NY unemployment backpayments stopped since July - now they say I owe $300?

My BYE (benefit year end) was in early January 2025... this is my first time on unemployment, and somehow I haven't been receiving payments since January 11th even though I've been claiming every week. The system keeps showing "file a new claim" but when I finally got through to a representative, she specifically told me NOT to file a new claim and just keep claiming weekly, saying I should receive back payments soon. But now I'm totally confused because the system is saying I owe them $300! The same representative told me to ignore that and just keep claiming... so I did exactly what she said from January until now (almost 3 months!) and I STILL haven't received ANYTHING at all. Today I got a letter in the mail saying "you must pay this debt of $300"!!! I'm so frustrated because I keep trying to call but the line is always busy and just tells me to call back later 😡 Can someone PLEASE explain why this is happening to me and what I should do? Should I pay the $300? Should I stop claiming? Should I file a new claim even though she told me not to?

You're dealing with two separate issues that need to be handled differently. First, the $300 debt is likely from an overpayment they determined you received at some point. You need to address this regardless of your current claims situation. Second, if your BYE has passed and you're still eligible for benefits, you typically DO need to file a new claim despite what the representative told you. Here's what you should do: 1. For the $300 debt: Check if the notice includes appeal rights. If so, you have 30 days to appeal if you disagree with the determination. 2. For the claiming issue: When your benefit year ends, the system requires a new application to determine if you qualify for a new benefit year. The representative gave you incorrect information. You should file a new claim immediately, and also try to speak with someone about both the gap in payments and the overpayment notice.

Omg thank you for the clear explanation! So the rep totally gave me wrong info?? I'm so mad I've been wasting all this time! Do you think if I file a new claim now they'll still give me backpay for all those weeks I claimed but didn't get paid? And what happens if I can't afford the $300 right now?

same thing happened to my cousin last year, they said he owed money then stopped his payments even tho he kept certifying. took him like 2 months to fix it

How did your cousin finally get it fixed? Did he have to pay the money they said he owed first before they started paying him again?

This sounds like a classic case of miscommunication between departments. The $300 debt is almost certainly from an overpayment determination (either they think you reported something incorrectly or they made a calculation error). This is separate from your ongoing claims. Since your Benefit Year End (BYE) date passed in January, you absolutely need to file a new claim to continue receiving benefits. Continuing to certify without filing a new claim after your BYE date is unfortunately not going to result in payments. For the $300 debt, you have options: 1. Pay it if you agree you were overpaid 2. Request a waiver if paying would cause financial hardship 3. Appeal the determination if you believe it's incorrect 4. Set up a payment plan But most importantly, file that new claim ASAP, then try calling about both issues. You might still be eligible for back payments, but that will require speaking with a claims specialist.

Thank you so much for the detailed answer! I'm going to file a new claim right now. Do you know if there's a way to explain in the new claim that I've been trying to certify all this time? I'm really worried about those back payments because that's almost 3 months of money I was counting on!

the DOL is such a JOKE! they tell you one thing then do another!!! I had almost the EXACT same situation last year - they said I owed $450 and stopped my payments even tho I kept claiming. When I FINALLY got thru to someone they admitted it was THEIR ERROR and fixed it but it took 6 WEEKS of no money and calling EVERY. SINGLE. DAY. The whole system is designed to make us give up!!!!

That's exactly what it feels like! Like they're hoping we'll just give up and go away. Did you eventually get backpaid for all those weeks you were certifying?

YES but only after I threatened to contact my state assemblyperson!! suddenly they "found" the error and fixed everything in 2 days after 6 weeks of "we're working on it" BS!!!

I had a similar issue last month and spent weeks trying to get through to someone. After dozens of failed attempts calling the regular number, I used a service called Claimyr (claimyr.com) that got me connected to an agent in about 20 minutes. They have a video showing how it works: https://youtu.be/Rdqa1gKtxuE Once I got through, the agent explained I needed to file a new claim after my BYE date and that the supposed overpayment was actually because of a wage reporting issue that was easily fixed. They were able to release my back payments and remove the overpayment notice in one call. Completely worth it after struggling for weeks to get through on my own.

Thank you for the suggestion! At this point I'm desperate enough to try anything that might help me talk to a real person. I'll check out that video!

Your definitely need to file a new claim after your BYE date. The rep gave u wrong info. You can keep certifying for weeks after BYE but youll never get paid unless you do a new application. Thats probably why your not getting payments. For the $300, thats seperate. Did u get a form explaining why they think u owe money? Sometimes its just a mistake in there system.

The letter just says I was overpaid because of "incorrect reporting of wages" but I reported everything exactly how they told me to! I'm going to file the new claim right away. Really hoping I can still get those back weeks once this is all straightened out.

I'm a bit confused by some of the responses here. Let me clarify: 1. When your Benefit Year Ends (BYE date), you MUST file a new claim if you want to continue receiving benefits. This is true regardless of what any representative tells you. 2. The $300 overpayment is a separate issue that needs to be addressed. You have the right to appeal this determination if you believe it's incorrect. 3. For the back weeks you certified but didn't get paid: Once you file a new claim and it's approved, you can request backpayments for those weeks. You'll need to speak with a claims specialist, as this won't happen automatically. I recommend doing the following in this order: 1. File your new claim immediately 2. Submit an appeal for the overpayment (if you believe it's incorrect) 3. Once your new claim is processed, contact them about the backpayments Document everything - dates you called, who you spoke with, what was said. This will be important if you need to escalate the issue.

Thank you for laying it out so clearly! I just submitted my new claim online. The system is giving me an estimate of 2-3 weeks for processing. Should I wait until it's approved before appealing the overpayment, or should I do that now too?

Appeal the overpayment now - there's typically a 30-day deadline from when you received the notice. Don't wait for your new claim to be processed. These are handled by different departments anyway, so you can pursue both simultaneously.

u might wanna check if ur identity verification is still good too. sometimes when BYE happens they need u to do the ID thing again

Oh I didn't even think of that! Where would I check if my ID verification is still valid?

You can check this in your NY.gov ID account under the identity verification section. If it's expired, you'll see a prompt to complete verification again through ID.me. This is sometimes required when filing a new claim after your BYE date.
