Approved ESD appeal - next steps for payment and employer counter-appeals?

So I just received a decision letter that my appeal with OAH was approved after 7 weeks of waiting! I'm relieved but also confused about what happens next. The letter says I'm eligible for benefits, but doesn't explain the actual payment timeline. Does ESD automatically start processing my back payments or do I need to contact them? Also, my former employer was pretty aggressive during the hearing - can they appeal this decision AGAIN and delay my benefits even longer? I'm getting really anxious because I've been without income since December and my savings are completely drained. Has anyone gone through this process recently who can explain what happens after a successful appeal? Thanks!

Congratulations on winning your appeal! Here's what happens next: 1. ESD should automatically process your payments within 7-10 business days. You don't need to contact them directly, but it doesn't hurt to send a message through your eServices account as a reminder. 2. Yes, unfortunately your employer CAN appeal again. They have 30 days to file a Petition for Review with the Commissioner's Review Office. If they do this, you'll get a letter notifying you. 3. The good news is that even if your employer appeals, ESD should still release your payments while that second appeal is pending (unlike the initial appeal where benefits are held). Make sure you continue filing your weekly claims if you haven't been! You won't get paid for any weeks you didn't submit a claim, even if you're ultimately found eligible.

my sister got her apeal aprroved last month and it took almost 3 weeks for the money to hit her account. so dont get worried if its not there right away. she kept checkng everyday and was getting super freaked out but then one day it was all there so just be patient

When my appeal was approved last year, I received all back payments in one lump sum about 12 days after the decision letter. ESD processes it automatically, but I recommend keeping a record of the decision letter just in case. Regarding employer appeals - yes, they can appeal to the Commissioner's Review Office within 30 days, but as mentioned above, this doesn't stop payment processing. If your former employer does file another appeal, you'll need to submit a response defending the OAH judge's decision. One thing to note - make sure your address is current in the system. Sometimes ESD will mail you a physical check for backdated payments rather than using direct deposit, especially if it's a large amount.

BEWARE - even if you win your appeal, ESD can be EXTREMELY slow to actually process your payments! I won my appeal in January and didn't see a DIME for over a month afterward! And good luck trying to reach them to ask about it!!! I called literally 47 times in one day and couldn't get through. The system is BROKEN and designed to wear you down so you'll give up!!

I had a similar experience trying to reach ESD after my appeal was approved. After days of failed attempts, I found a service called Claimyr (claimyr.com) that got me through to an actual ESD agent in about 25 minutes instead of spending hours redialing. dont listen to the negative ppl here! i just went thru this in february and got my money in like 5 days after winning appeal. its fast now not like during covid when everything was slow

To answer your question about whether payments come individually or as a lump sum - it can actually be either! I've seen cases where all back payments come at once, and others where ESD processes each week separately, resulting in multiple deposits over a day or two. Also, important note: when they process your backpay, they'll withhold taxes if you elected for tax withholding on your initial application. You can verify or change this selection in your eServices account before payments are processed if needed.
