Identity theft nightmare with NY unemployment - my claim was hacked and benefits stolen

Discovered something terrifying last week when I checked my payment history. Someone managed to hack into my ny unemployment account and changed my direct deposit info! I lost over $2,800 in benefits that were sent to some random bank account I've never seen before. I noticed this happened when I didn't receive my payment on Tuesday like usual. Logged in and saw all my previous 7 payments (dating back to May) went to my actual bank, but suddenly the last 4 payments from June-July went somewhere else. The system shows the money as "paid" but I never got a penny of it. Called unemployment about 30 times over 3 days with no luck getting through. Finally reached someone yesterday who told me this is happening a lot lately. They filed a fraud report but said it could take 8-12 WEEKS to investigate! Meanwhile I'm behind on rent and utilities with no income. The agent also said I need to file a police report, freeze my credit, and contact the attorney general's office. I've done all that but feel completely overwhelmed. Has anyone else dealt with this? Any advice on how to speed up the investigation or get emergency funds while waiting?

OMG this EXACT thing happened to me in August! I only caught it because I randomly decided to check my payment history one day. Someone changed my direct deposit info and stole almost $3,400 from me. The unemployment people were useless - kept saying "we're investigating" but it's been over 2 months and still nothing. Did you freeze all your credit reports? That's the first thing I did. Also change ALL your passwords everywhere. These scammers are getting more sophisticated.

Yes I froze all three credit bureaus as soon as I found out! Did you ever get your money back? I'm seriously freaking out because I have no savings left.

Still waiting 😡 They keep saying "the investigation is ongoing" but no timeline. I've started calling every single day to check status. It's exhausting. Document EVERYTHING - dates, times, who you talked to. It helps when you have to explain the situation for the 500th time.

damn this is scary af! just checked my account after reading this. luckily mine looks normal but im changing my password RIGHT NOW

After dealing with similar issues trying to reach NY unemployment, I found this service called Claimyr (claimyr.com) that actually worked when nothing else did. They got me connected to a live agent after I'd wasted days trying on my own. The agent was able to escalate my fraud case and I got my stolen benefits back in 3 weeks instead of the 12 they initially quoted me. Worth checking out this video for how it works: https://youtu.be/Rdqa1gKtxuE - talking to an actual human made all the difference in speeding things up.

Does this actually work? I've been trying to get through to unemployment for literally 2 weeks straight with no luck. About to lose my apartment 😞

0 coins

100% worked for me. I was super skeptical at first but I was desperate after trying for DAYS to get through. The agent I spoke to immediately escalated my case when I explained it was identity theft. Best part was not having to sit on hold for 4 hours.

0 coins

Ok but how does it actually work? Seems sketchy that they can get you through when nobody else can...

0 coins

They basically have an automated system that keeps dialing until it gets through, then it connects you with the agent. No magic, just technology doing the annoying part for you. You can check their site (claimyr.com) - they explain it better than I can. All I know is it saved me weeks of frustration.

yo I just tried this yesterday and actually got through! After calling myself for 3 days straight and getting nowhere. My identity theft case got escalated to the fraud department. Finally feel like something might happen now 🙏

File a report with the FBI Internet Crime Complaint Center (IC3) immediately! I work in cybersecurity and these unemployment fraud rings are sophisticated and international. The more reports filed, the more likely they'll investigate the entire ring. Also, contact your state representative's office - they can sometimes light a fire under unemployment to expedite fraud cases.

The same thing happened to my cousin last month. The unemployment office is completely overwhelmed with fraud cases right now. One thing that helped him was contacting the state attorney general's office - they have a special task force for unemployment fraud and were more responsive than unemployment itself. Still took about a month to get the money back though. It sucks.

The attorney general's office is definitely the way to go. I emailed them and got a response in 48 hours with a case number. Unemployment suddenly became MUCH more helpful once I mentioned I had an open case with the AG.

Yup! It's like magic when you mention the AG's office 🪄 Suddenly they find ways to help you lol

This is a HUGE problem right now with ny unemployment. There's actually a class action lawsuit forming because NYSDOL has been so negligent with security. Google "new york unemployment class action fraud" and you'll find the form to join. Won't help immediately but might get you compensation eventually. In the meantime, here's what worked for me to speed things up: 1) File police report (which you did, good) 2) Call your bank and file a dispute since the money was sent to a fraudulent account 3) Contact state rep (this is what finally worked for me) 4) Keep detailed records of all communications 5) If you're facing eviction, apply for emergency rental assistance It took me about 5 weeks to get my money back, which is better than the 12 they quoted. Good luck!

Thank you for this detailed response! I didn't know about the class action. Just filed to join it. Also going to contact my state rep tomorrow - didn't even think of that.

I can confirm the state rep approach works. My sister had her benefits hijacked and was getting nowhere for weeks. One call to her assemblyman's office and suddenly unemployment called HER within 48 hours and resolved it the following week.

