Need help setting up EDD benefits overpayment offset - what to expect?

Hey everyone, I'm dealing with a benefits overpayment issue and need to set up an offset. Has anyone gone through this process before? What should I expect when I call the EDD about this?

Ugh, I've been there. It's a pain in the butt to deal with EDD on this. Make sure you have all your paperwork ready before you call. They'll probably ask for your claim number, SSN, and details about the overpayment.

Thanks for the heads up! Do you remember how long the process took? I'm worried about how this will affect my current benefits.

It took me about 2 weeks to get everything sorted out. They might reduce your current benefits to recoup the overpayment, but you can usually negotiate the amount they take each week.

2 weeks? You got lucky! I've been trying to resolve my overpayment issue for over a month now. 😫

I found a way to actually get someone on the phone at EDD! I used this site's (claimyr.com) calling tool that dials the phone menu, stays on hold, waits for a live agent to pick up, then sends the call to my phone. It does cost $20, but it works. Here's a video about it: https://youtu.be/DOLxZQb92wM

Sounds too good to be true. Is this legit? Has anyone else tried it?

I was skeptical at first too, but it really worked for me. Saved me hours of frustration.

When setting up an offset, make sure you understand your rights. You can request a waiver if the overpayment wasn't your fault. Also, they can't take more than 25% of your weekly benefit amount for repayment.

Has anyone had luck getting their overpayment waived? I've heard its possible but idk how to go about it

I tried, but no luck. They said I didn't qualify because the overpayment was due to my own error. šŸ˜ž

I got mine waived! It took a lot of paperwork and proof that it was EDD's mistake, but it's possible. Don't give up!

Pro tip: Keep a record of EVERYTHING. Every call, every letter, every online message. You never know when you'll need to reference something to prove your case.

Good advice! I'll start a file right away. Any specific info I should make sure to note down?

Definitely note down the date and time of calls, the name of who you spoke with, and any claim numbers or confirmation numbers they give you. Also save any emails or letters you receive.

The whole EDD system is a joke. They overpay us, then expect us to jump through hoops to fix their mistakes. 🤔 Anyone else feel like were just getting jerked around?

Preach! šŸ™Œ I've been dealing with this nonsense for months. It's like they want us to give up.

C'mon guys, the system isn't perfect but at least were getting some help. Could be worse.

Here's a detailed breakdown of what to expect when setting up an offset for benefits overpayment: • First, gather all relevant documents: overpayment notice, past benefit statements, and any correspondence with EDD. • When you call, you'll need to provide your Social Security number and confirm your identity. • The rep will explain the reason for the overpayment and the total amount owed. • You can then discuss repayment options. An offset means they'll reduce your future benefits to recoup the overpayment. • You have the right to negotiate the amount of the offset. They can't take more than 25% of your weekly benefit. • If you disagree with the overpayment, you can request an appeal or apply for a waiver. • Make sure to get a confirmation number or case number for your offset agreement. • Ask for a written statement of the agreement to be mailed to you. Remember, stay calm and polite, but be firm about your rights and needs. Good luck!

This should be pinned to the top of the sub. Great info!

One thing I'd add - if you're currently receiving benefits and they want to start the offset immediately, you can ask for a hardship deferral if the reduced payments would cause financial distress. I had to do this when my offset would have dropped my weekly benefit below what I needed for rent. They approved a temporary delay while I got my finances sorted. It's not guaranteed, but worth asking about if you're in a tight spot financially.
