Washington ESD unemployment appeal was reversed - now what do I do?
Just got the decision letter today and I'm honestly confused about what happens next. My original unemployment claim was denied back in October, I filed an appeal, and now they reversed the denial which I think means I won? But the letter is full of legal language and I can't figure out what my next steps should be. Do I need to do anything or will Washington ESD automatically start processing my back pay? How long does it usually take to see the money hit my account after a successful appeal reversal?

Congratulations! A reversal means you won your appeal. Washington ESD should automatically process your back pay for all the weeks you were denied. It usually takes 2-3 weeks for the payments to show up in your account. Make sure your direct deposit info is current in your SecureAccess Washington account.

•Thank you! That's such a relief. I was worried I'd have to file some other paperwork or something.

•Just make sure you keep filing your weekly claims if you're still unemployed. The reversal doesn't automatically restart your ongoing benefits.

You should receive a determination letter explaining exactly what benefits you're entitled to and the effective dates. The back pay calculation can be tricky depending on when you originally filed versus when the appeal was processed. Keep all your documentation in case there are any discrepancies.

•I have copies of everything but should I call Washington ESD to confirm they received the reversal decision?

•You can try calling but honestly their phone system is impossible to get through. If you need to speak with someone about your specific case, I'd recommend checking out claimyr.com - they have a service that can actually get you connected to Washington ESD agents. There's even a video demo at https://youtu.be/7DieNd3C7zQ showing how it works.

omg same thing happened to me last month!! took them 6 weeks to process my back pay after the reversal but when it finally came through it was like christmas morning lol. just be patient and keep checking your account

•Six weeks?? I was hoping it would be faster than that but I guess I'll just have to wait it out.

•Mine only took 3 weeks so it really varies. Depends on how backed up they are with appeals processing.

Make sure you understand exactly what was reversed. Sometimes they reverse part of a decision but not all of it. I learned this the hard way when I thought I was getting full benefits but they only reversed one of the disqualification issues.

•How can I tell what exactly was reversed? The letter just says 'decision reversed' but doesn't break it down.

•Look for a section that talks about 'findings of fact' or 'conclusions of law' - that should explain which specific issues were overturned.

dont get too excited yet - washington esd has a habit of finding new reasons to deny claims even after successful appeals. happened to my neighbor where they reversed his appeal then immediately hit him with a different disqualification

•That's pretty rare actually. Once an appeal is reversed, they usually honor it unless there's evidence of fraud or new information comes to light.

•maybe rare but it does happen so just saying keep your guard up

Quick question - did you have to attend a hearing for your appeal or was it just based on written documentation? I'm dealing with an appeal right now and trying to figure out what to expect.

Paolo Longo
•It was just document-based for me. I submitted additional proof of my job separation circumstances and that seemed to be enough.

•That gives me hope! I submitted a ton of documentation so maybe I won't need to do a phone hearing.

The back pay should include any weeks you certified for during the appeal process, plus interest if it's been a really long time. Don't forget that the payments will be taxable income so you might want to set some aside for taxes.

Paolo Longo
•Good point about taxes! I hadn't thought about that. Should I have taxes withheld from the back pay or just handle it at tax time?

Isabella Costa
•You can change your withholding preferences in your Washington ESD account settings. I'd recommend having at least 10% withheld to be safe.

Just want to echo what others said about keeping up with weekly claims if you're still unemployed. The reversal fixes your past benefits but doesn't automatically restart ongoing payments - you still need to certify each week.

Paolo Longo
•Yeah I've been keeping up with the weekly certifications even during the appeal process, just in case.

•Smart move! Some people stop filing during appeals and then have gaps in their benefit weeks.

Been trying to get through to Washington ESD for weeks about my own appeal status and their phones are absolutely useless. How did you find out about your reversal decision - did they mail it or was it in your online account first?

Paolo Longo
•I got a physical letter in the mail but it also showed up in my SecureAccess Washington account under correspondence.

•Thanks! I'll keep checking both places. This waiting is driving me crazy.

•If you really need to talk to someone at Washington ESD, try that Claimyr service I mentioned earlier. Saved me hours of calling and getting nowhere.

Congrats on winning your appeal! That's huge. I've been fighting Washington ESD for months on my own case and it feels like they make everything as complicated as possible on purpose.

•Thank you! Don't give up on your case - I honestly thought I was going to lose based on how confusing everything was.

•That gives me hope. Did you use a lawyer or represent yourself?

Paolo Longo
•I represented myself but I did a lot of research on unemployment law beforehand. The key was having really good documentation.

One thing to watch out for - make sure the back pay amount is correct when you receive it. I've heard of cases where Washington ESD miscalculated the weeks or the benefit amount. Keep your own records to double-check against what they send.

Paolo Longo
•How would I calculate what I should be getting? I'm not sure how to figure out the exact amount.

Omar Hassan
•Take your weekly benefit amount times the number of weeks you were denied, minus any taxes withheld. Should be pretty straightforward unless there were partial payments involved.

this whole appeal process is such a nightmare. been waiting 3 months for my hearing date and still nothing. at least you got yours resolved! gives me some hope that the system actually works sometimes

•3 months is crazy long even for Washington ESD standards. Have you tried following up on your hearing status?

•tried calling probably 50 times and never get through to a human being

•That's exactly why people are using services like Claimyr now. Regular calling just doesn't work anymore with their phone system.

FINALLY some good news from someone dealing with Washington ESD! I swear 90% of the posts here are about problems and delays. Nice to see they actually do reverse bad decisions sometimes.

Quick administrative note - you might want to update your job search log if you've been slacking on that during the appeal process. Once benefits restart they'll expect you to be actively looking for work again.

Paolo Longo
•Oh shoot, I completely forgot about the job search requirements! Thanks for reminding me.

•Yeah it's easy to forget when you're focused on the appeal. Just make sure you're logging at least 3 job contacts per week going forward.

For what it's worth, I tried that claimyr thing someone mentioned and it actually worked. Got connected to a Washington ESD agent in like 20 minutes instead of calling for days. Worth checking out if you need to talk to someone about your benefits.

•There is a fee but honestly it was worth it to actually get answers about my claim instead of being stuck in phone tree hell.

Just want to add that you should save copies of all your appeal documents and the reversal decision. I learned the hard way that Washington ESD sometimes 'loses' paperwork and you might need to prove what happened later.

•Good advice! I've been scanning everything and saving it to cloud storage just in case.

•Smart! I lost months of documentation in a computer crash and had to start over with my appeal. Digital backups are essential.

Probably a dumb question but when they reverse an appeal decision, does that mean the employer can appeal the reversal? Or is it final at that point?
0 coins
Amina Bah
•Either party can appeal to the Board of Appeals if they disagree with the Administrative Law Judge decision. But most cases end at the ALJ level.

•Thanks! I was worried my old employer might try to fight it but sounds like that's not super common.

One last thing - if there are any issues with your back pay calculation or if payments don't show up in a reasonable time, don't hesitate to escalate. Washington ESD has internal review processes for payment disputes.
0 coins
Paolo Longo
•How do you escalate something like that? Through the normal appeals process or is there a different department?
0 coins
Yuki Kobayashi
•There's a separate payment dispute process. You'd file a complaint through their customer service system, though getting through to discuss it is the usual challenge.

Carmen Vega
•This is where having a service that can actually get you connected to agents becomes really valuable. Much easier than trying to file complaints through their automated systems.
