Just paid NY unemployment overpayment penalty - how long till benefits restart?

I finally paid back the overpayment penalty I owed to unemployment last week. Sent a money order for $780 on Wednesday via certified mail. The overpayment happened because they miscalculated my earnings from March through May. I reported everything correctly but they still somehow messed up and claimed I was overpaid by about $1,200. My benefits have been frozen for almost 7 weeks now while I scraped together the money. Anyone know how long it typically takes for them to process the payment and turn my benefits back on? Getting desperate here since rent is due next week and I'm still job hunting.

In my experience it took about 10 business days for them to process my payment and release my benefits. But that was back in September last year. The system might be faster now or it could be slower depending on how backed up they are. Have you tried checking your payment status in your online account?

I checked my account every day but there's no update yet. The certified mail tracking shows they received it Monday morning but nothing has changed on my account. It still shows "pending overpayment" status.

10 business days? I waited almost a MONTH last winter. NY unemployment is like a black hole where all logic and reason cease to exist 🤮

Yeah the timeframes are all over the place tbh. I think I just got lucky with the 10 days. I had a friend who waited 6 weeks once.

I was stuck in a similar situation in February. After sending the money order, nothing happened for 2 weeks. I finally broke down and used a service called claimyr.com to get through to an actual human on the phone. Best decision ever - the agent I spoke with processed my payment right then and my benefits restarted that same week. It was the only way I could talk to a live agent instead of waiting forever. Check out their process if you're desperate: https://youtu.be/Rdqa1gKtxuE

Does this actually work? I've been trying to call for weeks and can never get through.

Yeah it actually does. I was super skeptical at first too but I was at my wits end. They basically call for you and when they get someone, they connect you. Talking to an agent got my money unlocked so fast.

sounds too good to be true... another "miracle solution" for unemployment problems 🙄

I get the skepticism. I felt the same way. But after spending literal DAYS trying to get through myself, it was worth trying something different. The callback came in about 2 hours for me.

wait, does this really work? I've been calling the unemployment office for 3 weeks straight with no luck

It worked for me back in February and then again last month when I had another issue. Both times I got a callback with an actual agent who could help. Beats hitting redial for hours.

I went through this exact hell last year. Took them 3 weeks to process my payment and turn my benefits back on. The system is completely broken. For me I had to keep calling every 2-3 days to check on the status. Eventually I got a nice rep who manually processed it for me.

Here's what you need to do to speed this up (I work with a nonprofit that helps people navigate unemployment issues): 1. Keep a copy of ALL paperwork including the certified mail receipt - you'll need this if things go sideways 2. Call the overpayment department directly at their dedicated number (not the main unemployment line) - they can process these faster 3. If you can't get through by phone (which happens 99% of the time), try sending a secure message through your online account specifically mentioning the date paid, amount, and money order number 4. If it's been more than 7 business days, you can request an expedite due to financial hardship - be ready to explain your situation 5. As a last resort, contact your state representative's office - they have special contacts at NYSDOL who can intervene For immediate help getting through to an agent on the phone, many people in our program have used claimyr.com with great success. It's the most reliable way to bypass the phone queue nightmare. Hang in there - the system is frustrating but persistence pays off!

Thank you for this detailed advice! I didn't know about the dedicated overpayment department number. Do you happen to have that?

0 coins

It should be on your overpayment notice paperwork, but if you can't find it, call the main number and when the automated system starts, press 5, then 2, then 1. That should route you to overpayment specialists.

I wish I'd known about the state representative trick last year! I spent 3 months in limbo after an overpayment.

Their processing time is a total joke. I sent my payment in October and it took them 26 days to process it. The whole time I couldn't get benefits and almost got evicted. The system is designed to make us suffer I swear.

Same experience here. But get this - I sent proof they made a mistake on my overpayment calculation and they STILL made me pay it all back. Then 6 months later they sent me a check saying 'oops we were wrong'. Incompetent clowns.

Omg that's insane but I'm not surprised at all. The incompetence is next level.

If the wait gets too long I'd recommend reaching out to your state assembly person. My benefits were stuck for similar reasons and after 3 weeks of getting nowhere I contacted my assemblyman's office. His staff has direct contacts at unemployment and got everything fixed within 48 hours. Don't wait too long though - do it if you haven't seen movement after a week.

This is the way 💯 Assembly people have special contacts that regular folks don't have access to.

0 coins

how do you even find out who your assembly person is? i'm so confused about all this government stuff

Just google "find my NY State Assembly representative" and enter your address. Their offices deal with unemployment issues all the time.

