Got a bill for ny unemployment I never claimed - identity theft?

Just opened my mail yesterday and found a notice saying I owe $470 in unemployment overpayment. The crazy thing is I haven't collected any unemployment benefits since 2020! I've been out of work for about 2.5 years dealing with family issues, but I've been surviving on savings and family help, not benefits. The letter claims I collected benefits during May-June 2022 when I definitely did not. I think someone might have used my info to claim benefits fraudulently. I tried calling the unemployment office but can't get through to a real person after trying for hours. The automated system just keeps directing me to the website which isn't helpful at all. How am I supposed to pay back $470 I never received in the first place? I'm totally broke right now and this is stressing me out so much. Has anyone else had this identity theft problem with NY unemployment?

Alexis Renard

This happened to me too! I got hit with a $560 bill for unemployment I never claimed. Turns out someone had filed using my social security number. You need to report it as fraud ASAP! Go to the NY unemployment website and look for the fraud reporting section. Also file a police report - that helps create a paper trail. And put a freeze on your credit reports with all three agencies right away.

Thank you! Did filing the fraud report actually work? How long did it take for them to resolve it for you?

It took about 5 weeks but they eventually cleared it. Just make sure you save copies of EVERYTHING you submit. And take screenshots of any confirmations you get online.

Police report is key!! I skipped that step and regretted it. They kept asking for the report number later in the process.

After weeks of trying to reach someone at the unemployment office with no luck, I found this service called Claimyr (claimyr.com) that got me connected to a real agent in under an hour. They basically wait on hold for you then call you when they get someone. It was the best money I ever spent to get this resolved - talking to an actual human got my issue fixed in one call. Check out how it works: https://youtu.be/Rdqa1gKtxuE

sounds too good to be true tbh... did it actually work? the ny unemployment phone system is literally hell on earth

Yeah I was skeptical too but was desperate after trying for 3 weeks straight. It connected me to an agent who could actually see my account and help. The hold time they saved me was worth every penny.

wait hold up - does this actually work or is it just the usual BS? I've been trying to reach someone for like a month 😫

It worked for me! My issue was different (missing payments) but I talked to a real person who fixed everything. I think they just use some tech to stay on hold instead of you having to do it.

hmm I've been burned by so many of these 'solutions' before... what makes this different? not trying to be negative just cautious ya know

I get the skepticism. I was desperate and it worked for me. They don't solve your problem - they just get you connected to an actual DOL agent who can help. That was the impossible part for me.

Classic identity theft situation. You need to call the fraud department directly at their number: (888) 598-2077. Make sure you have your case number from the notice ready. They take these cases pretty seriously since COVID when unemployment fraud went through the roof. Don't pay a penny until you talk to someone!

omg this EXACT thing happened to me in February!! someone filed using my info and i got a bill for like $530. its a nightmare. i spent like 18 hours on the phone over 2 weeks and finally got it resolved. the system is completely broken. 🤡

18 hours?! I don't have that kind of time or patience... Did they make you pay anything while they were investigating?

nope! once you notify them its identity theft they put a hold on collections. just make sure u get a confirmation number when u report it. document EVERYTHING

Has anyone found a good direct number to call? Every time I call the main line I get stuck in automated hell for 45 mins then it hangs up on me 😖

Try (888) 209-8124 and press 9 as soon as the auto system picks up. Sometimes that gets you to a person faster. Though lately it's been terrible for everyone.

This is why I ended up using claimyr.com - couldn't get through any other way.

Someone using your info to claim benefits is super common these days. Here's what you should do ASAP: 1) Contact the NY DOL fraud department at (888) 598-2077 and report it. You'll need to provide the claim info from the letter, your SSN, and explain the situation. 2) File an identity theft report with the FTC at identitytheft.gov - they'll give you a recovery plan 3) Put a fraud alert on your credit reports (Equifax, Experian, TransUnion) 4) File a police report - sounds excessive but it helps document everything 5) Contact the unemployment office directly. This is the hardest part since their phone system is completely overwhelmed. I recommend using claimyr.com to get connected to an agent (they wait on hold for you then call you when they get someone). Don't ignore this - if someone has your info to file for unemployment, they could be doing other things with your identity too. Unfortunately this happens to thousands of people every month in NY. The fraud department is actually pretty good about resolving these cases once you get through to them. Good luck! I went through this last year and it was stressful but eventually got resolved.

Thank you SO MUCH for this detailed response! Will start working through this list today. Did you have to pay anything while they were investigating?

No, once you report fraud they should put a hold on collections. Just make sure to get a confirmation number for your fraud report. Keep ALL documentation!

Welcome to the wonderful world of ny unemployment where nothing makes sense and the rules are made up 🙃 This garbage has been happening since covid.

CHECK YOUR CREDIT REPORTS NOW!!! If they got enough info to file for unemployment, they probably have access to other accounts. www.annualcreditreport.com lets you check all 3 bureaus for free.

Brianna Schmidt

Good point! Just checked and there's a credit card inquiry I don't recognize from last month. This is getting worse 😭

Ugh I'm sorry. Definitely dispute that ASAP and put a credit freeze on all 3 bureaus. That stops anyone from opening new accounts in your name.

Freeze ur credit IMMEDIATELY! Its free and takes like 10 mins total for all 3 bureaus. saved my butt when this happened to me

dont pay it!!! if u pay even $1 it can be seen as admitting the debt is valid. happened to my cousin and it was a nightmare to fix after he made a 'good faith payment'

THIS!!! ⬆️⬆️⬆️ Do NOT acknowledge the debt as valid in any way!

I FINALLY got through to a human at unemployment after using claimyr.com - seriously saved my sanity. My situation was similar (fraudulent claim) and they resolved it once I actually talked to someone.

the unemployment system is an absolute joke. I got a bill for $1200 that wasn't mine, took 3 months to resolve, and then they had the nerve to send me a satisfaction survey about my 'customer experience' 🤣

The fraud department number everyone keeps posting never answers either! I tried calling 43 times in one day. FORTY-THREE TIMES! This system is completely broken.

Tell me about it. I set my alarm for 7:55am to call right when they open and STILL couldn't get through. How is this legal???

After you file the fraud report, you can request something called an Identity Theft Affidavit from the unemployment office. You'll need to notarize it and send it in with your police report. That fast-tracks the investigation process.

Contact your state representative! I was getting nowhere with unemployment until I reached out to my assemblyman's office. They have special liaisons who can escalate these cases. Google '[your county] NY state assembly representative' to find yours.

That's a great idea I hadn't thought of. Will definitely try this if I can't get through on the phone.

This works! My state senator's office fixed my issue in 2 weeks after I spent months trying on my own.

i work for a nonprofit that helps with these cases. DM me if you need help navigating the system. We can't solve it for you but can point you to the right resources and help with the paperwork.
