Ny unemployment claim stuck in review since August - no decision after 5 months of waiting

I applied for unemployment benefits back in August 15th after being let go from my job. It's now been over 5 months and my claim is still showing as 'under review' with no decision yet. I've tried calling their phone line at least 20 times (always disconnected after waiting forever), sent about a dozen messages through their portal, and even tried emailing their general address. Complete radio silence from them. I check my account every morning and nothing changes - just perpetually 'under review.' Has anyone else been stuck in limbo this long? I'm running out of options and savings. Are there any tricks to actually get someone to look at my claim or give me an update? This is beyond frustrating at this point.

Welcome to the wonderful world of ny unemployment lol. Same boat here - filed in September and still waiting. Their system is a joke. I've called like 30+ times just to get hung up on 🤮

this is so common its ridiculous. i've been waiting since october. My neighbor waited 7 months last year!

It's getting worse tbh. My first claim in 2021 was approved in 3 weeks. Now seems like 4-6 months is the norm 🤷‍♂️

Thanks for the response. Doesn't make me feel better knowing so many people are stuck but at least im not alone

After trying to call for weeks with no luck, I finally tried claimyr.com and got a callback with a real agent in about an hour. Talking to that agent got my claim unstuck and my payments started processing within days. Best decision I made after months of waiting! They have a video about how it works here: https://youtu.be/Rdqa1gKtxuE

wait hold up - does this actually work or is it just the usual BS? ive tried like everything at this point

0 coins

Yeah it worked for me! They basically keep calling for you and when they get through, they connect you with the agent. Took about 40 mins for my callback. Talking to a real person fixed everything.

0 coins

hmm I've been burned by so many of these 'services' before... what makes this different? do they need all ur personal info and stuff?

0 coins

They just call on your behalf and transfer when someone answers. I had all my claim info ready when the agent connected. Having a real convo with the agent is what got my claim moving after months of nothing.

Just checked out their site. Might try this tomorrow cuz I'm literally at my wits end with unemployment 😩

Sorry your going through this. The whole system is designed to frustrate people so they'll give up. I was stuck for 4 months and finally got through by calling right when they open at 8am (gotta start dialing at 7:58) and I hit the spanish option then 0 repeatedly. Still took 6 tries but eventually worked.

It sounds crazy but try reaching out to your state representative. I was stuck in review for 3 months, emailed my assembly person, and magically my claim was processed a week later. Coincidence? I don't think so!

THIS ACTUALLY WORKS!! My state senator's office has a dedicated person just for unemployment issues. They have direct contacts.

0 coins

yup 100% this. Had my husband call our rep and they fixed it in like 10 days after 3 months of nothing. wish I'd known sooner

I will definitely try this. Never thought about contacting my rep before. Thanks for the suggestion!

Let me be the voice of (unfortunate) experience. I've been dealing with NY unemployment for years through multiple layoffs. Here's what ACTUALLY works: 1. Keep detailed records of EVERY interaction - dates, reference numbers, agent names. This is crucial when you finally reach someone. 2. The phone system is deliberately frustrating. Use claimyr.com if you're desperate (it works - saved me weeks of calling). 3. In your messages through the portal, use specific keywords like "hardship" and "urgent financial distress" - these can flag your account. 4. Contacting your state rep works about 70% of the time in my experience. 5. If your claim has been under review for 5+ months, specifically request a "claim escalation" when you talk to an agent. The most important thing is persistence and documentation. Don't give up - that's literally what they're hoping for. The system is designed to wear you down. I've helped about a dozen friends navigate this nightmare system. Feel free to DM if you need more specific advice.

This comment should be pinned at the top of this whole subreddit tbh. Best advice I've seen.

Thank you SO much for this detailed response. I'll try all these approaches. Any specific language that's worked best when asking for an escalation?

0 coins

Say "I'm requesting a formal escalation of my claim due to the excessive review period exceeding standard processing times." Then ask for a confirmation number for the escalation. Don't hang up without getting it.

This is incredibly helpful! I'm in a similar situation - been waiting 4 months now. Quick question - when you mention using "hardship" and "urgent financial distress" in portal messages, do you put those exact phrases or work them into a longer message? Also, how often should I be sending messages without seeming like I'm spamming them?

