Anyone successfully gotten NY unemployment backpay months after claim ended?
I got laid off back in August 2022 and filed for unemployment right away. I received benefits from mid-September to February 2023 with no issues. Recently, I was going through my paperwork and realized I never received any payments for the 4-week period between my initial filing and when payments actually started. At the time I was so stressed about getting any money that I didn't notice this gap. Has anyone successfully claimed backpay after their regular unemployment ended? It's about $1700 that I'm missing and could really use right now. I've tried calling the regular unemployment number like 25 times but can't get through to anyone. The website is useless for this situation since my claim is technically closed. Starting to think I should just give up but wanted to check if anyone has actually managed to get backpay for a closed claim?

Yes, you absolutley can get that backpay! I had a similar situation where I missed about 6 weeks of payments from April-June 2022 (around $2200). My claim had ended in December, but I called in March this year and managed to get it all sorted. Took about 3 weeks for the money to show up after I finally got someone on the phone, but it did come through!

Just explained to the regular agent who answered. They had to transfer me to a specialist after the initial convo, but it wasn't complicated. Just be prepared to wait on hold foreverrr 😫

Honestly it was brutal. Tried for like 2 weeks straight calling at different times. Finally got smart and used claimyr.com - they kept calling for me and then connected me when an agent picked up. Total game changer!

Not a scam at all! I was super skeptical too but was desperate after 3 weeks of calling. They just automate the calling/holding process. Once I got through to an agent, I got my backpay approved in one call.

You need to keep calling untill you speak to someone who can help. I had a similar issue with missing 3 weeks of payments ($1450) and finally got it resolved last month. But I won't sugar coat it - took me calling everyday for almost 2 weeks straight to finally get through. The key is to call right when they open at 8:00am. And you need to speak to a tier 2 rep, not just the first person who answers.

Hate to be that person but you're probably outta luck. I had almost identical situation (3 weeks of backpay on a claim that ended) and they basically told me I waited too long. Said I should've noticed and reported it within 30 days of the issue. Complete BS but thats the NY unemployment system for ya 🤷♀️

Not true! The law says you have up to one year to request backpay on valid weeks. Whoever told you 30 days was wrong or lying.

This is why I screenshot EVERYTHING when dealing with ny unemployment. They "lost" 2 weeks of my payments last year and tried to tell me I never certified for those weeks. Showed them the screenshots and magically the problem was fixed that same day.

Sorry you're dealing with this! The backlog at NYSDOL is still ridiculous. FWIW my brother just got backpay from a claim that ended in Oct 2022. He had to send in a written request with all his documentation. Took like 2 months but he did eventually get paid. I think the key is documenting everything and being super persistent.

You absotootly need to get a claims specialst on the phone not the first level support people. The regular reps don't have access to the system that can issue backpay on closed claims. It's a compleely different department and they transfer like 2% of calls there. Most reps will just say "sorry can't help" because they literally dont know how the backpay process works.

Pro tip: call your state representative's office!! I was in the EXACT same situation (missing 5 weeks of pay from beginning of claim). Called for months with no luck. Finally contacted my assembly member's office, and they have special contacts at unemployment. Had my backpay within 3 weeks of contacting them.

Here's the secret most ppl don't know: backpay requests need to go to the "Underpayment Unit" not regular claims. When you call, specifically ask for that department. Most reps won't transfer you there unless you specifically ask. I worked for NYSDOL during covid (quit cuz it was a nightmare) and this is how the system actually works.

Unfortunately you have to go through the main number. They don't publish direct lines to specialized units (deliberately). Best bet is to call early morning and immediately ask for Underpayment Unit when you get a human.

Just went through this EXACT scenario. You CAN get your backpay but you need to be prepared to fight for it. What worked for me was calling at exactly 7:55am (they open at 8) and staying on hold for 1hr45min. Finally got a real person who fixed it in literal minutes after months of trying.

Make sure u have all your documents ready when u finally get through to someone! They asked me for: - Original claim confirmation number - Dates of the missing weeks - Proof I was eligible during those weeks (I used a termination letter with my last day of work) - My current mailing address (even though it hadn't changed) Being super prepared made the process go way faster once I finally got someone on the phone.

I had a somewhat similar situation and what worked was contacting the ombudsman office. Google "ny unemployment ombudsman" and you'll find the contact info. They're specifically there to help with unusual situations that the regular customer service can't/won't handle.
