My identity was stolen for NY unemployment and now child support payments are missing too

Someone stole my identity and filed fraudulent unemployment claims in November using my information. Just found out when I got a tax form saying I received $6,780 in benefits that I never saw a penny of. What's worse is that my ex was supposed to get child support payments automatically taken from these benefits (around $1,690 according to the statement). She just told me yesterday she never received any of those payments and doesn't even have a child support debit card set up. I'm totally stressed out - not only am I dealing with this identity theft, but now the system thinks I've been paying support when my kid's mom got nothing! Has anyone dealt with this? I need to fix both issues - clear my name with unemployment AND figure out where those child support payments went. The whole system seems completely broken.

You need to file a fraud report ASAP with ny unemployment and also call the child support office separately to report this. The two systems don't talk to each other well so you'll have to work both angles. I'd start by filing a police report too because thats always the first thing they ask for.

Most places let you file online now for identity theft. Just make sure you get a case number cause NYSDOL will definitely ask for it.

Yeah it worked for me! They keep calling for you and then transfer you once they get someone. I was shocked when I actually got to talk to a real person who could help.

Not sketchy at all - they just automate the calling and waiting on hold part. Talking to an actual agent was the only thing that fixed my issue after months of getting nowhere.

I went thru the exact same thing last summer!!! Someone filed for benefits using my info and child support was supposedly taken out too. What a nightmare! It took almost 3 months to resolve. Here's what I did: 1) Filed a police report 2) Filed fraud report with Unemployment 3) Called the child support collection unit (had to call like 15 times to get thru) 4) Placed a credit freeze with all 3 credit bureaus 5) Filed an Identity theft claim with the FTC at identitytheft.gov Most important was getting thru to someone on the phone at unemployment. I used claimyr.com to get past the hold times - best money I ever spent. They called and waited on hold, then connected me once they reached a live person. The agent was able to mark my case as priority fraud. For the child support side, you'll need to work with the Support Collection Unit directly - they eventually found that the payments were sent but went to a wrong account. They were able to stop and redirect the missing money. Don't give up! Document everything and follow up constantly!

They completely cleared my record once they verified it was fraud. Make sure you request a corrected tax form too - otherwise the IRS will think you got that money!

This is super helpful info. Did you have to prove it wasn't you who filed? Like what evidence did they ask for?

They asked for my ID, the police report, and proof of where I was actually working during the time the claims were filed. They also asked security questions that the scammer got wrong when they filed.

You might want to check if the fraudster set up a direct deposit account for the child support. Sometimes they can redirect ALL payments including the child support portion. You should contact the NY Child Support Processing Center directly at 888-208-4485.

Check ur credit report ASAP! When someone stole my identity for unemployment, they also opened credit cards in my name. Make sure u freeze ur credit at all 3 bureaus (Equifax, Experian, TransUnion

Did you setup two-factor authentication on ur unemployment account? After you file the fraud report make sure you create an account with your info (if you dont have one) and secure it with 2FA so they cant keep accessing it.

CONTACT YOUR STATE REPRESENTATIVE!!! I had a similar situation and was getting nowhere for weeks. I finally emailed my state assembly person and their office contacted unemployment on my behalf. Had it fixed in 10 days after that.

Has your ex checked with her bank to see if the payments maybe went there instead of to a card? Sometimes if they have direct deposit for other benefits the $ can go there automatically.

Make sure you also file a complaint with the IRS since you prob got a 1099-G tax form for benefits you never received! You don't wanna be on the hook for taxes on money some scammer got.

Yoooo Im dealing with same thing! Get the Unemployment fraud paperwork in ASAP - print everything, take screenshots of all correspondence. Also - use claimyr.com to get through to an agent on the phone. I waited for hours trying to call myself, paid for their service and got through in like 20 min. Worth every penny to get my case moving.
