Appeal victory - decision reversed by OAH but confused about next ESD steps

OMG finally got the decision letter from my appeal hearing last week!!! It says "Decision Reversed" at the top and the judge wrote that ESD's denial of my benefits was incorrect based on the evidence I presented. I'm sooo relieved but honestly kinda confused about what happens next? Does this mean I'll automatically get all my back benefits for the 8 weeks I've been fighting this? My eServices account still shows "disqualified" status - do I need to call ESD to get them to update it or does it happen automatically? The letter doesn't explain anything about timeline or next steps. I'm afraid to celebrate until I actually see the money hit my account lol. This whole process has been such a nightmare since I got laid off from my restaurant management job in February.

Congratulations on winning your appeal! When I won mine back in January, it took about 10-14 business days for ESD to process the OAH's decision and update my claim. The system doesn't update automatically - ESD has to manually review the judge's decision and implement it. During that time, keep filing your weekly claims as normal! Your eServices will continue showing \

Thank you!! That's so helpful. I was worried something was wrong since nothing changed right away. I'll keep filing my weekly claims and give it 2 weeks before panicking 😅

congrats!! i just had my hearing yesterday and im super nervous. what kind of evidence did u end up using that helped u win??

Thanks!! For me it was emails between me and my boss that proved I was laid off due to slow season and not fired for misconduct like ESD claimed. I also had my final paystub showing regular hours up till the end (not reduced hours). The judge was actually really fair and listened to everything. Good luck with yours!!

A reversed decision is definitely good news, but there are a few important things to understand about what happens next:\n\n1. ESD must implement the OAH judge's decision, but this doesn't happen instantly. Their claims specialists need to process the reversal manually.\n\n2. You should expect a separate letter from ESD (not OAH) once they've processed the reversal. This letter will explain your payment details.\n\n3. The implementation usually takes 10-21 days from when ESD receives the official decision from OAH.\n\n4. Continue filing your weekly claims during this waiting period - this is CRITICAL.\n\n5. This is exactly what I needed to know! I was definitely confused about who does what between OAH and ESD. I'll keep an eye out for that second letter from ESD. And don't worry, I've been religiously filing my weekly claims even during the appeal process - wasn't sure if they'd count but didn't want to risk it.

CONGRATULATIONS!!! The system is such a mess, I'm always happy when someone beats it! I went through this exact situation in March and just so you know, THE SYSTEM IS DESIGNED TO MAKE YOU GIVE UP!!!! They denied me because they \

52 calls? That's insane but sadly not surprising based on my experience so far. I'm definitely keeping my expectations in check about timeline. This whole process has been so stressful.

try claimyr.com if u need to get thru to an agent faster. i used it after waiting 4 weeks for my appeal to be processed and was able to talk to ESD in like 15 minutes when i had been trying for days. they have a video showing how it works at https://youtu.be/7DieNd3C7zQ?si=26TzE_zGms-DODN3 - totally worth it to avoid the phone nightmare. the agent i spoke with was able to see my appeal was approved and manually push it through their system.

yeah it does, the system basically waits on hold for u and calls when an agent picks up. saved me like 3 hours of hold time

Ya definitly keep filing those weekly claims. My cousin didnt and lost out on like $4000 even tho he won his appeal.

Oh no that's awful! I've definitely been filing every week even when it seemed pointless. Thanks for the reinforcement that it's the right thing to do!

Something everyone seems to be missing - make sure you check your correspondence inbox in eServices for any additional fact-finding questionnaires after your appeal win. Sometimes ESD sends additional questions before processing the reversal. These have strict deadlines (usually 5 business days) and if you miss responding, it can further delay your payments.\n\nAlso, verify that your payment method is correct in your profile. I've seen cases where people win appeals but then have payments delayed because their direct deposit information was outdated.\n\nLastly, print and save a copy of your appeal decision letter. If there are any issues with implementation, having that documentation ready when you call ESD can speed up the resolution process significantly.

That's really good advice about checking for questionnaires! I wouldn't have thought to look for that. My direct deposit info should be current but I'll double-check everything tonight. And I definitely saved a PDF of the decision letter already - this process has taught me to document EVERYTHING.

what judge did u have? was it over the phone or zoom?

It was Judge Sanchez and we did it over Zoom. She was actually really fair and let me explain everything without rushing. Way less intimidating than I expected!

Just wait until you see how they mess up your taxes next year!!!! My 1099-G was COMPLETELY WRONG after my appeal and I had to spend MONTHS getting it corrected. Make sure you keep track of exactly how much back pay you eventually get so you can verify it later!!

Omg I hadn't even thought about the tax implications. This just gets better and better 🙄 Thanks for the heads up though, I'll definitely track everything.

One other important detail: the decision letter should indicate which specific weeks were addressed in the appeal. If your disqualification covered more weeks than were specifically mentioned in the appeal decision, you may need to address those separately. \n\nFor example, if you were disqualified for 12 weeks but the appeal only explicitly reversed 8 weeks, you might need to follow up about the remaining 4 weeks. Check the date ranges carefully in your decision letter.

That's a really good point. Looking at my letter more carefully, it does specify
