Someone stole my ny unemployment identity and now I can't get my tax forms

I discovered something terrible when trying to do my taxes this year. I haven't collected any NY unemployment since 2022, but when I created an account on the tax website to get my documents, it showed that someone had been collecting benefits using my social security number since September! Over $7,400 in benefits that I never received. I immediately tried calling the unemployment office but couldn't get through after trying for days. Sent multiple emails through their contact form but just got automated responses. Finally drove 40 minutes to my local DOL office where they told me they couldn't help with identity theft issues over the counter and I needed to speak with someone on the phone. It's been 6 weeks now, my tax filing deadline is approaching, and I'm terrified the IRS will think I'm hiding income. I've filed a police report and an FTC identity theft report, but unemployment still hasn't fixed anything in their system. How am I supposed to file taxes when someone else's benefits are being reported under my SSN? Has anyone successfully resolved this kind of identity theft with NY unemployment?

Ugh this exact thing happened to my brother. Someone used his info to collect benefits for like 4 months before he found out. He had to submit a fraud claim with unemployment, file a police report, and contact all three credit bureaus to put a freeze on his credit. It took almost 3 months to get it all sorted out, and he ended up having to file for a tax extension because the corrected forms weren't ready in time. he kept calling EVERYDAY like first thing in the morning. Eventually got through to someone who transferred him to the fraud dept. But honestly what finally worked was contacting his state senator's office. They have special contacts at these agencies that can cut through the bs.

Not a miracle, just a way to skip the phone queue. You still have to deal with the agents (who can be hit or miss) but at least you GET to an agent. I was about to give up before finding them.

No they just get you through to someone on the phone. The rest is up to you and the agent. My issue got fixed because I finally could TALK to someone instead of getting disconnected for the 500th time.

File form 14039 (Identity Theft Affidavit) with the IRS immediately! This puts a flag on your account so they know something sketchy happened. Also request a PIN for future tax filings. I went thru this last year and waiting too long made everything worse.

This happened to SO many people during the pandemic and NY unemployment still hasnt fixed there systems 🤦‍♀️ I work at an accounting firm and we had dozens of clients with this exact problem. Make sure you're documenting EVERYTHING - dates you called, who you talked to, confirmation #s, etc. When you finally get it resolved, you'll need an official letter from NYSDOL stating the benefits were fraudulent and not paid to you.

If possible, file an extension and wait for the corrected forms. Filing with the wrong info can trigger audits and create more headaches. But absolutely file the extension properly - penalties for late filing are worse than penalties for filing with errors.

The unemployment website has a specific identity theft reporting form now. Go to ny.gov/unemployment and look for 'Report Fraud' at the bottom of the page. I filled that out AND called, which seemed to make things move faster. Still took 5 weeks tho 😩

Every call, email, letter - note the date, time, who you spoke with, and what was said. This will be crucial if you need to prove you've been trying to resolve this. Don't give up! It's a frustrating process but persistence eventually pays off.

Yes, I did file an extension. My accountant said not to file with incorrect information because it would just create more problems to fix later. When you do get it resolved, make sure you get an official letter stating the benefits were fraudulent - you'll need this for the IRS.

My theory is they don't want to make it too secure because then it would slow down the process when they need to get money out fast during economic downturns. But yeah the current system is WAY too vulnerable.
