NY unemployment finally addressing the identity theft issue after months of silence
Just wanted to share something important that happened to me yesterday. Back in August, I noticed someone had filed for unemployment benefits using my information in New York. I immediately reported it to ny unemployment and filed a police report. For nearly 4 months, I heard absolutely nothing back from anyone despite calling weekly and sending multiple emails. Yesterday, I finally got through to a supervisor who told me they're dealing with a massive spike in identity theft cases right now. Apparently hundreds of people are having their info stolen and used for fraudulent claims. The supervisor said they've put together a special fraud investigation team that's working with the FBI to track down the source of these data breaches. She told me my case is marked as 'in review' but it could still take 6-8 more weeks to resolve completely. At least I finally got some answers! Just a heads up to check your accounts regularly and lock your credit reports. This seems to be happening to tons of people across the state.

Thanks for the update. I've been dealing with something similar since October. Someone filed using my info and I found out when I got a weird letter in the mail about benefits I never applied for. Called the fraud hotline like 30 times with no response. Did they say anything about what we're supposed to do in the meantime? Like are they stopping the payments to the fraudsters or are they still getting paid while we wait?

•From what the supervisor told me, they freeze the account once fraud is reported but the investigation takes forever. She said that's why they're not responding to people - they're backlogged with thousands of cases. Definitely frustrating!

•The same exact thing happened to me! Got a random letter about benefits approval when I never even applied. Its crazy how many people this is happening to

•they need to hire more people to handle these cases smh. like how is taking 4+ months to investigate acceptable?? meanwhile our credit scores could be tanking

After weeks of trying to reach someone about my identity theft issue, I finally found a service called Claimyr (claimyr.com) that got me connected with an actual human at ny unemployment. Talking to a real agent made all the difference - my case got escalated immediately and they started the fraud investigation process right away. Best decision I made after wasting hours on hold every day! Check out how it works: https://youtu.be/Rdqa1gKtxuE

•Does this actually work? I've been trying to get someone on the phone for literally 2 months about my identity theft case.

•100% worked for me. I was super skeptical at first but after trying to call myself for weeks and getting nowhere, I was desperate. Got connected with an actual claims specialist who took all my info and flagged my account for the fraud team. It was the only way I could get someone to actually acknowledge my problem.

•yeah right, another 'miracle solution'... what's the catch? 🙄

•No catch - it just saves you from having to call and stay on hold yourself. They wait in the phone queue and only connect you when a real person picks up. Talking to an agent got my case moving after being stuck for months. Worth every penny considering how much stress it saved me.

•wait hold up - does this actually work or is it just the usual BS?

•It worked for me - finally got my identity theft case assigned to an investigator after using it. Before that I was just getting automated responses or nothing at all. Check their reviews if you're on the fence.

This SAME thing happened to me!!! I found out in September when I got a weird tax document. I filed police reports, FTC reports, froze my credit, everything. Still waiting on unemployment to do literally anything about it. So frustrating when it's not our fault at all 😡

I work in cybersecurity and there's been a huge spike in these unemployment fraud cases across multiple states, not just NY. The data isn't coming from the unemployment systems themselves - it's from other breaches where criminals buy batches of personal info on the dark web. The unemployment systems are just the target because they're known to be outdated and easier to exploit. Make sure you've frozen your credit at all 3 bureaus and set up fraud alerts everywhere you can.

•This is so helpful, thank you! Do you know if changing your SSN would help prevent this from happening again? Or is that too drastic?
0 coins
Emma Bianchi
•Changing your SSN is extremely difficult and usually only approved in cases of demonstrated ongoing harm. It probably wouldn't help much anyway since the thieves already have your other personal info (name, DOB, address history, etc). Better to freeze credit, use 2FA everywhere, and monitor your accounts closely.

•is there a website where you can check if your info was part of a known breach? I swear I've been careful but somehow these scammers still got my info

•Try haveibeenpwned.com - it won't catch everything, but it's a good starting point to see if your email or phone was in any known breaches.

I had this problem back in July. The ONLY way I finally got it resolved was by contacting my state assembly person's office. They have special liaisons who can escalate cases directly with NY unemployment. Took about 3 weeks after they got involved but they finally cleared my name in the system and stopped the fraudulent payments. Don't waste time with the regular phone lines - they're useless.

•That's really smart! I didn't even think about contacting my local rep. Which office did you contact exactly? And did you just call them or send an email?

•Google your NY State Assembly rep based on your address. Call their office directly and explain you're a constituent with unemployment identity fraud. They'll have you fill out a form consenting to them advocating on your behalf. Way faster than waiting for NYSDOL to get around to your case!

honestly it feels like ny unemployment is completely broken at this point. my sister had her identity stolen last year and it took EIGHT MONTHS to resolve. they kept telling her she needed to wait while someone was literally collecting benefits in her name the whole time! the whole system needs to be rebuilt from scratch.

•For real. The system was designed in the 1980s and they just keep patching it. During covid my claim got stuck for months because their ancient system couldn't handle my previous employer's name having an ampersand in it. I'm not even joking.

