-G showing about $12,400 in benefits paid out - but I've only received around $4,800 since October! Someone has been collecting MY benefits using MY social security number for months without me knowing! I've tried calling the NY unemployment office 23 times today but can't get through to a human. Their website is useless - there's no clear process for reporting identity theft related to benefits. Has anyone dealt with this before? What should I do? I'm worried about tax implications and my credit score being wrecked.

It took forever but yes. Had to file police report, contact credit bureaus, and literally show up IN PERSON at the local unemployment office (after trying to call for weeks). Still dealing with some IRS issues tho 😭

Then file a police report and contact the FTC at IdentityTheft.gov to fill out an identity theft report. I went through this hell last year and waiting even a day could make things worse.

Hate to tell you this but ur gonna be dealing with this for months. The DOL is completely overwhelmed with fraud cases. My cousin works there and says they're seeing THOUSANDS of these cases every week. The system is broken af and they're understaffed.

friendly reminder that if u get an email claiming to be from NYSDOL asking u to "verify ur information" DO NOT CLICK IT!! thats how a lot of these scammers are getting peoples info in the first place

About 3 weeks from when I finally got a human on the phone. They had to create a whole new claim for me with a different claim ID. But at least I was able to get weekly benefits while they investigated.

I don't want to freak you out more, but check if your address was changed with USPS too. When this happened to me, the scammers had also filed a change of address so they could intercept my mail. It's a whole identity theft ring thing.

Also check with your cell phone carrier! Some scammers try to do SIM swaps to get your 2FA texts/calls too. This identity theft stuff goes deep.

I feel for ya. The ny unemployment system is a complete disaster right now. Been there, done that. If you can't get thru on the phone, try faxing (yes, faxing lol) your identity theft report to them. Sometimes old school works when their phone lines are jammed.

I work for a tax prep company and see this ALL THE TIME now. OP - when you file your taxes next year, you'll need to file a form 14039 (Identity Theft Affidavit) with your return. Also, request an Identity Protection PIN from the IRS so this can't happen again.