NY unemployment security is a JOKE. My account was hacked TWICE in the past year. Change your password to something super complex and enable 2FA if they offer it (i don't think they do which is ridiculous). Also check your email accounts for any forwarding rules you didn't set up - hackers often set these up to intercept security alerts.

0 coins

this is such good advice about the email forwarding rules! I never would have thought to check that. Just looked at my gmail and found a suspicious forwarding rule I definitely didn't create 😳

0 coins

Glad you caught it! They're sneaky af. Check all your accounts that use that email too and change those passwords. These scammers are organized.

just spent the last hour changing ALL my passwords. What a nightmare. Thanks for the heads up tho, could have been way worse!

Here's what helped me get my case resolved faster when this happened to me: 1. File a detailed police report and get a copy 2. Use claimyr.com to actually get someone on the phone (seriously, this saved me days of frustration) 3. Ask specifically for the fraud department when you get through 4. File a complaint with the state attorney general's office 5. Notify all three credit bureaus 6. Contact your state representative's office 7. Submit a consumer complaint to the CFPB if bank accounts were involved 8. Document EVERYTHING Doing all of this simultaneously created enough pressure that my case was resolved in about 5 weeks instead of the 3+ months they initially quoted me. The system is overloaded with these cases right now, so you have to make noise to get attention. Also, if you're facing immediate financial hardship, tell the agent that specifically. There's an emergency process they can use for people facing eviction or utility shutoffs, but they won't volunteer this information unless you specifically say you're in crisis. Good luck and hang in there - it's a horrible thing to go through but you will eventually get your money back.

Thank you so much for this comprehensive plan. Going to follow it exactly. Did you have to keep calling every day or did they actually start contacting you once all these agencies got involved?

0 coins

Once I had the attorney general and my state rep involved, they started calling ME for updates. But until then, yes, I called at least every other day. The squeaky wheel definitely gets the grease in these situations.

I don't wanna freak you out more but CHECK YOUR TAX ACCOUNT TOO. These hackers often file fraudulent tax returns after they access your unemployment. Create an account on the IRS website if you haven't already to make sure nobody's filed in your name.

0 coins

lol welcome to NY unemployment where they make you jump through 500 hoops to get benefits but can't secure their own systems against hackers 🤡 The whole department needs to be rebuilt from scratch.

0 coins

FOR REAL THO!! They'll deny you for missing a semicolon on your application but let random hackers change your bank info without verification 🙄

0 coins

the system is designed to be broken. they don't want us to get benefits, period. it's all by design.

0 coins

absolutely. barrier after barrier after barrier. but when it comes to actually protecting our $$ suddenly they can't be bothered to implement basic security 🤦‍♀️

Went through this EXACT hell in April. Try contacting the fraud department directly at 888-598-2077. That number sometimes works better than the main one. Also, get yourself a credit monitoring service ASAP - these hackers usually don't stop at just unemployment fraud.

This number worked for me when nothing else did! Had to call right when they opened at 8am but actually got through. Thx for sharing 🙏

After trying for days to reach NY unemployment about fraud on my account, I finally used Claimyr (claimyr.com) and got through in under an hour. Best money I ever spent considering it saved my claim. Just throwing that out there if you're desperate like I was.

0 coins

how long did it take for your case to get resolved after you talked to someone?

0 coins

About 4 weeks, which was way better than the 12+ they quoted me initially. The key was getting to speak with someone in the fraud department specifically, not just any agent.

0 coins

The thing that really pisses me off about these situations is that NYSDOL doesn't even verify bank account changes properly!! No text verification, no waiting period, nothing. In what world is that acceptable security in 2023??? 😤

0 coins

Right?! My freaking PIZZA APP has better security than ny unemployment. Makes me wonder if they're intentionally making it easy for fraud to happen.

0 coins

My theory is they're stuck with ancient government systems from like 1998 that they can't upgrade because of budget/bureaucracy. But still inexcusable.

If you're really desperate while waiting for the investigation, look into local emergency assistance programs. Catholic Charities, Salvation Army, and many local community action agencies have emergency funds for exactly these situations. Also check if your county has a Short Term Emergency Aid for Families program.

NYSDOL completely dropped the ball on this for wayyy too many people. I've been reading stories like yours for months now. Have you tried reaching out to local news stations? They LOVE these stories and unemployment offices hate bad press. Might light a fire under them to resolve your case faster.

0 coins

This actually worked for my brother! He contacted the "On Your Side" segment of our local news and they did a story. Suddenly his case was "top priority" lol

0 coins

Im sorry this happened to you. The waiting period is insane when you need the money now! One thing that helped me was getting a live person on the phone using claimyr.com - once I explained my situation was urgent due to possible eviction, they flagged my case as priority. Still took a few weeks, but better than months.

0 coins

Thanks, I'll check out that service. At this point I'd try anything to speed things up.

This may sound weird but try reaching out on Twitter. Tag NY DOL and your state reps. Public callouts sometimes get faster responses than going through official channels. Worth a shot anyway.