The NY unemployment website is SUCH garbage. It's like they built it in 1997 and never updated it. Half the time it logs me out when I try to check my status 🤬

0 coins

OMG YES. And those security questions that I can never remember how I answered them the first time! drives me inSANE

0 coins

remember when it completely crashed during covid? good times good times 💅

Have u tried the Social medai route? sometimes posting about ur problem on twitter and tagging the ny labor department gets results. they dont like the bad publicity.

0 coins

What reason did they give for your separation? If it was anything besides a straight layoff, that might explain the delay. They investigate every claim where the employer might contest it.

0 coins

They said it was a position elimination but maybe my former employer is saying something different? Is there a way to find out if they're contesting it?

0 coins

You can call and specifically ask if your employer has contested the claim or provided conflicting information. They should tell you that much at least.

0 coins

not to be that person but have u double checked that ur weekly certifications are still being submitted correctly? system glitched on me and i didnt realize i had stopped certifying for like 3 weeks

0 coins

Yes I've been certifying religiously every Sunday morning. The system accepts them but still shows my overall claim as under review.

0 coins

Are u in nyc or upstate? seems like upstate claims move faster for some reason. my cousin in buffalo got approved in like 3 weeks

0 coins

Try calling exactly at 7:30 AM. I know it sounds weird but the lines open 30 min before they officially say they do. WAY less wait time. Worked for me twice.

0 coins

Can confirm this is true! They start answering at 7:30 not 8:00 like the website says. I got through immediately.

0 coins

claimyr.com was the only way I could talk to a human after weeks of trying on my own. Sometimes you just gotta bite the bullet and pay for the service, but it was worth every penny to get my claim processed and money flowing again!

0 coins

another day, another company promising to fix the unfixable unemployment system lol

0 coins

I was skeptical too but seriously, after 2 months of getting nowhere I was desperate. They got me a callback within an hour, agent fixed my issue, and my claim was moving again that same day.

0 coins

do they actually transfer you to a real unemployment agent or is it some third party thing?

0 coins

It connects you to the actual NY unemployment office agents - the same people you'd talk to if you managed to get through yourself. They just handle the calling and waiting on hold part.

0 coins

Check if you have an "outstanding questionnaire" or document request buried in your account somewhere. they don't always notify you properly and your claim just sits there waiting for info they never actually told you they needed 🙄

0 coins

FYI, they're extra backed up right now because of the system "upgrade" in December that broke half their processes. My friend who works there says they're struggling with the transition. Not an excuse, just an explanation.

yOu jUsT nEeD tO bE pAtIeNt 🤡🤡🤡 (this is what the automated message told me after waiting 4 months for my claim lmao

0 coins

LOLOL they really be telling people to "be patient" while we cant pay bills. the AUDACITY

0 coins

we should all send them our late fees and overdraft charges smh

0 coins

LMAO for real though. My landlord isn't being "patient" about my rent 😩

Ugh, I feel your pain! I've been stuck in review hell since September - going on 5 months now too. The whole system is absolutely broken. What's helped me stay (somewhat) sane is keeping a spreadsheet of every single call attempt, message sent, and interaction. I also started calling my assemblyperson's office last week after seeing similar advice here. Haven't heard back yet but fingers crossed! In the meantime, I've been doing gig work just to keep the lights on. It's so frustrating that we have to jump through all these hoops when we're already stressed about money. Hang in there - you're definitely not alone in this nightmare!

0 coins

Wow, 5 months too?! This is insane. I'm definitely going to start keeping a spreadsheet like you suggested - that's actually really smart for tracking everything. How did you find your assemblyperson's contact info? Did you just Google it or is there a specific way to reach out to them about unemployment issues? Also curious what kind of gig work you've been doing to get by - I'm running low on options here and might need to look into that too. Thanks for the solidarity, it really does help knowing I'm not the only one dealing with this mess!

0 coins

Wow, reading through all these comments is both reassuring and terrifying at the same time. I'm dealing with something similar - filed my claim in early September and it's been "under review" ever since. Like you, I've called probably 25+ times with no luck, sent multiple messages through their portal, and even tried reaching out on social media. Nothing. The claimyr.com suggestion keeps coming up and I'm honestly getting desperate enough to try it. Has anyone here actually used it recently? I'm a bit worried about giving my info to a third party but if it actually works... Also definitely going to try contacting my state rep after seeing how many people had success with that approach. At this point I'll try anything. The financial stress is unreal - I've burned through my savings and am now behind on rent. How is it legal for them to just ignore people for months like this? Hang in there OP, sounds like we're all in this together unfortunately 😔
