Can I backdate my ny unemployment claims after missing several weeks?
I've been dealing with a frustrating situation with unemployment. I filed my initial claim back in September 2023, but there were verification issues that delayed my approval until early December. During that limbo period, I stopped certifying weekly since I thought there was no point without approval. Now that I'm approved, I realized I need those missed payments from mid-November through December (about 6 weeks total). The online system won't let me go back and certify for those weeks now. I called the unemployment office several times but can't get through to a human. Has anyone successfully backdated claims after missing certifications? I really need that money to catch up on bills that accumulated while waiting for approval.

You're supposed to certify even when your claim is pending. For real tho, your best bet is to talk to a live agent. you need to request backdate for the missed weeks. Good luck getting thru to them tho lol

•Yeah I know that now 😩 Is there a specific thing I should ask for when I call? Like is there an official name for the backdate process?

•Just tell them you need to backdate missed certifications. They'll know what to do. But seriously, be prepared to wait FOREVER on hold.

I was in the same situation last summer and couldn't get through on the phones for weeks. Finally used this service called Claimyr (claimyr.com) that got me connected to an agent in about 30 mins. Agent backdated all my missed weeks and I got paid for everything I was owed. Seriously talking to an agent got my $ unlocked so fast. Check out their explainer video: https://youtu.be/Rdqa1gKtxuE

•hmm I've been burned by so many of these 'services' before... what makes this different? The unemployment system is such a mess I'm desperate but skeptical

•It literally just holds your place in line and calls you when an agent picks up. It's not like those scammy services that promise to "get you more money" or whatever. It just saves you from spending all day on hold.

•wait hold up - does this actually work or is it just the usual BS? I've been trying to get through for THREE WEEKS 😤

•Worked for me! They just call unemployment on your behalf and stay on hold so you don't have to, then connect you when a human answers. Saved me a ton of time and frustration.

I went through the exakt same thing in November! The system is designed to make you fail i swear. My advice: call right when they open (like 7:59am). Keep calling till you get through. Tell them you were waiting for approval and didnt know you were supposed to certify during that time. Mention financial hardship. Be nice but firm.

There's a specific form for backdating missed certifications. I think it's on the website somewhere but I couldn't find it when I needed it. You basically HAVE to talk to someone. Keep calling and don't give up.

•Do you happen to remember what the form is called? I've been searching all over the site and can't find anything specifically about backdating missed weeks.

•I think it's called Request for Backdated Claims or something like that. But honestly the website is such a maze of confusion. Calling is your best bet if you can ever get thru.

The worst part of ny unemployment is how they expect you to know all these unwritten rules. No one tells you to certify while pending! I missed out on like $2800 because of that same issue and was never able to get it backdated. The system is broken af.

•THIS. The whole system seems designed to deny as many claims as possible. They make everything confusing on purpose i swear

Look, I'm gonna be real with you. Your chances of getting those weeks backdated are pretty low. NYSDOL has gotten really strict about this since the pandemic. They consider it your responsibility to certify weekly regardless of claim status. But it's not impossible if you can actually talk to someone and plead your case well. Here's what you need to know: 1. You absolutely NEED to speak with an agent directly. No online solution for this. 2. When you call, specifically ask for a "Request for Backdated Certifications" - using the exact terminology helps. 3. Be prepared to explain why you didn't certify (confusion about the process is a common reason they'll sometimes accept). 4. Document everything - dates you called, who you spoke with, what was said. 5. If you get denied by one agent, call back and try again with another. I've helped several people navigate this system and the biggest issue is always just getting through on the phones. After trying for weeks, I finally discovered claimyr.com which basically waits on hold for you then connects you when an agent picks up. It was a lifesaver. Don't give up! The system is designed to frustrate you into quitting, but those benefits are YOUR money that you're entitled to.

•I wish I had this advice months ago. Ended up giving up after trying to call for two weeks straight. That claimyr thing sounds interesting.

u can also try reaching out to your state assembly person. they have direct contacts at unemployment sometimes and can help u get thru the red tape. worked for my cousin when he had a similar issue

Just wondering if anyone knows - is there a time limit for how far back they'll let you backdate? I have a similar situation but it's from like 4 months ago...

•I believe the official policy is you have 28 days to claim a week, but agents have discretion to go back further. I've seen people get backdated 6+ months in special circumstances.

Does anyone have the direct number to speak to a real person? The automated system is a nightmare and keeps hanging up on me 🤬

•There isnt a direct number sadly. That's why I ended up using claimyr.com - they somehow get through the phone tree faster than I could manually.

•Pro tip: when the automated system asks why youre calling, say "payment not received" - that seems to get you to a human faster than other options

Same exact thing happened 2 me. I eventually got my backpay but it took MONTHS and like 30 phone calls. Don't give up!!! The money is rightfully yours.

Try contacting them on Twitter too. Sometimes their social media team can escalate issues faster than the regular channels.

•That's a great idea I hadn't thought of! Do you know their official handle?

i made a spreadsheet to track all my calls to unemployment last year: - 47 calls over 3 weeks - average wait: 1hr 22min - got hung up on: 19 times - reached human: 6 times - problem actually solved: ONCE the system is a joke 🤡

•Those stats are actually BETTER than my experience. I never got through even once after like 60 tries

•I had to call at weird times like Tuesday at 7:58am or Friday at 4:47pm. Seemed to improve my odds of getting through.

I'm dealing with almost the exact same situation! Filed in October, got caught up in their verification nightmare for 2 months, and didn't certify during that time because the system kept showing my claim as "pending" and I thought there was no point. Now I'm approved but missing like 8 weeks of payments that I desperately need. Reading through all these responses is both helpful and terrifying - sounds like getting through to someone is a full-time job in itself. I'm definitely going to try that "payment not received" tip when calling the automated system. Has anyone had success getting backdated more than 6-8 weeks? I'm worried they'll say it's been too long even though it was their verification process that caused the delay in the first place. This whole system seems designed to make people give up and walk away from money they're legally entitled to.
