Someone stole my NY unemployment identity - how do I actually reach a human to fix this?

Discovered someone fraudulently filed for unemployment using my info last week. I've NEVER filed for unemployment benefits before so this was a total shock. Got a letter in the mail saying my claim was processed and payments would start soon - nearly had a heart attack! Called the fraud hotline immediately but it's just an endless loop of automated messages. Tried the regular unemployment line too - waited 2+ hours before getting disconnected. Filled out the online fraud form on October 3rd but haven't heard anything back. Checked my credit reports and placed freezes on everything. Really worried about someone collecting benefits in my name while I'm still working full time! Has anyone successfully reached an actual person at NY unemployment to resolve identity theft? My employer is now getting verification requests about my "claim" and I'm freaking out about potential tax implications. Need to get this fixed ASAP!!

This happened to me last summer. Complete nightmare. The only thing that worked was emailing my state representative. Seriously - call your assembly person or state senator's office. They have special contacts at the DOL and can escalate your case. I was getting nowhere for weeks until I did this. Had it resolved in 5 days after my rep's office got involved.

Thx for the tip! Do I just google my local rep? Did you need to provide them with all the info about the fraud upfront?

Just google "NY state assembly person" or "NY state senator" with your address/zipcode. They'll ask for basic info - your name, contact info, what happened, and maybe your SSN (last 4 digits). They're used to helping with unemployment stuff.

I second this. Representatives have staff dedicated to helping with these issues. They can work miracles when regular channels fail 💯

After spinning my wheels for days with the regular unemployment numbers, I finally got through to someone using Claimyr.com - it's this service that calls for you and connects when a real person answers. Talking to an agent got my $ situation sorted so fast after weeks of frustration. They can transfer you to the fraud department too. Check out this video on how it works: https://youtu.be/Rdqa1gKtxuE

Is this for real? Sounds too good to be true after all the horror stories I hear about getting through to ny unemployment...

Totally get the skepticism - I felt the same way! But yeah it worked for me. They just call repeatedly until they get through, then connect you. Saved me literally days of my life on hold.

wait hold up - does this actually work or is it just the usual BS? The unemployment phone system is literally designed to make you give up 🤔

It worked for me! The key thing is they have some tech that keeps dialing and navigates all those annoying menus automatically. When a human finally answers, your phone rings and you talk directly to the agent.

another day, another company promising to fix the unfixable unemployment system lol

I was just as cynical until I tried it. Then I was like "why didnt I do this three weeks ago?" Talking to an actual person made all the difference with my fraud case.

Sucks this happened to you. Identity theft + unemployment system = total hell. Make sure to file a police report too! You'll need it for documentation. Also file with the FTC at identitytheft.gov - they give you a recovery plan and pre-filled letters to send to creditors.

When this happened to me I had success with the fraud hotline but only when I called at EXACTLY 8:00 am when they open. Like literally had my finger on the dial button at 7:59. If you call even 10 minutes after they open, forget it - you'll never get through. Took 3 mornings of trying but finally worked.

This is actually good to know. I've been trying mid-day like an idiot 🤦‍♂️

Yep! And make sure you have nothing scheduled for the morning because once you actually get through, might be on the phone for an hour sorting everything out.

OMG THIS IS LITERALLY THE WORST. I had someone steal my identity for NY unemployment last year and it took me SIX MONTHS to fix!!! The fraud department is overwhelmed because there was so much pandemic-related fraud. My credit score dropped 115 points before I got everything sorted out. If I could give you one piece of advice: DOCUMENT EVERYTHING. Every call, every email, every letter - keep records of dates/times/who you spoke with.

Six months?!? 😱 I cannot deal with this hanging over my head that long. Did you have to keep calling or did they eventually contact you?

Both. I called constantly AND sent certified letters AND filed police reports. Eventually got assigned a case worker who helped resolve it. But I had to be super persistent.

