No payments for 7 weeks while ny unemployment investigates my claim after being fired
I was let go from my job on December 11th and filed for unemployment right away. The DOL started an investigation into my claim on December 19th, and I haven't heard anything or received a single payment since then. It's been over 7 weeks now and I'm completely out of savings. I've tried everything - calling at 7:58am right when they open, calling midday, sending multiple messages through the portal, and nothing has worked. Not a single update on my claim status or when I might get paid. Has anyone dealt with claim investigations before? Any advice on how to actually get someone to give me an update? This silence is driving me insane.

You need to get someone on the phone. The investigation probably has something to do with your employer contesting it. I was stuck for almost 3 months in the same situation. Messageing them is pointless. They never respond.

•Did you ever get through? I've been trying to call for weeks now with no luck.

•Yeah, eventually. Try calling right at 8:00am on the dot. That's how I got thru.

•I've tried that 😭 Did your employer contest your claim? That's what I'm thinking is happening with mine.

After spending weeks trying to reach ny unemployment with no luck, I discovered this service called claimyr.com that helped me get a callback from an actual agent without waiting on hold. It was the best money I've ever spent because the agent I talked to immediately saw my investigation status and escalated it. Got my payments released the very next day! Check out this video about how it works: https://youtu.be/Rdqa1gKtxuE

•Is this for real? Sounds too good to be true tbh

•100% worked for me. After two months of nothing, I had my money in my account 24hrs after talking to someone. The callback came in about 2 hours.

•another "miracle solution" yeah right... what's the catch? 🙄

•No catch - they just connect you with actual DOL reps. You still have to explain your situation yourself, but at least you get to TALK to someone instead of busy signals.

•wait hold up - does this actually work or is it just the usual BS? i've been trying for WEEKS to get through

•It worked for me. I was skeptical too, but I was desperate after 8 weeks of no income. Got a callback same day and the agent helped resolve my case.

I went thru the exact same thing last year. Employer contested my claim (they fired me and then claimed I quit 🤡). The investigation took 11 weeks! I was ready to be homeless when they finally approved it and gave me backpay. Hang in there but DEFINITELY try to get a hold of someone on the phone. That's the ONLY way to speed things up.

LISTEN UP! I'm gonna tell you EXACTLY what you need to do cuz I've been through this nightmare. This is the unofficial "how to handle ny unemployment investigations" guide: 1) Stop with the messaging system. It's a black hole. 2) You NEED to talk to a TIER 2 agent. The regular agents can't help with investigations. 3) When you call, immediately ask for a supervisor or specialist who handles investigations. 4) Have your employer's exact reason for termination ready. If they said "misconduct" but you disagree, be ready to explain why. 5) Check your mail OBSESSIVELY. They sometimes send questionnaires that have 7-day deadlines. 6) If it's been more than 6 weeks, you can also try contacting your state assembly person's office. They often have direct contacts. 7) If all else fails, try the claimyr.com service to get someone on the phone. It worked for me after 2 months of complete silence. This system is DESIGNED to be frustrating so people give up. DON'T GIVE UP. They owe you that money if you qualify!

•Thank you so much for this detailed advice! I think my employer is claiming misconduct but I was let go due to "not being a good fit" - nothing I did wrong specifically. I'll try these steps.

•"Not being a good fit" usually gets approved, so don't worry. Just make sure you explain that clearly when you talk to them. Good luck!

The silence is the WORST part. I swear they do this on purpose to make people give up. My investigation took 9 weeks and not a SINGLE update during that time.

•THIS!!! They want us to give up so they don't have to pay.

•Yup. The system is completely broken. No transparency whatsoever.

do u have any idea why there doing an investigation? did ur employer contest it? that's usually what happens. they have 10 days to respond to ur claim and if they say u quit or got fired for misconduct then DOL has to investigate

Justin Trejo
•I think they must have contested it. I was technically fired but it was more of a "not a good fit" situation, not for misconduct. But I'm guessing they're saying something different.

if ur desperate for a response, try contacting ur state senator or assembly person. they have special liasons who can cut through the red tape at unemployment. i was stuck for 3 months and my assembly person got it fixed in 3 days 🤯

•This actually works! I did this back in 2020 and got immediate results.

•How do you find your assembly person? Is there like a website or something?

Esteban Tate
•just google "find my NY state assembly person" and it'll show a site where u put in ur address. then go to their website and look for a "constituent services" contact form

I hate to say this but my investigation took 14 weeks. FOURTEEN. And I got zero communication during that time. The system is completely broken. I had to borrow money from family just to survive.

you NEED to contact them by phone. I was in a similar situation and after weeks of trying I had success using claimyr.com. Talking to an agent got my $ unlocked so fast. Before that I was just stuck in limbo for ages.

•I just checked this out. Did it really work? Seems sketch.

•It did work for me! Basically they stay on hold for you and then call you when they get a human. Saved me hours of hold time.

Have you checked your online account for any messages or document requests? Sometimes they send questionnaires that you need to fill out, and if you miss them, your claim stays in limbo.

•I check my account daily - nothing there except my weekly certifications which I've been doing religiously. No questionnaires or messages from them at all.

This happened to me late last year. Investigation started in October, didn't get a PENNY until January. When I finally reached someone, they told me they were "waiting on my employer to respond" the entire time. Like why should I suffer because my ex-employer is dragging their feet??

What number are you calling? Make sure ur using 888-209-8124. some people call the wrong # and waste time. call at EXACTLY 8:00:00 am. Not 8:01. Not 7:59. EXACTLY 8. It took me 18 tries but I got through eventually

Justin Trejo
•Yep, that's the number I've been calling. I'll keep trying right at 8am sharp. Maybe I'll get lucky soon.

is ur claim showing as pending in the payment history? or does it say "0" with no other info?
0 coins
Justin Trejo
•It shows as "pending" with no payment amount listed. Been that way since week one.

Paloma Clark
•OK so thats actually good news. if it says pending it means the claim exists in the system, they just haven't approved the payments yet. If it was rejected there would be nothing there

fun fact: the ny unemployment system is STILL using a computer system from the 1970s. Actual COBOL mainframes. no wonder everything is a mess 🤦♀️

Whats ur effective days remaining? If it's stuck at the same number each week that's another sign of investigation.

Justin Trejo
•It's been stuck at 104 days since I first applied. Hasn't changed at all.

•Yeah that means ur in investigation mode. It won't count down until they start paying u.
