NY unemployment backdated claim still pending after 5 weeks - anyone get theirs processed?
I filed a backdated unemployment claim with NY DOL back on January 12, 2025 for weeks I missed filing in December. The rep I spoke with said it would take 2-3 weeks to process, but it's been over 5 weeks now and my online account still shows 'pending determination' for those weeks. I've been regularly certifying for my current weeks (which get paid fine), but those backdated weeks are just stuck. I've called about 40 times in the past week and either get disconnected or told to wait. Has anyone else had backdated claims this year? How long did yours take to process? I'm getting desperate as I'm behind on rent now.

Backdated claims are taking forever right now. I filed one in November 2024 and it took 7 weeks to get processed. The key is to keep certifying for your current weeks like you're doing. For the backdated weeks, you need to specifically request a callback from a claims specialist who handles backdating - the regular agents can't help with this. Make sure you have all your documentation for why you couldn't file on time (medical records, etc.) ready when they call.

I was in the EXACT same situation in December and found out that calling their number is basically IMPOSSIBLE right now!!! I tried for TWO WEEKS straight and could never get through. I finally used this service called Claimyr (claimyr.com) that got me connected to an agent in about 20 minutes. Yes, it really worked for me! The agent I got was super helpful and could see all my backdated weeks in the system. She said they were just sitting in a queue waiting for review, and she moved them to priority processing.

The entire NY unemployment system is BROKEN and they don't care! I had a backdated claim from October that just got processed last week. That's almost 4 MONTHS of waiting while I nearly lost my apartment. When I finally got through to someone (after 50+ calls), they told me my claim had actually been approved weeks ago but never got released for payment due to a "system flag" that no one bothered to check. They're deliberately understaffed and their technology is from the stone age. My advice: call your state representative's office and tell them your situation. That's what finally worked for me - my assemblyman's office has a dedicated staff person who deals with NYSDOL issues. After they made a call, my claim was processed within 48 hours. The system only works when they're embarrassed into doing their jobs!!!

I was hospitalized for two weeks in December and then had some complications after that made it impossible to file on time. Medical reasons are considered "good cause" according to the rep I eventually spoke with. They said you need documentation though.

UPDATE: I finally got through today! For anyone with the same issue, here's what worked: I tried that Claimyr service mentioned above and got connected to an agent in about 15 minutes. The agent checked my claim and said it was actually approved two weeks ago but stuck in the system waiting for a secondary review that never happened. She manually released the payment and said I should see it in 2-3 business days. She also gave me a direct reference number for this specific issue in case I need to follow up. I also contacted my state assembly member's office this morning as suggested above, and they were super helpful - said they'd follow up with DOL directly if my payment doesn't come through by Friday. Thank you all for your suggestions and support! This has been so stressful, and it helps to know I'm not alone in dealing with this system.
