Been victim of fraud in the ny unemployment system, what now?

So I found out that someone has been claiming ny unemployment benefits using my identity for the past 4 months. I never even applied! My employer reached out to me last week asking why I filed for unemployment when I'm still working full-time. I was shocked and told them I definitely didn't file anything. I immediately checked my email and found notifications from NYSDOL about benefits being deposited that I never received. Looks like they've been paying around $580 weekly to some random bank account since August. I called the fraud department yesterday and waited over 2 hours before someone finally picked up. They told me they'd put a hold on the claim and flag it for investigation, but couldn't tell me how long it would take or what I need to do next. They also said I should contact the police and file a report, check my credit report, and freeze my credit. I'm freaking out because that's nearly $9300 stolen using my information! Has anyone dealt with this before? How long did it take to resolve? Will I need to pay this back somehow even though I never received the money?

Dude this same exact thing happened to me in September!! My boss called me in and I thought I was getting fired but he was asking why I was collecting unemployment when I was working 40 hours a week! Someone had been collecting about $530 weekly for like 3 months using my info. I filed a police report immediately and called the fraud dept. Took me forever to get through.They put my claim on hold but its been 6 weeks and still no resolution. The police basically said theres not much they can do either 🤷‍♂️

Yeah it actually works! They basically call the unemployment office for you and use some tech to wait in the hold queue. Then they call you when they get a real person on the line. Talking to an actual agent got my case moved up the priority list.

DEFINITELY freeze all your credit reports immediately! I had the same thing happen and they tried opening credit cards in my name after getting my info from the unemployment scam. Go to all three credit bureaus (Experian, Equifax, TransUnion) and put freezes. Also file an identity theft report with the FTC at identitytheft.gov - they'll give you a recovery plan. And keep checking your credit reports weekly!

Here's what you need to do RIGHT NOW (speaking from experience after this happened to me last year with ny unemployment): 1) File a police report ASAP and get a copy - you'll need this documentation for everything else 2) Contact all three credit bureaus and place a fraud alert AND credit freeze 3) File Form 14039 (Identity Theft Affidavit) with the IRS immediately 4) Keep detailed records of EVERY call and interaction - names, ID numbers, dates, times 5) Contact your HR department and have them help document that you've been employed during this period 6) Set up a separate email folder for all correspondence about this issue 7) Call the unemployment office again but try using claimyr.com to actually get through - regular calling was useless for me but using their service got me to a senior agent who could actually help 8) Check your mail frequently - they might send important documents The resolution time varies wildly. Mine took about 10 weeks, but I've heard anywhere from 6 weeks to 6 months. The good news is that you won't be held responsible for the fraudulent payments once your case is resolved. The hardest part is getting through to someone who can actually help at NYSDOL. Once I got through using Claimyr, things moved much faster.

have you checked your mail? sometimes they send you a letter with a specific number to call for fraud. its different than the regular unemployment number and usually less of a wait time.

This happened to me too omg! The thing that finally worked was getting ahold of a SUPERVISOR in the fraud dept. Regular agents couldnt do much. I spent 3 days calling over and over. Waste of time 😤 My case was resolved after 7 weeks but only cuz I kept calling.

You have to specifically ask to speak to a supervisor or fraud specialist. If they say no, hang up and try again with a different agent. Took me like 5 attempts before someone transferred me.

Contact your state representative!!! This was the game changer for me. Their office has special contacts at unemployment and can cut through all the BS. Email them explaining your situation and they can help escalate your case.

Yep! Just google "find my NY state representative" and it'll show you who represents your district. Send them an email with all the details and documentation. They usually respond within a few days. My rep's office called me back the next day and had direct contacts at NYSDOL.

The same thing happened to my wife. She only found out when she got a 1099-G tax form showing she'd supposedly received $14,000 in unemployment benefits! The whole system is a joke. Take screenshots of EVERYTHING and document every call. It took us 4 months to get it resolved.

Check if your employer recieves a 'Notice of Determination' letter. My company got one when this happened to me. Ask for a copy - it has the claim details that you'll need when reporting the fraud.

Yes, my HR department had to submit an employer protest form stating I was still employed full-time. They also provided payroll records proving I was working during the claim period. Definitely get them involved early!

there was a HUGE data breach back in 2020-2021 where scammers were targeting unemployment systems across the country. ur just one of thousands of victims. the wait times are insane because theres so many fraud cases. its not just you, the whole system is a dumpster fire rn

Don't freak out too much about having to pay it back. As long as you report it and follow the process, you won't be liable. Just make sure you document EVERYTHING. I mean everything - screenshot emails, record call dates/times/names, etc. This will be key when it comes tax time.

I had to physically go to my local DOL office to get help. The phone system is useless. Check if there's one near you and just show up with all your documentation. Got more done in one visit than in weeks of calling.

Most offices require appointments now but some have walk-in hours. Check their website for the location nearest you. Bring ID, the police report, and any other documentation. Much better than phone!

i'm a tax accountant and see this ALL THE TIME now. make sure you get a corrected 1099-G for tax filing next year. the DOL will send you one showing all that unemployment income unless you get your case resolved and get them to issue a corrected one showing $0.

They usually send them out by late January/early February. But for fraud cases that get resolved later, it can take 4-8 weeks after resolution to get the corrected form. If you don't have it by April, file an extension for your taxes!

pro tip: RECORD YOUR PHONE CALLS with the unemployment office (check if your state is one-party consent first). I recorded all mine and it saved me when they tried claiming I never reported the fraud. Played the recording for a supervisor and suddenly they found my case 💅

Check if the scammer changed your address with USPS too! This happened to me - they filed a change of address form to redirect my mail. Had to go to the post office with ID to fix it. These scammers are thorough 😡

They tried to open credit cards but the freezes stopped them. Also check with your cell phone carrier - they sometimes try to port your number to get access to 2FA codes.
