NY unemployment identity fraud - my name got used for fake claims?

Got a crazy letter in the mail last week from ny unemployment saying my claim was approved from December. Problem is - I never filed for benefits! I'm currently employed full time and have been with the same company for nearly 3 years. Called the fraud department immediately when I realized someone must have stolen my identity to file a fake claim. They put me on hold for ages and then told me to fill out some online form. I submitted all the documentation they asked for but haven't heard anything back in 8 days. The letter said payments would start going out next week to some bank account I don't recognize. I've already frozen my credit reports but I'm worried about tax implications and my employer somehow getting notified about a claim I never made. Has anyone dealt with this before? Do I need to contact my employer? How long does it take them to actually resolve these identity theft cases?

Same thing happened to my cousin last November! Someone filed using his info while he was working full time. He was freaking out because he was worried his employer would think he was committing fraud. What worked for him was calling REPEATEDLY (like 30+ times) until he finally got through to a supervisor who could flag the account properly. The online form literally goes nowhere - its a black hole. You need to talk to a real person ASAP.

Yeah his HR department got the paperwork and that's actually how he found out. Definitely talk to your employer before they come asking YOU questions. It's better if you tell them first.

This happened to me in January! You need to file a police report ASAP - the unemployment office won't do anything serious about it until you have a police report number. Take that to your local precinct today if possible.

Sorry this happened to u bro. The system is totally broken. I had the opposite problem - I actually NEEDED benefits and couldn't get them for 4 months while scammers get approved instantly using stolen info 🤬 You should report this to the FTC at identitytheft.gov too. They'll give you a recovery plan with all the steps.

I work in HR and we've seen a HUGE spike in fraudulent unemployment claims using employee identities. Definitely notify your employer right away. They can contest the claim which helps flag it in the system faster. Also verify your mailing address is correct with the unemployment office - sometimes scammers will try to change your address to intercept future communications.

It could if it's not resolved before the end of the year. The state will issue a 1099-G for unemployment benefits in your name. You'll need to request a corrected 1099-G once the fraud is confirmed.

File a police report - this is essential documentation 3. Contact your employer's HR department to inform them 4. Call the NY unemployment fraud hotline at 888-598-2077 (good luck getting through) 5. Submit the online fraud form at dol.ny.gov/report-fraud 6. File an identity theft report with the FTC at identitytheft.gov 7. Get a case number from EACH agency you report to 8. Keep detailed notes of every conversation with dates, times, and names The online form you submitted is important but not enough. You need to speak with a live agent to properly flag your account. I wasted weeks trying to call until I found claimyr.com which got me through to a representative who could actually help. They flag your call and connect you with an agent when one becomes available. Totally worth it after spending days trying to get through normally. Once you speak with someone, request written confirmation that the fraudulent claim has been marked as identity theft. This will protect you at tax time if they try to issue a 1099-G for benefits you never received.

I've talked to the states fraud department and theyre overwhelmed. They told me there's over 40,000 cases just from the last 2 months that they're working through. Your best bet is to call early in the morning right when they open at 8am. Thats how I got through after trying for days.

The whole ny unemployment system is a joke. My neighbors identity got stolen and used to claim benefits and it took him 6 MONTHS to get it resolved. He had tax problems, his employer got weird about it, and it messed up his credit. Not to scare you but this is gonna be a marathon not a sprint. Document EVERYTHING.

Check to see if the scammer also filed federal unemployment in your name! This happened to me - they filed both state and federal claims. You need to check with the IRS too and possibly put a pin on your SSN for tax filing.

You can call the IRS identity theft department at 800-908-4490. They can tell you if any suspicious tax forms have been filed with your SSN.

dont freak out too much. this is happening to THOUSANDS of ppl in NY right now. my whole department at work (7 people) got hit with fake claims last month. the state knows its a massive problem. just make sure u document everything and keep following up.

Contact ur state representatives office! Seriously! After 3 weeks of getting nowhere with unemployment, I emailed my state assembly person and their office contacted DOL directly. Had my issue resolved in 4 days after that.
