NY unemployment benefits suspended due to overpayment - when will backpay arrive?

My NY unemployment benefits were suddenly cut off on September 5th, 2025 and I just found out it's because of an alleged overpayment. I haven't received any benefits since then but was told I'm still eligible - they're just holding everything up. Does anyone know if this overpayment issue would be why they're taking so long to restart my benefits? I'm waiting on almost 8 weeks of backpay at this point! They said I'm approved again but nothing is hitting my account. Do they hold your money until you pay off the overpayment or set up a repayment plan? I'm getting desperate here and can't get anyone on the phone.

OMG thank you for this info! I had no idea I needed to specifically set up a repayment plan before they'd release anything. They never explained that! Did you have to pay the entire overpayment before getting your backpay? I'm worried they'll take the whole overpayment amount out of my backpay when it comes through.

The same thing happened to my brother BUT he got it resolved in like 2 weeks. The difference was he kept calling every single day until he got through. Sometimes you just gotta be persistent with these people.

Everyone's saying different things here but I want to clarify something important based on my experience earlier this year. The benefits hold and your backpay are two SEPARATE issues: 1. Yes, you need to address the overpayment to get future benefits started again 2. BUT your backpay for weeks you were eligible should still be processed regardless In my case, I had to file an appeal for the weeks they didn't pay me because they were technically weeks I was eligible, even though they had suspended my claim. Don't just accept that they can withhold your backpay - those are benefits you're entitled to for weeks you were eligible! Call and specifically ask about the status of payment for each week since September 5th. Make sure they check if those weeks are coded as payable or if there's another issue. Sometimes the system puts a general hold on everything.

I tried calling for two days straight with no luck. Just used Claimyr this morning and got through in about 30 minutes! They're setting up a 30% repayment plan for me and said my backpay should be released by next Tuesday. Such a relief! My sister had this happen and they took her entire backpay to cover the overpayment, so be careful! Make sure you specifically tell them you CANNOT afford to have the entire amount taken at once. They'll try to get as much as possible upfront.

One crucial thing no one has mentioned: Make sure you continue to certify every week while this is being resolved! Many people stop certifying when their benefits are suspended, but this creates a whole new problem. Even though you're not receiving payments, you need to maintain your claim by certifying weekly.

Yes! I've been certifying every week even though nothing was coming through. The agent I spoke with today actually thanked me for doing that because it makes processing the backpay much easier. Apparently it's a common mistake people make.
