Identity theft nightmare with NY unemployment - anyone else dealing with this fraud mess?

So I lost my job in April due to downsizing and filed for unemployment right away. Everything seemed to be processing normally until last week when I tried logging into my account and got locked out. Called the helpline after trying to reset my password with no luck. The rep told me someone had changed all my information - phone number, email, bank accounts - everything! According to them, about $3650 in benefits had already been paid out to an account that isn't mine. I'm freaking out because I never received a penny and now the system shows I've been collecting for weeks! The rep filed a fraud report but said it could take 6-8 weeks to investigate. Meanwhile I have rent due and bills piling up. How am I supposed to survive while waiting for them to sort this out? Has anyone else dealt with identity theft on their unemployment claim? What did you do to speed up the investigation process? The rep suggested I file a police report but wasn't clear if that would actually help.

Ugh I'm so sorry this happened to you. The SAME thing happened to my cousin last month. The fraudsters are getting more sophisticated. Definitely file that police report ASAP - it helped in my cousin's case because it gave her an official document to prove she was reporting it as fraud. Also contact all three credit bureaus immediately to put a freeze on your credit!

Thanks for the advice. Did your cousin eventually get their money? How long did the process take?

Yeah she got it after about 5 weeks which is faster than they originally said. The police report definitely seemed to speed things up. She also had to provide like a ton of ID verification docs.

That's good to hear. I'll head to the police station tomorrow. Did she have to keep calling them or did they actually handle it with just the initial report?

I went through something similar and found this service called Claimyr that helped me actually reach a live person at unemployment without waiting forever. Talking to a real agent made all the difference - they escalated my case and I got my account back in control way faster than waiting for emails. Check out their site (claimyr.com) or this video explains how it works: https://youtu.be/Rdqa1gKtxuE - talking to an agent got my $ unlocked so fast!

Is this actually legit? Seems too good to be true with how impossible it is to reach anyone at ny unemployment these days 🤔

Yeah it's real. I was skeptical too but I was desperate after 3 weeks of trying to get thru myself. They just call and wait on hold for you, then connect you when a person picks up. Saved me hours of frustration and my issue got resolved that same day.

wait hold up - does this actually work or is it just the usual BS? the unemployment system is LITERALLY IMPOSSIBLE to navigate rn

It worked for me! I was ready to give up after being on hold for 4+ hours multiple days. Used Claimyr and got a callback with an actual human in about 90 mins. Best decision ever since that agent could see what happened and flag my account for the fraud team.

THIS EXACT SAME THING HAPPENED TO ME!!!! I didn't know until I got a tax form in the mail saying I'd received $5200 in benefits that I never saw a penny of! I immediately reported it and had to jump through so many hoops. File the police report AND report it to the FTC at identitytheft.gov - I printed out their recovery plan and followed it step by step. My case took 10 weeks to resolve but I eventually got my real benefits.

NY unemployment's security is a joke. My neighbor works in cybersecurity and says their system is basically held together with duct tape. No surprise criminals are exploiting it. When my account got compromised last year, I had to physically mail in copies of my ID and wait 9 weeks for resolution. The whole system is broken beyond belief.

ur not wrong 💯 the whole system is outdated af. my friend said they're still running on software from like the 90s or sumthin

Yep, COBOL programming language from the 1960s running on ancient servers. They've been promising to update it for years but never do. Pandemic exposed how bad it really is.

Make sure you also file a report with the Internet Crime Complaint Center (IC3) which is run by the FBI. They track unemployment fraud across states and it might help your case. I'd also recommend checking what other government accounts might be compromised - like your social security account, IRS account, etc. These scammers often hit multiple systems at once.

Didn't even think about my other accounts being at risk. That's terrifying. I'll check those right away.

Sorry to hear what your going thru. I had identity theft happen with my claim too. Here's what worked for me: 1) File police report immediately - they gave me a case number I could reference 2) Contact all 3 credit bureaus (Experian, Equifax, TransUnion) and freeze your credit 3) Call NY unemployment EVERY DAY - yes seriously, be persistent 4) Ask specifically for their fraud department each time 5) Document every call - write down rep names, ID numbers, and what they tell you 6) Send in multiple forms of ID (I sent passport, driver's license, utility bill, birth certificate) 7) Check out claimyr.com if you're having trouble getting through on phones It took me about 5 weeks total but I finally got my account restored and received backpay for everything. Don't give up! The system is slow but if you're persistent they will eventually resolve it.

Thank you SO much for this detailed advice. Did you have to create a new claim or did they fix your existing one?

0 coins

Diego Flores

•

They fixed my existing one after verifying my identity. They'll basically lock the fraudulent account, investigate, then restore it to you once they confirm you're the real person. Make sure you have ALL your employment history handy when you finally talk to them.

I tried calling everyday for 2 weeks and never got through 😡 Just endless busy signals or being on hold for hours then disconnected. How did you actually reach them?

I used claimyr.com after the first week of failed attempts. They call and wait on hold for you, then connect you when someone picks up. Totally worth it when you're dealing with something urgent like identity theft.

