NY unemployment shows as pending for 3 months with no determination letter
Filed for ny unemployment back in August after getting laid off from my warehouse job. System has been showing my claim as pending for almost 3 months now and I still haven't received any determination letter. For about 8 weeks my account was showing my old BYE date from a previous claim. Just checked today and they finally updated my claim with a new BYE date, but still no payments. Anyone know when they might actually start paying me? My savings are almost gone and rent is due next week. Been certifying every single week without fail.

Similar thing happened to me back in April. My claim was stuck in pending for 12 weeks. The ONLY way I got it fixed was by talking to an actual human. I couldn't get thru on the phones after trying for WEEKS then I found this service called Claimyr (claimyr.com) that got me a callback from an agent. The lady fixed my claim in like 10 minutes and I had backpay within 3 days. Saved my ass from getting evicted tbh.

I went thru the same BS. Waited for 14 freaking weeks before I saw a dime. NYS unemployment system is a complete joke 🤡 Did you try contacting your state rep? That sometimes helps speed things up.

The BYE date update is actually a good sign. That means they're actively working on your claim. Usually when they update that, payments follow within 1-2 weeks. Make sure you keep certifying every week!

The exact same thing happened to me! They didn't send my determination letter either. Turns out they had my old address in the system and all my mail was going there. Have you checked if your contact info is correct in the system?

•Hmm ok. Another thing to check - did you verify your identity through ID.me? Sometimes claims get stuck when that's not completed properly.

Try reaching out to them on Twitter. I know it sounds weird but their social media team sometimes responds faster than anyone else. Just DM @NYSLabor with your issue (don't include personal details tho).

I had to wait 15 weeks for my determination letter. The system is extremely backed up right now. When did u lose ur job? If it was a layoff with no issues, it should be processed faster than if u were fired or quit.

CALL THEM EVERY DAY!!!! I cannot stress this enough. The only way my claim got fixed was by being persistent AF. Call as soon as they open at 8am. If you can't get through, use claimyr.com - its what I did after 2 months of no progress. Had my money 3 days after talking to someone.

Be careful! Make sure you keep claiming benefits every week even if you're not getting paid. When your claim is finally processed you'll get backpay for all weeks properly claimed. Miss a week of claiming and you might not get that money later!

Check if ur claim is marked as pending or if it says "under review" cuz those are different. Under review usually means they need more info from you.

Here's my comprehensive advice after dealing with NY unemployment for way too long: First, your BYE date update is actually good news - it means they're processing your claim. However, you need to be proactive: 1) Call NY unemployment every day. Early morning (8:00-8:30am) tends to have shorter wait times. Be prepared to spend 2-3 hours on hold. If you can't get through using the regular line, try claimyr.com - they'll wait on hold and call you when an agent answers. 2) When you do speak with someone, ask them specifically about the status of your determination letter and why it hasn't been issued. Request they escalate your case to a supervisor if they can't provide clear answers. 3) Contact your state representative AND your state senator. Send emails explaining your situation with your name, address, last 4 of SSN, and claim ID number. They have special channels to inquire about claims. 4) Document everything! Note the date/time of every call, the name of who you spoke with, and what they told you. This will be important if you need to escalate further. 5) Continue certifying every single week without fail, even with no payments coming in. When your claim is resolved, you'll receive all backdated payments for weeks properly certified. 6) Check that all your information in the system is correct - especially your mailing address, phone number, and banking details. Stay persistent! The NY unemployment system is overwhelmed but squeaky wheels eventually get attention. The fact that your BYE date updated means you're in the queue for processing.

You need to call and speak to a tier 2 specialist. Regular agents can't help with determination issues. Keep asking to be transferred to a higher level agent when you call.

Honestly the fastest way to resolve this is to physically go to a NY Dept of Labor office in person if possible. They can pull up your claim and often fix issues on the spot. Bring ID and all ur claim info.

I think there's a fraud alert on ur account. Same thing happened to me - no letter, long wait, then suddenly BYE date updated. When I finally got through to someone they said there was a fraud flag on my account that needed manual review. They removed it and I got paid that week.
