Washington ESD unemployment appeal won - when do payments start?
Finally got the good news that my unemployment appeal was approved after 8 weeks of waiting! The hearing officer ruled in my favor and overturned Washington ESD's initial disqualification. My question is - when should I expect to actually receive the back pay and regular weekly benefits? The decision letter doesn't give a clear timeline and I'm behind on rent. Has anyone been through this process recently? Do I need to file new weekly claims or will they automatically process everything?

Congrats on winning your appeal! From my experience, Washington ESD usually processes appeal reversals within 7-10 business days after the decision is final. You should continue filing your weekly claims if you haven't been - they'll release all the back pay in one lump sum along with your regular weekly amount.

•Thanks! I kept filing my weekly claims even though they weren't being paid. Hopefully that helps speed things up.

•That's smart - filing continuously definitely helps. They won't make you refile for the weeks you already submitted.

The timeline can vary depending on the complexity of your case and whether the employer decides to appeal the decision further. If it's a straightforward reversal with no additional appeals, expect payment within 2 weeks. If there are complications or the employer appeals to the Board of Appeals, it could take longer.

•The employer didn't show up to the hearing so I doubt they'll appeal. Fingers crossed it's straightforward!

•Yeah when employers don't participate in the hearing they rarely appeal afterwards. You should be good to go.

Had a similar situation last year - won my appeal but then hit a wall trying to get answers from Washington ESD about payment timing. Their phone lines are impossible and the online system just showed 'processing.' Ended up using claimyr.com to actually get through to someone who could check my account status. They have a video demo at https://youtu.be/7DieNd3C7zQ showing how it works.

•Never heard of that service - does it actually work for getting through to Washington ESD?

•Worked for me - they handle the calling and waiting so you don't have to sit on hold for hours. Worth it when you need actual answers about your claim.

•Interesting, might have to try that if my situation gets complicated. The hold times are absolutely ridiculous.

FINALLY someone else who won their appeal! I've been waiting 3 months for my hearing and seeing posts like this gives me hope. Did you have to provide a lot of documentation or was it mostly testimony?

Jacob Lee
•I had to submit my work schedules and text messages between me and my supervisor. The hearing was mostly me explaining what really happened versus what the employer claimed.

•Good to know - I've been gathering everything I can find. Thanks for sharing your experience!

The back pay should include all weeks from when you were initially disqualified. Make sure you check the calculation when it comes through - sometimes they miss weeks or calculate the wrong benefit amount.

Jacob Lee
•Good point - I'll definitely double check the math. Should be about 8 weeks worth of benefits plus the regular weekly amount going forward.

Emily Thompson
•Yes, keep your own records of what you should receive. Washington ESD makes calculation errors more often than they should.

Just a heads up - even though you won your appeal, make sure you're still meeting all the job search requirements going forward. Winning an appeal doesn't exempt you from the ongoing eligibility requirements.

•Yeah I've been doing my job searches and logging them in WorkSourceWA the whole time. Don't want to give them any reason to cause more problems.

•Smart approach - keeping up with requirements during the appeal process shows good faith effort.

Ugh I'm so jealous! My appeal hearing is next week and I'm terrified. The employer is actually showing up with a lawyer. Any advice for the hearing itself?

Jacob Lee
•Stay calm and stick to the facts. I was nervous too but the hearing officer was fair and let me tell my side of the story. Having documentation helped a lot.

•Thanks - I've got everything organized and ready. Hopefully it goes as well as yours did.

•You can do this! Even with a lawyer, if the facts are on your side, you have a good chance. The hearing officers see through employer BS all the time.

One thing to watch out for - sometimes the first payment after an appeal takes longer because they have to manually process it. Don't panic if it doesn't show up exactly when expected, but definitely follow up if it's been more than 2 weeks.

Jacob Lee
•Good to know - I'll give it two weeks before I start calling. Hopefully the manual processing doesn't add too much delay.

Natalie Chen
•Yeah the manual processing is annoying but necessary. They have to make sure everything is calculated correctly after the reversal.

This is such great news! I've been following your posts about the appeal process. How long did it take from when you requested the hearing to actually having it?
0 coins
Jacob Lee
•About 6 weeks from when I submitted the appeal request to the actual hearing date. Then another 2 weeks to get the written decision.

•That's not too bad considering how backed up they are. Gives me hope for my own timeline.

Make sure you save that appeal decision letter! You might need it later if there are any issues with future claims or if you need to prove the reversal happened. Washington ESD's record keeping isn't always reliable.

•Already printed multiple copies and saved the PDF. Not taking any chances after going through all this.

•Smart move - I learned that lesson the hard way when they couldn't find my appeal decision in their system months later.

Did you represent yourself or did you have help? I'm thinking about appealing my disqualification but the whole process seems overwhelming.

Jacob Lee
•I represented myself but did a lot of research beforehand. There are free resources available if you need help - WorkSource has some guidance materials.

Crossing my fingers that your payment comes through quickly! The stress of waiting for back pay is terrible, especially when you're behind on bills. Keep us updated on how long it actually takes.

Jacob Lee
•Will definitely update once I see the money hit my account. The waiting is the worst part after already waiting so long for the appeal decision.

•I bet! At least you're over the biggest hurdle now. The payment processing should be much more straightforward.

Question about the back pay - do they pay interest on the delayed benefits? Seems like they should since it was their mistake that caused the delay in the first place.
0 coins
Daniela Rossi
•No, Washington ESD doesn't pay interest on delayed benefits even when they're wrong. You just get the principal amount you would have received originally.

Michael Green
•That's frustrating but not surprising. At least you get the full back pay amount.

Been there with the appeal process - it's such a relief when you finally win. One tip for anyone else going through this: keep detailed records of everything during the appeal process, including dates you tried to call Washington ESD. Sometimes that information becomes relevant later.

Jacob Lee
•Good advice! I kept a log of all my attempts to get information during the process. Probably helped show I was trying to resolve things.

•Exactly - it shows you were acting in good faith throughout the process.

For what it's worth, I used that Claimyr service someone mentioned earlier when I needed to check on my appeal status. Saved me hours of trying to get through on the phone. Just putting it out there for anyone else struggling with Washington ESD communication.

•How much does something like that cost? Seems like it might be worth it if it actually works.

•I'd rather spend a little to get actual answers than waste days trying to get through myself. The peace of mind was worth it during the appeal process.

This gives me hope! I lost my initial appeal but I'm thinking about taking it to the Board of Appeals. Did you consider that option or was the first appeal level enough?
0 coins
Jacob Lee
•I got lucky and won at the first level, but I was definitely prepared to take it further if needed. If you think the hearing officer made a mistake, it might be worth pursuing.

Daniela Rossi
•The Board of Appeals is a different process with stricter requirements, but it's definitely an option if you have grounds to appeal the hearing decision.

Congratulations! Can I ask what the original disqualification was for? I'm trying to understand what types of cases have good chances on appeal.
0 coins
Jacob Lee
•It was a misconduct disqualification that was completely wrong. My employer claimed I was fired for performance issues but it was actually a layoff due to lack of work. Had the documentation to prove it.

Isaiah Thompson
•That's exactly the kind of situation where appeals work well - when you have clear evidence the employer's claim was wrong.

UPDATE: Just wanted to follow up and say my payment came through this morning! Took exactly 9 business days from the appeal decision. Back pay was correct and my regular weekly claims are now processing normally. Thanks everyone for the advice and support!
