NY unemployment payment not processing after certification - hearing required?
I'm so confused about my NY unemployment situation right now! I certified on Sunday like normal, and I usually get paid on Tuesdays. But I checked today and nothing went through. What's weirder is that where it usually says I can certify for the week, it now shows "File a New Claim" but at the top it still says I already certified for this week?!?! I called unemployment and the first agent mentioned something about needing to do a hearing??! But just last week a different representative told me to just keep claiming every week and I should receive the money! Has anyone experienced this? Do I really have to go through a hearing process to get my benefits now? The system is showing conflicting information and I'm getting different answers from different people. Please help!

This sounds like your benefit year might have ended, which automatically triggers the system to prompt you to file a new claim. When your benefit year expires, the system sometimes shows conflicting messages like you're describing. You don't automatically need a hearing, but you might need to complete additional steps. Check your payment history section - does it show your last payment was the final one for your benefit year? Also look for any messages in your inbox about your benefit year ending.

Thank you for responding! I checked my payment history and it doesn't specifically say anything about final payment. My benefit year started in March 2025, so I should still have about 6 months left. There's nothing in my inbox either... that's why I'm so confused! Why would they suddenly tell me I need a hearing???

This EXACT thing happened to me back in January!!! The system was showing contradictory info and one rep told me I needed a hearing while another said just keep certifying. Turns out there was a flag on my account because my previous employer contested something. I spent TWO WEEKS trying to reach a tier 2 agent to fix it. Then I found this service called Claimyr that got me through to an agent in under 20 minutes (https://claimyr.com). They have a video showing how it works: https://youtu.be/Rdqa1gKtxuE The agent I spoke with removed the flag and my payments started processing again. No hearing needed! Worth checking if there's some kind of flag or hold on your account.

Omg this sounds exactly like what might be happening! My previous employer has been difficult about everything. I'll check out that service because I've been calling for days and can't get through to anyone helpful. Thanks so much for sharing your experience!

Based on what you're describing, it sounds like there's an eligibility issue that's been flagged in the system. This typically happens when: 1. Your employer contested your claim 2. You reported earnings that triggered a review 3. There was a discrepancy in information provided 4. Your benefit year ended (though you've clarified this isn't the case) 5. You answered a weekly certification question in a way that triggered a review When this happens, the system sometimes gets confused and shows both "certified" and "file new claim" simultaneously. The hearing they're referring to is likely a determination hearing where you can present your case regarding whatever eligibility issue has been raised. I recommend checking your document section in your online account - there should be a notice explaining what the specific issue is. The determination notice would have been mailed to you as well.

Thank you for such a detailed response! I just checked my documents section and found something dated yesterday about "possible availability issue" - I think this is because I answered YES when they asked if I had any days I couldn't work. I was sick for one day last week and thought I had to be honest about it. Is this going to cause me to lose all my benefits???

That explains it! No, you won't lose all your benefits. Being unavailable for one day doesn't disqualify you completely - it just means you'll receive partial benefits for that week (typically reduced by 1/4 for each day you were unavailable). The system sometimes puts a temporary hold on payment while this is sorted out. You should still receive most of your payment for that week, but there may be a slight delay. Keep certifying each week as normal. If your payment doesn't come through in the next 7-10 business days, then you should contact them again to check on the status.

The same thing happened with my wife's claim. She had to do a phone interview but they called it a hearing. Not a big deal really. Just answer their questions honestly. They're just verifying something.

Did your wife have to wait long for the phone interview? I have a similar issue and they told me it could be 4-6 weeks before they schedule my phone interview. I can't wait that long without income!

It was about 3 weeks for her. Not great but not as bad as they said it might be.

I think I know what happened... when you certified, did you answer any questions differently than usual? Like did you report any income or say you weren't available for work on any days? Sometimes even a small change from your normal answers can trigger a review. When the system is processing a review, it gets glitchy and shows contradictory information. The "file a new claim" message is definitely a system error if you're still within your benefit year.

Yes!! I said I was unavailable for one day because I was sick! I didn't realize that would cause such a huge problem. Someone above mentioned they found a document about an "availability issue" so I checked and found the same thing. I didn't know being honest about one sick day would mess everything up!

That makes sense! Don't panic - this happens all the time. You'll still get benefits, but they might reduce it slightly for that one day. The system often puts a temporary hold on payment when there's an availability issue. Keep certifying weekly and it should resolve soon.

My brother works for NYSDOL (not in unemployment though) and he says their systems are constantly having issues especially after they did some upgrades in early 2025. The hearing thing is probably just because you answered a question in a way that flagged your account for review. They make it sound scarier than it is.

That's reassuring! Do you know if these system issues usually resolve themselves or do I need to keep calling?

He says most resolve within 2 weeks but calling can speed things up if you can actually get through to someone knowledgeable.

Just saw your update about the availability issue document. That's exactly what's happening then. Being unavailable for one day due to illness will typically just reduce your weekly benefit by 1/4 (assuming you claim for a 4-day work week). The phone interview/hearing is just to verify the nature of your unavailability. It's standard procedure. Keep certifying each week as normal while you wait for the interview to be scheduled. If you receive an official notice with an interview date, make sure you're available for that call. Also, make sure to answer all certification questions carefully going forward. For future reference, many states have specific guidelines about how to answer the availability question when you're sick for just a day or two. Some states don't consider short-term illness as being "unavailable" if you would have accepted suitable work had it been offered on other days.

Thank you so much for the clarification! This makes me feel so much better. I'll definitely be more careful with how I answer the certification questions in the future. I had no idea one day of sickness would trigger all this!

I get that this is frustrating but atleast ur still eligible! My claim got denied completely over a stupid misunderstanding and I had to appeal. That took 3 months to resolve!

That sounds awful! I'm glad you eventually got it resolved. The system makes everything so complicated!

Just to summarize what we've discovered for anyone else who might have this issue: 1. When you report being unavailable for work on any day during weekly certification (even for illness), it can trigger an availability review 2. During this review, the system may show contradictory information like "already certified" and "file new claim" simultaneously 3. A phone interview (sometimes called a hearing) may be scheduled to verify the reason for unavailability 4. You should continue to certify weekly while waiting for this process to resolve 5. Benefits will typically be reduced by 1/4 for each day you were unavailable (in a 4-day work week system) 6. The temporary hold on payment should resolve once the review is complete The key is to keep certifying and be available for any scheduled phone interviews. Most of these situations resolve within 2-3 weeks.
