Identity theft messing up my NY unemployment claim - what do I do now?

I found out someone used my identity to file for unemployment back in August! I only discovered this when I got laid off last month from my job in construction and tried to apply for benefits myself. When I called ny unemployment, they told me my SSN already had an active claim since August, receiving weekly payments of $570 that I never saw a penny of. Now they've frozen everything and sent me to their fraud department. I've been waiting 3 weeks with zero income while they 'investigate'. I filed a police report, contacted credit bureaus, and even went to the unemployment office in person but they just say I have to wait. Anyone dealt with this before? How long am I supposed to survive with no money coming in? I have rent due next week and my savings are almost gone.

This happened to me too, but it was back in April. Someone filed using my info and collected for 2 months before I found out. I had to wait almost 6 weeks for the fraud investigation to finish before I could file my own claim. Call the fraud department EVERY DAY. Seriously, be annoying AF. I ended up getting backpay for the weeks I waited but it was a nightmare. Also go ahead and place a fraud alert on your credit report asap if you haven't already.

6 weeks?! I can't wait that long, my landlord's already getting impatient. Did you have any luck getting through to the fraud department? I keep getting voicemail.

I know it sucks but yeah took forever. Try calling right when they open at 8am. Thats how I finally got through. The whole system is broken man.

Did you have to provide a ton of documentation? I'm going through something similar and they're asking for like my firstborn child and a DNA sample 🙄

Yep so much paperwork. Had to send my birth certificate, drivers license, SS card, utility bills, everything short of a blood sample lol. Keep copies of EVERYTHING you send them.

After dealing with a similar situation and getting nowhere for weeks, I found a service called Claimyr (claimyr.com) that got me a callback with an actual human at unemployment. Talking to a real person made all the difference - they escalated my case and I got my account unlocked way faster. Best money I've spent to get my benefits flowing again. uhh this sounds sketchy af. another 'miracle solution'... what's the catch? 🙄

0 coins

No catch - it just gets you past the hold times. I was skeptical too but was desperate after trying for 2 weeks to reach someone. They just connect you with an agent, you still handle your own claim.

0 coins

not falling for another unemployment 'hack'... these never work. anyone ACTUALLY try this besides the person promoting it?

0 coins

I used it last month when my payments suddenly stopped. Got connected to an agent in about 45 mins when I'd been trying for days on my own. Agent fixed my issue on the spot.

wait hold up - does this actually work or is it just the usual BS? the unemployment system seems designed to make you give up

0 coins

It worked for me! Was literally about to give up after being on hold for 3+ hours multiple days. The callback system saved my sanity.

You need to file an identity theft report with the FTC RIGHT NOW at identitytheft.gov - this creates an official federal record. Then take that to the unemployment office in person. Also notify all 3 credit bureaus. I had to do this last year and it took 2 months to resolve but I eventually got all my benefits.

I work in cybersecurity and unfortunately identity theft with unemployment claims is HUGE right now. Make sure you're also monitoring your credit, bank accounts, and tax records. Sometimes these thieves file fraudulent tax returns too. The unemployment office is overwhelmed with these cases, which is why they're slow to resolve them.

Oh great, now I'm worried about my tax returns too... Any specific things I should be watching for?

Check if you can get an Identity Protection PIN from the IRS for next tax season. Also monitor your IRS account online and check for any weird letters from IRS about filings you didn't make.

This is why I froze my credit at all three bureaus years ago. Best decision ever. 👍 Still a pain dealing with the unemployment system tho

The exact same thing happnd to me and heres what worked: go to your state representatives office and ask for help. Sounds weird but my case was stuck for 5 weeks until I contacted my state rep. Their office has special contacts at unemployment and got my case resolved in 3 days after I'd been waiting over a month!

0 coins

THIS!!! 100% the way to go. I did this too and it was like magic. They have direct lines to people who can actually help.

0 coins

Wow really? I never thought about contacting my rep. Do I just call their office or go in person?

0 coins

Both work but in person is better. Bring all your documentation and they'll have you fill out a form authorizing them to inquire about your case. Total game changer.

Try reaching out to the AG's office too. They have a specific division for benefits fraud now becuz theres been so many cases lately. I know several people who got help faster this way than waiting on unemployment to figure it out.

Listen, while your dealing with all this BS, apply for emergency assistance through local charities and nonprofits. Catholic Charities, Salvation Army, and your local Community Action Agency all might be able to help with rent and utilities while this gets sorted out. Don't wait until you're completely broke.

Thanks for this idea. Didn't even think about it. I'll start making some calls tomorrow.

This is EXACTLY why the ny unemployment system is such a joke. They're super quick to send out benefits to scammers but take forever to help actual taxpayers who need help. I've been in your shoes and it took me 8 weeks to get my identity theft case resolved.

For what its worth, I had a similar situation and ended up getting ALL my back pay once they verified my identity, so don't lose hope! They backdated my claim to when I first tried to apply. But yeah the waiting period is brutal.

That's actually really good to hear. I was worried they might deny me completely because of this mess.

Here's exactly what you need to do (I work in fraud prevention and have helped several people with this): 1) Report to FTC at identitytheft.gov 2) File a police report - get a physical copy 3) Place a freeze (not just an alert) with all 3 credit bureaus 4) Contact the fraud department daily - document every call with date, time, who you spoke with 5) Send a certified letter to unemployment with copies of all your ID, the police report, and FTC report 6) Contact your state representative AND state senator's offices 7) If you're desperate for a quick response, try claimyr.com - I've had clients successfully use this to get through when the phone lines are impossible Most importantly, document EVERYTHING. Every call, every letter, every visit. This paper trail will be crucial for getting your backpay once resolved. Also check with your employer if they can provide any emergency assistance while you wait.

This is fantastic advice. Following even half of these steps solved my identity theft issue with NY unemployment in 3 weeks instead of months.

Thank you so much for this detailed plan! I've done some of these but definitely not all. Going to work on the rest tomorrow.

Bro the same thing happened to me. Some dude in Florida was collecting my benefits for 3 months before I found out. Such garbage. The unemployment system is held together with duct tape and prayers.

0 coins

Did you ever find out how they got your info? That's what's freaking me out the most.

0 coins

Nope, never found out exactly. Probably one of the 5000 data breaches every company has these days. Get used to it 🤷‍♂️

Just a heads up - the fraud dept is CRAZY backlogged right now. My cousin's case took almost 3 months to resolve (also identity theft). Start applying for other assistance ASAP - SNAP benefits, rental assistance, etc. Don't wait for unemployment to get their act together.

0 coins

have you tried going to your LOCAL unemployment office? Sometimes being physically present makes them actually do something. The office in Albany helped me way faster than phone calls ever did.

0 coins

I went to the one near me and they just gave me a form to fill out and said they couldn't do anything else until the fraud dept finished investigating. Super frustrating.

0 coins

Ugh that sucks. Try going again but ask to speak to a supervisor this time. Sometimes the front desk people don't have authority to help with fraud cases.

0 coins

Ask your previous employer for help proving your identity. My HR department wrote a letter verifying my employment history and identity which sped things up with the unemployment office. Worth a shot.

Im in the same situation and its been 7 weeks of waiting. I finaly got through to someone using claimyr.com and they told me to keep certifying every week even though I cant get any payments yet. That way when your identity is verified youll get all the backpay at once. Dont miss any weekly certifications!

0 coins

I second this. My brother didn't certify during his identity verification period and lost 4 weeks of benefits he could have gotten later. KEEP CERTIFYING!

0 coins

Good to know! I wasn't sure if I should keep certifying since everything is frozen.
