NY unemployment forfeited my payment but still says I owe a penalty - what gives?
So I went to claim my benefits last week, and discovered they weren't paid. When I checked my account, it shows my benefits were "forfeited" for the week. The weird thing is, the notice they sent doesn't explain why. The only strange thing I noticed was the expiration date on the letter says 7/18/15, which makes no sense. Some background: Back in November I had a penalty because I worked part-time at a store for like 3 days in fall 2021 and didn't report it correctly. I thought if you worked less than 4 hours you didn't have to report a full day (turns out that rule changed). For that mistake, they reduced my payments for about 3 weeks, and I assumed that took care of the penalty. Now I just got another notice saying I still owe $320 in penalties. I'm totally confused because: 1. Why would they completely forfeit my payment instead of just reducing it like before? 2. If they're taking my entire payment away, isn't that collecting on what I owe? 3. How can they both refuse to pay me AND say I still owe them money? 4. Are these two issues even connected? I've tried calling for days but can never get through to anyone. The system is driving me crazy and I'm falling behind on bills. What should I do to get this fixed?

That's so frustrating. I had something similar happen in February. My benefits got cut off completely with no explanation, and when I finally got through to someone, they said it was because of a prior issue from 2022 that I thought was resolved. The NY unemployment system is a mess with these penalties.

I think the main issue is that there are two different types of penalties. One is a monetary penalty (what you have to pay back) and one is a forfeit penalty (weeks you can't collect at all). Sounds like you first had a monetary penalty that reduced your payments, and now you hit a forfeit week penalty. That expiration date is suspicious though - maybe there's an old penalty from years ago showing up??

I think what happen is you have a new overpayment AND an old one from 2015 (based on that date). The system is now enforcing both. You need to talk to someone to untangle this mess.

Check if the penalty is actually from a different claim period. Sometimes old penalties from previous unemployment periods can come back and affect current claims. The system is terrible at communicating this clearly.

the way nysdol handles penalties is completetly broken. all u can do is keep calling until u get someone who knows what their doing (rare) or submit an appeal and wait forever for a hearing.
