NYDOL overpayment: When will benefits resume after recoupment?
Hey everyone, I'm in a bit of a pickle with my unemployment benefits. I've got an overpayment situation going on, and they're taking money out to cover it. Thing is, I'm not sure when I'll start seeing benefits again after this overpayment is sorted out. Anyone been through this before? How long did it take for your benefits to kick back in?

Ugh, overpayments are the worst! I went through something similar last year. It took about 3 weeks after they finished recouping the overpayment for my regular benefits to start up again. Hang in there!

3 weeks?! š© That's rough. Did you have to do anything special to get them started again, or did it just happen automatically?

Nah, it just started up again on its own. But def keep an eye on your account and maybe give em a call if it goes longer than a month.

A month?! Jeez, some of us can't wait that long. The system is so broken š¤¦āāļø

I found a way to actually get someone on the phone! I used this site's (claimyr.com) calling tool that dials the phone menu, stays on hold, waits for a live agent to pick up, then sends the call to my phone. It does cost $20, but it works. Here's a video about it: https://youtu.be/Rdqa1gKtxuE

Sounds too good to be true. Has anyone else tried this?

I get the skepticism, but it seriously saved me hours of frustration. Worth every penny imho.

Can you give more details about how it works? Like, do you have to be near your phone the whole time?

Nope, that's the beauty of it. You just set it up, and it calls you when it gets through. I was able to do other stuff while waiting.

Have you tried checking your payment history on the NYDOL website? Sometimes you can see when the next payment is scheduled even if its not coming right away.

Overpayments are such a headache š¤ I had to deal with one last year and it took forever to sort out. Make sure you keep ALL your paperwork and correspondence with them. It'll help if there are any disputes later on.

Good advice, thanks! I'll start organizing everything now. Did you end up having to appeal anything in your case?

Yep, I had to appeal. It was a whole ordeal, but having all my docs in order made it way easier. Good luck!

Pro tip: If you can't get through on the phone, try reaching out to your local state representative's office. They often have direct lines to DOL and can help push things along.

Here's what I know about overpayments and benefit resumption: ā¢ Once NYDOL determines there's an overpayment, they'll start deducting from your future benefits. ā¢ The amount they take depends on the total overpayment and can be up to 50% of your weekly benefit. ā¢ Benefits should continue during repayment, just at a reduced rate. ā¢ If your benefits stopped completely, it might be due to a separate issue. ā¢ Check your online account for any new determinations or messages. ā¢ If it's been more than 2-3 weeks with no benefits, definitely try to contact them. ā¢ Remember, each case is unique, so your experience may vary. Hope this helps! Let me know if you have any other questions.

This is super helpful, thank you! I'll double-check my account for any new messages. Fingers crossed it's just a delay and not a bigger issue.

Great info! Quick question - do you know if they ever waive overpayments if it wasn't your fault?

Yes, they can waive overpayments in some cases, especially if it was due to a NYDOL error. You'd need to request a waiver and provide evidence it wasn't your fault.
