I won my unemployment appeal now what - next steps after Washington ESD appeal victory?
Just got the decision letter that I won my Washington ESD unemployment appeal! After 6 weeks of waiting and stressing about it, the judge ruled in my favor and overturned the initial disqualification. My former employer tried to claim I was fired for misconduct but I had documentation proving otherwise. Now I'm confused about what happens next - do I need to file new weekly claims? Will I get back pay for all the weeks I missed? The decision letter mentions something about 'implementation' but doesn't give clear next steps. Has anyone been through this process before?

Congratulations on winning your appeal! You should receive back pay for all eligible weeks from when your claim was initially disqualified. Washington ESD typically processes appeal reversals within 7-10 business days of the decision date.

•Thank you! Do I need to keep filing weekly claims while they process the back pay?

Natasha Kuznetsova
•Yes, continue filing your weekly claims as normal. The back pay will be separate from your ongoing weekly benefits.

•Good point about direct deposit. How much back pay did you end up getting?

The implementation process can be slow unfortunately. I've seen cases where it takes 3-4 weeks for Washington ESD to actually process the appeal decision and release back payments. If you don't see movement within 2 weeks, you might want to call them directly. Speaking of calling - I recently discovered Claimyr (claimyr.com) which actually gets you through to ESD agents instead of sitting on hold forever. They have a demo video at https://youtu.be/7DieNd3C7zQ that shows how it works.

•Never heard of Claimyr before. Is it legit or one of those scam services?

Emma Thompson
•It's legitimate - they just help you get through the phone system faster. No scam involved, just saves time dealing with busy signals.

•I used Claimyr when my claim got stuck in adjudication. Worked perfectly and got me connected to an actual ESD rep in minutes instead of hours of calling.

OMG this gives me hope! I'm waiting for my appeal decision right now and it's been 4 weeks since the hearing. How long did it take from your hearing to getting the decision letter?

Oliver Wagner
•My hearing was on January 8th and I got the decision letter yesterday, so about 3 weeks total.

•Okay so I should hear something soon hopefully. The waiting is killing me financially.

•Appeal decisions are typically issued within 30 days of the hearing date, so you're still within the normal timeframe.

THE SYSTEM IS BROKEN! I won my appeal 2 months ago and STILL haven't received my back pay. Washington ESD is a joke - they make it impossible to get what you're owed even after a judge rules in your favor. I've called dozens of times and keep getting different answers from different reps.

Oliver Wagner
•That's terrifying. What reasons are they giving for the delay?
0 coins
StarStrider
•First they said 'system processing delays' then 'additional verification needed' then 'waiting for employer response' - it's all BS excuses!

•This is exactly why services like Claimyr are helpful - you can actually get to someone who can track down where your case is stuck instead of getting bounced around.

Make sure to check your online account daily. Sometimes the back pay shows up before you get any notification. Also verify that your job search requirements are still being met while you wait for processing.

Oliver Wagner
•Good reminder about job search. I've been keeping my logs updated throughout the appeal process.

•Wait, do you still have to do job searches during an appeal? I thought that was suspended.

Ravi Gupta
•You should continue job search activities unless specifically told otherwise. Better to be safe than create new issues.

Just want to echo what others said about the back pay timing. Mine took exactly 10 business days from the decision date. One thing to watch for - they'll send a separate determination letter when they actually implement the appeal decision.
0 coins
Oliver Wagner
•Thanks for the heads up about the separate letter. I'll watch for that.
0 coins
Malik Davis
•Yeah it's confusing because you get the appeal decision first, then later you get the 'redetermination' notice when they actually fix your claim.

also make sure you understand if this affects your weekly benefit amount going forward. winning an appeal sometimes changes your monetary determination too
0 coins
Oliver Wagner
•I hadn't thought about that. My original determination was based on limited wage history because of the timing.

Natasha Kuznetsova
•If additional wages become available due to the appeal timeline, Washington ESD should automatically recalculate your weekly benefit amount.

