Still waiting for NY unemployment payments after 2 months - benefit rate determination delay?
Applied for unemployment in early March and haven't seen a single payment hit my account yet. When I check online, it says they're 'still determining my benefit rate' but this makes no sense because I already got their determination letter in the mail dated March 12 (received it March 16). I've tried calling at least 25 times and sent multiple messages through their portal but complete silence from them. It's been over 8 weeks now and my savings are almost gone. Anyone else stuck in this weird limbo where they sent you a determination but still claim they're determining your rate? Any advice on how to actually get someone to look at my claim?

Welcome to NY unemployment hell. I waited 11 weeks before getting my first payment. The only thing that worked was calling every single morning at 7:59am exactly when they open. Got through on my 4th day doing this. Good luck!

•Thanks for the tip. I've been calling around 10am thinking that would be less busy. Gonna try your 7:59 method tomorrow!

•This is what worked for me too! Call right when they open and have all ur info ready. The earlier agents seem nicer too lol

After weeks of trying to call and getting nowhere, I found this service called Claimyr (claimyr.com) that held my place in line and actually got me through to a live agent! Talking to a real human fixed my issue in 10 minutes. It was the only way I could actually get my benefits moving. Check out their explainer video here: https://youtu.be/Rdqa1gKtxuE

•does this actually work? sounds too good to be true tbh

•Yep, it actually does! I was super skeptical too but I was desperate after 5 weeks of nothing. They just hold your spot in line and call you when they get a human. Worth every penny - got my $4800 in backpay a week later.

•wait so you're saying this service just sits on hold FOR you? and then calls you when they get through? where was this when i spent 3 days on hold last year 😭

Javier Mendoza
•Exactly! They dial repeatedly using some algorithm and then when they get a human, your phone rings and you're connected. Saved me from going insane on hold music lol

•yeah right, another 'miracle solution'... what's the catch? 🙄

•No catch that I found. You pay them to do the painful part (sitting on hold) and they call you when there's a person. My backpay came through 3 days after I finally talked to someone.

Call your state representative ASAP! This worked for me when I was stuck for 6 weeks. I emailed my assembly person with my claim info and they had someone from ny unemployment call me within 48 hours. They can expedite your claim.

•I hadn't even thought of this! Do I just look up who my local rep is and email their office?

Emma Thompson
•Yep! Just google "who is my NY state assemblymember" and it'll show based on your address. Most have a form on their website specifically for unemployment help.

•This is hit or miss tho. I tried my rep and they never got back to me. But my friend's rep fixed everything in a week. Depends who you get I guess.

EXACT same thing happened to me!! Got the determination letter but website still showed "pending benefit rate determination" for 3 more months! Turned out they had an old employer listed that I hadn't worked for in 2 years and it was messing up their system. Make sure all your employment history is 100% accurate.

Have you checked if there are any outstanding documents they need from you? Sometimes they don't tell you but expect additional proof of income or identity. Log into your account and check the documents section.

•Just checked and there's nothing showing as pending or requested. Everything appears complete on my end which is why this is so frustrating!

Look in the Docusign section of ur account! This happened to me and there was a form they needed me to sign that was never emailed to me. It was just sitting there for weeks and nobody told me 🤦♂️

•Where exactly is the Docusign section? I don't see that anywhere in my account...

•It should be under "My Documents" or something similar. They hide it pretty well lol. If you don't see it maybe they changed the system again smh

Here's a comprehensive approach to solving this issue (worked for me after being stuck for 9 weeks): 1) Document EVERYTHING - dates you called, messages sent, letters received 2) Submit a formal complaint through the NY DOL website - there's a specific form for delayed payments 3) Call exactly at 8:00am AND again at 3:30pm - these are shift change times and your odds are better 4) Contact BOTH your state assembly person AND state senator - submit help requests through both 5) If still stuck after all that, use a service like claimyr.com - it's what finally got me through to an actual human Once I got someone on the phone, they found that my claim had been flagged for a "wage verification" that was never sent to me. The agent manually released all my back payments on the spot. The system is deliberately complicated, but persistence is key. Don't give up!

•This is SUPER helpful, thank you! I'm going to follow these steps exactly. Did you have to provide any special info when you finally got through?

•Have your NY.gov username, last 4 of SSN, exact address on file, and all employer names/addresses for last 18 months ready. Also any claim confirmation numbers. Good luck!

•Can confirm this works! I did everything on this list and finally got all my back pay last week after 3 months of nothing.

The real problem is their computer system is ancient and can't handle basic functions. My claim was stuck for 63 days because my last name has an apostrophe in it and their system kept glitching out. Had to get a supervisor to manually override it 🤬

Check if youve been certifying every week! Even if you havent received any payments, you need to certify each week or theyll assume you dont need money that week. A lot of ppl miss this step.

Amina Sow
•Yes I've been religious about certifying every single Sunday! Haven't missed a week.

•good! thats usually the first mistake. have you tried the automated phone system for certifying too? sometimes it updates differently than the website

sounds like they put your claim in the "pending purgatory" pile. i was there for 11 weeks. you NEED to talk to a tier 2 agent, not just the first person who answers. when you get through, immediately ask to speak with a claims specialist or supervisor.

Amina Sow
•This is great advice - I didn't know there were different tiers of agents. Will specifically ask for a claims specialist.

Did you happen to work in another state in the last 18 months? If so, that can cause major delays because they have to verify with other state systems. Took them 14 weeks to process mine because I had worked in NJ for 3 months.

•Nope, all my work has been in NY for the past 5 years. But good point - that could cause issues for others!

•try claimyr.com - seriously it's what worked for me after weeks of nothing. they get you through to a human who can actually look at your specific account

NY unemployment system is a complete disaster. They're still using COBOL programming from the 1970s. My brother works in their IT department and says there are claims that get stuck in "logic loops" for no reason. Only a manual override by staff fixes it.

Malik Davis
•wait is this for real?? they're still using COBOL?? that explains SO MUCH 💀

•100% real. They tried to update during covid but it was such a mess they went back to the old system. My brother said they have ONE guy who knows how to fix certain issues and when he's on vacation everything breaks 😂

have you tried Twitter? deadass tweet at @NYSLabor with your issue (don't include personal info). they sometimes respond faster there because its public and makes them look bad. worked for me!

sometimes the delay is because they're doing an employer verification and your former employer isn't responding. if you have any contacts at your old job, ask them to check if they got any requests from unemployment. my old HR lady found unemployment emails in their spam folder!

•That's a really good point - I'll reach out to my former boss tomorrow and ask if they've seen any verification requests