This happened to my brother too. He said the worst part was how they kept sending him tax forms for benefits he never received. Such a mess.

THE MOST COMPREHENSIVE GUIDE TO RESOLVING UNEMPLOYMENT IDENTITY THEFT IN NY: As someone who works adjacent to this issue and has helped dozens of people through it, here's what you need to do: 1) FILE A POLICE REPORT - This is essential documentation you'll need throughout the process 2) CONTACT ALL THREE CREDIT BUREAUS - Place fraud alerts AND freezes 3) REPORT TO THE FTC - Go to identitytheft.gov and follow their recovery plan 4) DOCUMENT EVERYTHING - Keep a journal of all communications 5) CONTACT NY DOL MULTIPLE WAYS: - Submit the online fraud form (sounds like you did this) - Mail a certified letter to their fraud department - Try calling early morning (8:00 AM sharp) or late afternoon (4:30 PM) 6) CONTACT YOUR EMPLOYER - Have them dispute any unemployment verification requests 7) REACH OUT TO YOUR STATE REPRESENTATIVE - They have special channels to DOL 8) USE A CALLING SERVICE - If you're still struggling, I've seen people have success with claimyr.com which gets you past the hold times 9) FILE IRS FORM 14039 - This is an Identity Theft Affidavit that helps prevent tax issues 10) BE PERSISTENT - This won't resolve quickly but staying on top of it will get results The system is overwhelmed but there are paths through it. Don't give up!

Thank you SO much for this detailed plan! Helps to have a roadmap when everything feels so overwhelming. Def going to try claimyr.com since I'm not making progress with regular calls.

Just wanted to add - also check if your employer offers identity protection services as a benefit. Mine did and it was super helpful through this process.

Not to make things worse, but check if they also filed for SBA disaster loans or PPP in your name too. When my identity was stolen for unemployment, they also tried to get COVID business relief using my info. Total scumbags.

Omg I didnt even think about that!! How would I check if they did that too???

You can contact the SBA directly at 800-366-6303 and ask if there are any loans in your name. Their fraud team is actually pretty responsive.

Seriously, the NY unemployment phone system should be studied by scientists as the perfect example of how NOT to design customer service. I have to believe they deliberately make it impossible to reach anyone. It's beyond incompetence - it has to be intentional at this point.

They actually admitted during COVID that they had a policy of disconnecting callers to manage volume. Like that was their official solution. Disconnect people who've been waiting hours.

That's insane but totally tracks with my experience. I once got disconnected after 3.5 hours on hold. Nearly threw my phone out the window.

my coworker had the same thing happen and he said after trying for weeks he finally paid for claimyr.com to get through - said it was worth every penny to finally speak to someone who could help with the fraud. Might be worth it if you're desperate.

Make sure you file a report with your county's district attorney too. Some counties have special task forces for unemployment fraud and will prioritize your case if you file directly with them.

I had no idea about this. Will definitely look into it for my county. Thanks for the tip!

Pro tip: call the unemployment TTY/TDD number instead of the regular one. Way fewer people use it so you can sometimes get through faster. You don't need a TTY device - when they answer just explain your situation.

Isn't that line specifically for deaf/hard of hearing people? Seems wrong to tie it up if you dont need it...

Fair point - better to try the claimyr.com route first then. I just know people who were desperate after weeks of trying standard channels.

Had a similar issue back in spring. After weeks of frustration I used claimyr to get ahold of unemployment and they actually fixed it fairly quickly once I got through. Their fraud dept can put a block on your SSN to prevent any further claims. definitely worth looking into if the normal channels arent working for u

The real question is how tf are people still able to steal identities for unemployment so easily?? Like hasn't the system been improved at ALL since the pandemic when this was happening constantly? It's ridiculous that we're still dealing with this in 2023.

For real! The amount of fraud that happened should have been a wake-up call to improve security. But nope. Same broken system.

They added some verification steps but the hackers just figured out ways around them. Its like a never ending arms race.