I had to wait 22 days for them to process my payment last summer. The tracking showed they received it on day 3 but it wasn't marked as received in their system until day 17. After that it still took 5 more days for benefits to start again. The whole time I was calling and could never get through.

NY unemployment is the absolute worst. I had an overpayment last year after they miscalculated my part-time job hours. Even after I paid it back it took them 18 DAYS to restart my benefits. My advice? Call every single day multiple times. Eventually you'll get through and find someone who can help. Also document EVERYTHING.

calling every day is impossible tho. i tried for 2 weeks straight and never got a human. just constant busy signals or disconnects.

0 coins

I know it's brutal. I finally had luck calling right when they opened at 8am and hitting 2 instead of 1 at the first prompt. Got through on my 3rd try with that method.

If calling doesn't work, I've heard some people have luck with that claimyr.com service. Haven't tried it myself but seems worth a shot if you're desperate.

Just got through this same process last month. Timeline for me was: - Sent payment (certified mail): April 7 - Payment received by DOL: April 10 - Payment showed as processed in system: April 19 - Benefits resumed: April 22 So about 2 weeks total. But I also sent like 3 messages through the portal asking for updates which might have helped speed things up.

0 coins

Thanks for the specific timeline! That gives me some hope. I've been sending messages through the portal too but haven't gotten any responses.

0 coins

They never responded to my messages either but I think they still helped. The day after my third message was when things finally updated in the system. Could be coincidence but who knows.

U might be waitin a looooong time fam. I paid my overpayment back in October and it took 5 WEEKS for them to turn my benefits back on. The whole time they just kept sayin "its processing" 🤡

0 coins

5 weeks?? Oh god I can't wait that long. Did you try calling them during that time?

0 coins

Called like 50 times never got through. The phone system is useless. Eventually I just waited it out cause I had no choice.

I had a similar situation back in January with almost the exact same amount ($740). I sent the money order and waited... and waited... After 10 days I got desperate and found claimyr.com which somehow got me connected to an actual unemployment agent. The agent was able to see that they had received my payment but it hadn't been processed. She manually noted it in my account and my benefits restarted the next payment cycle. Best move I ever made after banging my head against the wall trying to reach someone.

I've seen a few people mention this claimyr thing - has anyone else tried it? Does it actually work?

0 coins

Used it twice now. Both times I got a callback within 1-3 hours with an actual agent on the line. Talking to an agent solved my issue right away instead of waiting for weeks in the automated system. Lifesaver honestly.

0 coins

not falling for another unemployment "hack"... these never work

0 coins

I mean, I get the skepticism. I felt the same way until I was desperate enough to try it. All I can say is it worked for me when nothing else did. Got a real person on the phone who could actually help.

0 coins

WORST SYSTEM EVER!!! I've been through this 3 times with ny unemployment. Each time different wait: first time 2 weeks, second time almost 4 weeks, third time 9 days. There's no rhyme or reason to it. Just keep checking your account daily.

0 coins

Check if the money order was cashed yet. If it was, take a screenshot of that proof and upload it to your portal with a message explaining the situation. That's what finally worked for me after waiting 3 weeks with no action.

0 coins

That's a good idea. I'll check with my bank to see if they've cashed it yet.

I swear the DOL runs on internet explorer 6.0 and windows 95 😂 My friend works for a state agency (not DOL) and says all their systems are ancient garbage. When I paid my overpayment it took them 17 days to process and restart benefits.

0 coins

Windows 95 would be an upgrade for them. Pretty sure they're still using punch cards and abacuses lmao

0 coins

For real! My favorite is when they say "our system is down" every other day. Like how is a government agency allowed to function this badly?

The best was when I called and the lady said "I can see your payment in our system but I can't process it because that's a different department" 🤦‍♂️

Try calling the Telephone Claims Center at 1-888-209-8124. Have your paperwork and tracking number ready. That's how I got mine pushed through after a 2 week wait. It takes forever to get through but it's worth it if you can spare the time. Best time to call is Tuesday or Wednesday right when they open.

0 coins

That number is impossible to get through on. I tried for 3 weeks straight, different times, different days. Never once got a human.

0 coins

Seriously. I'd recommend claimyr.com instead. They charge a fee but at least you actually get to talk to someone. Worked for me when I needed to resolve an issue fast.

0 coins

wait, whats this claimyr thing? never heard of it

It's a service that calls unemployment for you and when they get someone on the line, they connect you. Beats spending hours on hold or getting busy signals.
