Was a bit nervous or untrusting at first, but my calls went thru. NY unemployment identity theft - Fraudulent claim filed in February showing Head of Household status with 3 exemptions while I'm still employed

So I discovered something really disturbing last week. Someone filed for NY unemployment using my personal information, even though I'm currently employed and have been at the same job for the past 3 years! I only found out when my HR department contacted me saying they received a request to verify my employment status for an unemployment claim. I immediately called NYSDOL and was told there was a claim opened in my name back in February. After multiple calls and being transferred around, they confirmed it was fraud. What's particularly concerning is that when I got access to my tax transcript information, I can see that my filing status was listed as "Head of Household" with 3 exemptions, even though that's not what I filed. My adjusted gross income is showing as $9,826.00 with taxable income of $0.00 and tax per return of $0.00. The account shows a balance of $0.00 with no accrued interest or penalties as of Aug. 24, 2021. This is really alarming because I don't know what else they might have done with my information. I've been told to file a police report, contact credit bureaus, and submit an identity theft affidavit. I'm also concerned because my transcript shows "SELF EMPLOYMENT TAX" sections, but the values are $0.00 for both taxpayer and spouse (I don't even have a spouse!), and "TOTAL SELF EMPLOYMENT TAX" is also $0.00. Has anyone dealt with something similar? How long did it take to resolve? I'm worried about the tax implications and whether this could affect my credit score or future unemployment claims if I ever actually need benefits. I've spent hours trying to reach someone at unemployment who can actually help me close this fraudulent claim. Should I be concerned about the information showing on my account balance? It shows "ANY MINUS SIGN SHOWN BELOW SIGNIFIES A CREDIT AMOUNT" but there are no credit amounts showing. Does this unemployment fraud explain why my tax information looks so strange?

Just be warned - even after you report the fraud, your account might still show the false claim for months. It takes their system forever to update and remove fraudulent claims. Don't panic if you still see it online.

THIS IS AN EPIDEMIC!!! My entire apartment building got hit with this (6 different people). We think our mail was stolen and they used that to get enough info to file claims. Check your credit reports NOW.

Side note: make sure you document EVERYTHING. Keep track of the weeks you work, hours, pay stubs, etc. NY unemployment loves to randomly audit people and if your numbers don't match up they can make you pay everything back. Ask me how I know... 🙃

Yes definitely start a spreadsheet! I had to pay back $3800 because my employer reported different hours than what I claimed. I was off by like 2-3 hours some weeks because I was estimating. Not worth the headache!

Unpopular opinion but the NY unemployment system actually works pretty well compared to other states. My sister lives in Florida and their system is a NIGHTMARE on purpose to deny claims. At least in NY you actually get paid when eligible.

Key Bank is THE WORST bank ever for unemployment. Once your money hits, consider transferring it out immediately to your regular bank. I had my card frozen randomly twice for "suspicious activity" which was just me buying groceries 🤬

You should download the Key Bank app if you haven't already. Sometimes deposits show pending there before they actually post to your available balance

Called NY unemployment yesterday because I was in the same situation. The agent said the dollar amount on your account is the MAXIMUM you can receive, not a guaranteed amount. You only get what you claim before your BYE date.

Have you tried calling your local congressman or representative? Their offices often have connections with both unemployment AND the IRS. I did this last year when I couldn't get through to either and my rep's office fixed both issues within 2 weeks.

Just a heads up - NY unemployment has a separate number for claims with specific issues. Depending on what your problem is, calling that number instead of the main one might be more successful. You can find the different department numbers on their website.