Classic NY unemployment... they let criminals steal your money then make YOU wait months for resolution. Typical government efficiency 🙄

forreal tho. they act like its YOUR fault someone stole ur identity. the whole system is a clown show 🤡

Yep. I work in IT and the security on their site is a joke. Single-factor authentication in 2023? No automatic alerts for account changes? It's like they WANT fraud to happen.

While your waiting for the investigation, apply for emergency assistance through your local social services office. They have programs specifically for people in your situation and can help with rent/utilities while the unemployment situation gets sorted out.

0 coins

Emma Davis

•

I didn't know that was an option. Is there a specific program name I should ask for?

0 coins

Luca Russo

•

In NY its called Emergency Assistance to Adults (EAA) or Emergency Safety Net Assistance (ESNA). Just tell them your situation - unemployment identity theft has left you with no income. Bring all documentation showing you've reported the fraud.

THIS HAPPENED TO ME!!! It took literally 12 weeks to get resolved. Keep calling every single day. The regular reps are useless - you need to specifically ask for the fraud department. I ended up sending them my birth certificate, social security card, drivers license AND a utility bill before they finally believed me. Good luck man, the system is broken af

Emma Davis

•

12 weeks??? I can't wait that long! Did they eventually give you all the money that was supposed to be yours?

0 coins

Nia Wilson

•

Yeah I got everything including back pay, but it was a nightmare getting to that point. I was literally about to be evicted when it finally came through. Squeaky wheel gets the grease - you gotta be persistent AF.

Contact your state representative ASAP!! This was the only thing that worked for me. Their office can reach people at unemployment that us regular folks can't. My case was stuck for weeks until I called my assembly member's office. They have staff dedicated to helping with unemployment issues.

im in the exact same boat rn. thieves got $4200 of my benefits and im struggling to pay rent. its been 3 weeks since i reported it and nothing has happened. this is so stressful i cant even sleep

So sorry you're dealing with this too. Have you filed a police report yet? I'm going to do that tomorrow based on advice here.

yea i did that last week. they gave me a case number but said theres not much they can do directly. mostly just for documentation. i keep calling unemployment but cant get thru

Try using claimyr.com - they'll get you through to a person. I was in the same situation and talking to an actual human at unemployment was the only thing that moved my case forward.

There's an entire subreddit dedicated to unemployment fraud. Check out r/IDTheft - lots of good resources there for your exact situation. From what I've read, getting a police report AND filing with the FTC is key to speeding things up.

Thanks, I'll check that out right now. I need all the help I can get.

Anyone dealing with NY unemployment fraud should immediately: 1) File police report 2) Contact FTC at identitytheft.gov 3) Freeze all credit reports 4) Report to unemployment (KEEP YOUR CONFIRMATION NUMBER!) 5) Document EVERYTHING 6) Check if your email/passwords were in any data breaches 7) Change ALL your government account passwords The state is completely overwhelmed with fraud cases right now. My brother works for the fraud dept and says they're seeing 1000+ new cases daily. The only way to get fast action is to either: A) Use a service like claimyr.com to actually reach a human who can escalate B) Contact your state representative/assembly member C) Be extremely persistent with daily calls Also - this might sound obvious but check your mail carefully! They often send verification letters that look like junk mail, and if you miss responding to those, it further delays your case.

Emma Davis

•

This is super helpful, thank you. Did your brother mention how long cases are typically taking right now?

0 coins

He said 6-8 weeks is the current average, but cases where people are proactive (police reports, daily calls, sending in multiple forms of ID proactively) tend to move faster. The squeaky wheel definitely gets the grease in this situation.

What's this claimyr thing? Does it actually help? I've been trying to reach unemployment for weeks about my fraud case.

0 coins

Yeah it actually works. They dial in and wait on hold for you, then connect you when a real person answers. My brother says they've had to implement special procedures because of how many people are using it now. Check out claimyr.com - talking to a live agent makes all the difference with fraud cases.

Call 211 - they can connect you with emergency rental assistance and food banks while you're waiting for the unemployment situation to resolve. Don't wait until you're completely broke to reach out for help.

smh the way NY unemployment handles fraud is a complete joke. took me 11 weeks to get my case resolved last year. meanwhile they expect us to just not pay bills or eat food while they "investigate"

The worst part is watching your savings drain away while waiting for them to fix THEIR security issues. Not like we did anything wrong.

Contact the Attorney General's office too! They have a specific division for unemployment fraud and can sometimes light a fire under DOL to move faster on your case. I did this after 5 weeks of no progress and suddenly my case started moving.

That's a great idea. Do you have a link or phone number for them?

Sure - go to ag.ny.gov and look for the consumer frauds bureau or call 800-771-7755. Make sure you have all your documentation ready (claim number, when you reported fraud, etc

has anyone tried going to the actual unemployment office in person? wondering if thats faster than calling?

They dont really have public offices anymore where u can just walk in. everything is phone or online now. its stupid.

I tried going to a NYS career center but they told me they can't help with unemployment accounts directly. Complete waste of time.

Make sure you get identity theft protection ASAP! These scammers usually don't stop at just unemployment - they'll try to open credit cards, loans, everything. I recommend LifeLock or similar service. I learned this the hard way after my unemployment was hacked and then suddenly I had 3 new credit cards opened in my name the next month.

Oh god, that's terrifying. I'll look into that right away.
