How to speed up a ny unemployment investigation that's gone on for 5 months?
I got laid off last August from my accounting job. Filed for unemployment right away, got approved and received payments for about 6 weeks. Then in October, everything stopped and I got this message saying my claim is "under further investigation" with no explanation. Called them and the rep said it's probably just a routine review that takes 4-6 weeks. Well, it's now March and STILL nothing! Every time I call, I get different answers - one person says they see notes about identity verification (which I've already done twice), another says it's a wage investigation, another just says "be patient". I've sent in all requested documents through their portal, emailed their fraud department thinking maybe someone used my info, contacted my local assemblyman who sent an inquiry 3 weeks ago. My savings are completely gone and I'm about to lose my apartment. Has anyone successfully gotten them to expedite these investigations? What else can I try? I can't survive much longer like this.

I was in a similar situation for almost 4 months. Most effective thing I did was contact my state senator's office. They have dedicated staff for helping with unemployment issues and can reach people at DOL that we can't. My case was resolved within 10 days after my senator's office intervened.

Yeah I just called the local office. Most have an actual form on their website specifically for unemployment help now cause so many ppl have issues. They asked for my claim ID, SSN last 4, and details about my situation. Then they sent it over to DOL with some official letterhead 😂

Yeah it's totally real. I was super skeptical too but I was desperate. They basically just do the hold waiting part for you and then transfer when they get someone. It was the only way I could actually talk to a competent agent who could help me.

Nah I get why you'd think that. There's so many scams out there. But this just connects you with the actual DOL agents. Same people you'd talk to if you called yourself, but without the 3 hour wait. My claim had been stuck for months and the agent I talked to fixed it during the call.

I faxed to 518-457-9378. Include your name, last 4 SSN, and claim ID on every page! I sent: 1) a cover letter explaining my situation 2) copies of my ID and SS card 3) last 3 paystubs 4) separation letter. Write "URGENT: CLAIM UNDER INVESTIGATION SINCE [DATE]" in big letters on the cover.

The thing nobody tells you is that you can request an OFFICIAL DETERMINATION LETTER. By law they have to provide this within a certain timeframe. Even if they're still investigating, this forces them to make a decision one way or another. If they deny you, at least then you can formally appeal, which has a legal timeline they must follow.

I might get downvoted for this but sometimes you have to be the squeaky wheel. Call EVERY DAY. Ask for supervisors. Email the commissioner directly. I know people who've gone to their local DOL office in person with all their documents and refused to leave until someone helped them.

You need to email these specific people at DOL (this is what finally worked for me after 5 months of nothing): nysdol@labor.ny.gov AND labor.sm.ui.fraud@labor.ny.gov In the subject line put "URGENT: Claim Under Investigation [YOUR CLAIM ID] - [YOUR FULL NAME]" In the email be super specific about dates, who you've talked to, what they said. Attach copies of any documents you've already provided (ID, work separation notice, etc). I got a call back within 48 hours after trying EVERYTHING else for months.

You said you contacted your assemblyman, but did you also try your STATE SENATOR? They often have more pull with DOL. Also, were you very specific in your request? You need to give them your full name, DOB, last 4 of SSN, claim ID, and exactly when the issue started + what you've done to resolve it.

Write a formal hardship letter. Send it certified mail to NYSDOL Commissioner's Office.