•8 months is actually FAST compared to what I've heard from others. Some people are still fighting claims from early 2022! 🤦♂️

Here's what worked for me after my identity was stolen for NY unemployment claims. This is a lot, but it's the most comprehensive approach to getting it fixed: 1) File reports everywhere: FTC identity theft site, local police report, and the NY unemployment fraud form online. Keep all confirmation numbers. 2) Place credit freezes at all three bureaus and set up fraud alerts. 3) Document everything in a single document with dates, times, who you spoke with, etc. 4) Send a certified letter to NYSDOL stating that your identity was stolen and you never applied for benefits. 5) Contact your state assembly person AND state senator's offices simultaneously. 6) If you're still stuck after 30 days, use claimyr.com to get through to a human on the phone. This service was a game-changer for me when nothing else worked. 7) If all else fails, file a complaint with the NY Attorney General's office - they've been taking these cases seriously. Stay persistent! It took me about 10 weeks total but my case was finally resolved and my tax records were corrected. Don't give up!

•Thank you for this breakdown! I'm in week 6 of trying to get my identity theft case resolved and was feeling hopeless. Gonna try contacting my state rep tomorrow.

•Do you have the exact link for the NY unemployment fraud form? Their website is so confusing I can't find it anywhere

•Here's the direct link to the fraud reporting form: https://dol.ny.gov/report-fraud. Make sure you follow up with calls though, the form alone isn't enough!

check your mail carefully too! I almost threw away what looked like junk mail but it was actually tax documents from ny unemployment for benefits I never received! Had to file a whole identity theft case because of it.

this is why I always tell everyone to FREEZE YOUR CREDIT at all three bureaus!! It's free and takes like 15 minutes total. won't stop unemployment fraud since they don't check credit but will prevent the same thieves from opening other accounts in your name.

•doesn't freezing your credit mess up your score tho? I'm planning to buy a house next year so I'm worried about doing anything that might affect my credit

Jacob Lee
•Freezing your credit has ZERO impact on your credit score! It just prevents new accounts from being opened. You can temporarily lift it when you need to apply for something legitimate. Much better than dealing with identity theft when buying a house!

Sophie Hernandez
•yup 💯 this is the best advice. I freeze and unfreeze mine all the time when applying for things. Takes like 5 mins to temporarily lift it when needed.

u kno whats crazy is how different states handle this so differently. my cousin had this happen in ohio and they resolved it in like 2 weeks. meanwhile here in NY ppl are waiting MONTHS. why is our system so bad??

•NY's system is running on ancient technology from like the 90s. They were supposed to upgrade years ago but never did. Then covid hit and everything fell apart.

Anyone try checking their Social Security statement online to see if the fake unemployment earnings are showing up there too? I just checked mine and now I'm freaking out because there's like $14k of unemployment income I never received showing up on my record for last year!

Henry Delgado
•Omg I never thought to check this! Going to look at mine right now. If it shows up there does that mean we're responsible for taxes on money we never got??

•You need to file IRS form 14039 (Identity Theft Affidavit) right away if this happens! It alerts the IRS that you're a victim of identity theft and prevents tax problems. I had to do this last year.

•Just checked - it can take up to a YEAR for the SSA to correct earnings records after fraud. This is such a nightmare.

I tried everything to get someone on the phone about my identity theft case - calling at different hours, using all the menu options, waiting on hold forever. Finally used claimyr.com and got a callback with a real person in about 2 hours. Explaining my situation to an actual human made all the difference - they escalated my case immediately. Sometimes you just need to talk to a real person to get things moving.

•how does that service work? never heard of it before

•They basically wait on hold for you and then call you when they get a real person. I was skeptical but talking to an agent got my $ situation resolved way faster than just sending emails into the void. Their site is claimyr.com if you want to check it out.

•another day, another company promising to fix the unfixable unemployment system lol

Maria Gonzalez
•They don't fix the system - they just help you get through to a human who can actually help instead of waiting on hold for hours. Huge difference between that and companies claiming they can magically fix your claim.

FYI for everyone - there's been a major data breach affecting New Yorkers that isn't being widely reported. A friend who works at NY unemployment (but obvs can't say anything officially) told me they're dealing with THOUSANDS of these fraud cases right now. The unofficial advice is to be super persistent and keep calling/emailing until someone helps you.

•Any idea where the data breach came from? I'm so careful with my info but somehow these scammers still got everything.

•My friend couldn't say for sure, but they suspect it might be connected to some healthcare systems that were breached last year. The thieves are just now using that data for unemployment fraud.

•the real problem is that once your SSN is leaked, it's leaked FOREVER. There's no way to change it easily and we're just supposed to deal with it for the rest of our lives? The system is fundamentally broken.

protip: if you're dealing with unemployment identity theft, get an Identity Protection PIN from the IRS website immediately! It prevents anyone from filing tax returns in your name, which is often the next thing these scammers try to do after unemployment fraud.