Congrats! What kind of documentation did you use to win? I'm preparing for my own appeal hearing next week.

•I had email chains showing my supervisor's actual reasons for termination, plus my employee handbook showing the progressive discipline policy they didn't follow.

How much stress relief did you feel when you got that decision letter? I'm so anxious waiting for mine.

be careful about spending any back pay right away. sometimes they make mistakes and you might owe some back if there's an error
0 coins
Oliver Wagner
•Good point. I'll probably save most of it just in case.
0 coins
Natasha Kuznetsova
•While errors can happen, once an appeal is decided in your favor, it's very rare for Washington ESD to reverse that without another appeal process.

My brother went through this same thing last year. The back pay came as one lump sum and he had to pay taxes on all of it in that tax year, which created issues. Just something to keep in mind for tax planning.

Oliver Wagner
•Oh wow, I hadn't thought about the tax implications. Thanks for mentioning that.

Diego Vargas
•Yeah he ended up owing more taxes because it pushed him into a higher bracket. Might want to set some aside.

If you need to follow up on the implementation status, definitely consider using a service to get through to ESD faster. I mentioned Claimyr earlier - they've really helped streamline the process of actually reaching someone who can give you real answers about your case status.

•I was skeptical about Claimyr at first but ended up trying it when my claim got stuck. Worked exactly as advertised and saved me hours of phone frustration.

just wanted to say congrats again! it's so rare to hear good news about ESD appeals. gives me hope for my own situation

Oliver Wagner
•Thank you! Don't give up hope - if you have good documentation and were wrongfully denied, the system can work.

One more thing - make sure your contact information is current in your ESD account. Sometimes implementation delays happen because they can't reach claimants for verification questions.

Oliver Wagner
•Good catch. I moved during the appeal process so I should double-check my address is updated.

Ravi Gupta
•Definitely update that ASAP. Address mismatches can cause significant delays in benefit payments.

How long was your entire process from initial denial to winning the appeal? trying to mentally prepare for my own timeline
0 coins
Oliver Wagner
•About 3 months total - initial denial in October, filed appeal in November, hearing in early January, decision this week.

Sean Doyle
•That's actually faster than I expected. Thanks for sharing the timeline.

did they make you pay back any benefits you received before the disqualification?

Oliver Wagner
•No, I hadn't received any benefits yet when they initially denied me. The disqualification happened during my initial claim review.

Zara Rashid
•ah ok that makes it cleaner. my situation is more complicated with overpayment issues

Final reminder - continue filing your weekly claims religiously while waiting for implementation. Missing weekly claim deadlines can create new complications even with a successful appeal.
0 coins
Oliver Wagner
•Absolutely. I've been filing every week throughout this whole process just to be safe.

Natasha Kuznetsova
•Perfect. That's the smartest approach and will prevent any gaps in your benefit eligibility.

Just to close the loop on my earlier comment - when I mentioned using Claimyr to get through to ESD, I should add that it's especially useful for post-appeal situations like yours where you need to check on implementation status. The regular phone lines get swamped but their service cuts through that.

Oliver Wagner
•I'll definitely bookmark that for reference. Hopefully I won't need it but good to have options.

Malik Davis
•Exactly - it's one of those things you hope you never need but are grateful to have when you do need it.

Congratulations Oliver! That's fantastic news about winning your appeal. I went through something similar last year and the relief is incredible. One thing I wish someone had told me - keep detailed records of everything during the implementation phase too. Screenshot your online account status, save any emails or letters you receive, and document any phone calls you make. If anything goes wrong during the back pay processing, having that paper trail can save you from starting over. Also, the back pay might come in chunks rather than one lump sum depending on how your claim was structured, so don't panic if you don't see the full amount right away. Wishing you a smooth implementation process!

•This is such helpful advice Tyler! I hadn't thought about documenting the implementation phase too but that makes total sense. Thanks for the heads up about the back pay potentially coming in chunks - I would have definitely panicked if I only saw a partial amount at first. I'm going to start taking screenshots of my account right now. Really appreciate you sharing your experience!
