Identity theft victim - how long to recover stolen ny unemployment benefits?
Discovered someone used my identity to collect unemployment in 2021 during a routine credit check last November. I was shocked because I've been working this whole time! Immediately reported it to ny unemployment and filed a police report. They confirmed someone collected about $14,800 using my info while I was actually employed. Been fighting for 5 months to get this resolved and get the money they stole using my identity. Department says they escalated to their fraud team and backdate specialists in February, but I haven't heard anything substantial since then. Called at least 20 times and keep getting different answers about timeline. Some agents say 6-8 weeks, others say 6 months to a year! Meanwhile my credit is affected and I'm worried about tax implications. Has anyone successfully recovered benefits that were stolen through identity theft? How long did your case take?

omg this happened to me!! someone filed using my info in June 2021, and it took almost 9 months to get it resolved. The fraud department is SO slow, but they did eventually clear everything up. I had to keep calling every 2 weeks to check status. Document EVERYTHING - names of reps u talk to, dates, claim numbers, everything. Tax season was a nightmare but they eventually sent me corrected tax forms.

Did you get any money back that was stolen from you? I'm worried they'll just clear my record but not actually give me the benefits that were stolen.

Yeah I did! They sent me a check for the full amount that was fraudulently claimed, but it was after everything was investigated. Took forever tho 🙄

After weeks of getting nowhere with the unemployment office, I finally got through to someone who could actually help by using this service called Claimyr. It basically waits on hold for you then connects you to an agent when they pick up. Talking to a real person got my identity theft case prioritized and they finally started the process of returning my stolen benefits. Best investment I ever made after wasting hours on hold getting nowhere. Check them out at claimyr.com or watch this explainer: https://youtu.be/Rdqa1gKtxuE

Is this for real? I've been trying to call for weeks and can't get through to anyone. How does it work?

yeah its 100% real! they basically call on your behalf and stay on hold, then when a person finally answers they connect the call to your phone. saved me HOURS of hold music. my identity theft case got assigned to an investigator right away after i spoke to someone

not a scam at all! i was skeptical too but it actually works. they don't ask for any personal info or anything, just connect you with an actual agent. my claim moved forward after 4 months of nothing

wait this actually sounds useful - does it work for other government agencies too or just unemployment?

They have a bunch of different agencies they call. I just used it for unemployment but I think they call IRS and other places too. Check their site claimyr.com

The ny unemployment system is completely broken when it comes to fraud cases. My mom had the same thing happen and it took 13 months to get resolved!! Keep calling and ask specifically for the fraud department, not regular agents. Regular agents can't do anything for these cases.

You need to contact your state representative ASAP!!!! They can help speed things up. I had my case stuck for 4 months, then contacted my assemblyman's office, and suddenly everything started moving within a week. They have special contacts at unemployment that we don't have access to.

Thank you, I'll try this! Do I just call my local representative's office? Should I have my claim info ready?

Yep just google your local state assembly member and call their office. They'll have you fill out a form authorizing them to inquire about your case. Definitely have all your claim info, dates, and a timeline of everything you've done so far ready to send them.

Im dealing with this right now! These criminals used my info back in 2020, and i only found out when i got a tax form for benefits i never received!! The whole system is a joke - nobody at the unemployment office knows what theyre doing. Ive been fighting for 7 months and still nothing.

Have you tried filing a police report? I did that right away but I'm not sure if it's actually helping my case move faster.

Yeah I filed a police report, froze my credit, filed with FTC, the whole 9 yards. Still waiting... police basically said so many of these are happening they cant do much 🤷♂️

Here's what worked for me with almost the exact same situation: 1. File fraud claim with unemployment (which you've done) 2. Contact your state senator or assembly member (they have special contacts) 3. File an identity theft report with the FTC at identitytheft.gov 4. Place a fraud alert on your credit reports 5. Contact the Department of Labor's fraud hotline AGAIN and tell them it's been X months 6. Get documentation from your employer proving you were working during that time 7. If all else fails, try using claimyr.com to get past the phone tree hell and actually speak to someone who can help It's frustrating and takes time, but my case got resolved after about 7 months. The key was getting my state rep involved - they have special channels to escalate these issues. Don't give up! The system is overwhelmed with fraud cases from the pandemic but they do eventually get to them.

Thank you SO much for this detailed answer. I've done some but not all of these steps. Will definitely contact my state rep and try that service if I keep hitting walls.

I did all that and it STILL took a year to resolve. But at least it did eventually get fixed.

Same boat here. someone stole $16k using my info last year. i finally got it resolved but only after i hired a lawyer to threaten legal action. suddenly they found time to fix my case! if u can afford it, legal pressure works wonders.

I hadn't considered a lawyer. Was it expensive? Did you use someone who specializes in unemployment cases?

Cost me $800 for the lawyer to send formal letters and make some calls. not cheap but better than waiting forever and it worked. found someone who handles employment law specifically.

I can't believe how common this is becoming! Just shows how utterly broken the NY unemployment system is. They let scammers collect thousands while making legitimate claims jump through endless hoops. Make sure you're checking your credit report regularly too - these scammers often use your info for other fraud as well.

literally THIS. they make it impossible for real people to collect but scammers get paid right away 🤡

Pro tip: call exactly at 8:00:01 am when they open. That's how I finally got through. And specficially ask for the fraud department, not general questions. Don't let them transfer you to the wrong place.

Thanks for the tip! I'll try this tomorrow morning. Did you have to wait on hold even at that early time?

Another trick: press the options for Spanish and then when you get a Spanish speaker just say you need English. The Spanish queue is usually shorter. Not even kidding this works.

i worked at ny unemployment during pandemic (quit cuz it was a nightmare). fraud cases are backlogged by MONTHS. there's a special team that handles these cases but theyre so understaffed. best advice: keep calling, be super polite (angry ppl get helped last tbh), ask for a supervisor after 10 mins if regular agent cant help.

Thanks for the insider perspective. Is there any specific department or person I should be asking for? Or magic words that will get my case prioritized?

Ask for the "special investigations unit" or the "fraud division" specifically. Also saying the words "tax implications" and "credit report damage" tends to get these cases flagged as higher priority. Don't let them tell you to just wait - always ask what specific action they're taking TODAY on your case.

Does anyone know if you have to pay taxes on benefits that were fraudulently claimed with your info? I got a 1099-G for benefits I never received and the IRS is coming after me!

Omar Hassan
You need to contact the unemployment office and request a corrected 1099-G. They should issue one showing zero benefits once your fraud case is confirmed. Don't pay taxes on benefits you never received!

File your taxes with the correct info and attach a statement explaining the situation. Include your fraud case number and police report number. The IRS has procedures for this - it's happening to tons of people.

I just want to say how disgusting it is that identity theft victims are being treated like THEY did something wrong. Why should we have to spend months fighting to clear our names when WE are the victims? The unemployment office should have better systems to prevent this fraud in the first place!

for real!!! and then they make us prove WE didn't commit the fraud like we're criminals 🤬

It's because they rushed to get payments out during covid and didn't verify anything properly. Now actual victims are paying the price.

If it makes you feel any better, I was in your exact situation last year and they DID eventually resolve it and I got all the money that was fraudulently claimed in my name. But it took 8 months and about 50 phone calls. Keep detailed records of every single person you talk to, date, time, what they told you. This documentation will help if you need to escalate.

Have u tried reaching out on Twitter? Sounds weird but @NYSLabor sometimes responds faster there than through official channels. Just don't post any personal info publicly - use DMs.
