How long until ESD appeal decision shows up online? Anyone know the timeline?

I just had my appeal hearing with the OAH judge last Thursday (finally!) after waiting for almost 8 weeks to get scheduled. The judge said they'd make a decision soon but didn't give a specific timeframe. It's been 6 days now and I'm checking my ESD account like 10 times a day but still nothing shows up under the 'Decisions' tab. Anyone been through the appeals process recently? How long did it take for your decision to actually show up on your ESD account page after your hearing? I'm so anxious about this because I've got $7,200 in benefits riding on this appeal and my landlord is already threatening eviction. Thanks for any insight!

For me, it took about 14 business days for the appeal decision to appear on my ESD account after my hearing. The judge told me they have 30 days to issue a decision, but mine came earlier. Once it showed up in my account, I also received the official paper copy in the mail about 3 days later. Hang in there - I know the waiting is incredibly stressful!

Thanks for the info! 14 business days seems like forever when you're checking constantly. Did you get any email notification when the decision was uploaded, or did you just have to keep checking your account?

mine took 22 days!!! and nobody told me it was there i just had to keep checking the website. worst part is they denied me agin and now i have to do another appeal to the commissioner which takes even longer ughhh

That's rough, I'm sorry to hear that. For the Commissioner's Review, you only have 30 days from the date of the OAH decision to file that appeal. Make sure you don't miss that deadline! Did you have any representation at your hearing? Sometimes having an advocate can make a difference in how these cases are decided.

The official timeframe is that Administrative Law Judges have 30 calendar days from the hearing date to issue a decision, but in practice, it varies widely. I've seen decisions appear as quickly as 7 days and as long as 35+ days (though that's uncommon). When the decision is made, it will appear in your ESD account under the "Decisions" tab, but you'll also receive a physical copy in the mail. The OAH decision is NOT the final word - if you disagree with it, you can appeal to the Commissioner's Review Office within 30 days. Most importantly - continue filing your weekly claims during this waiting period even if you're being denied benefits! If your appeal is successful, ESD can only pay you for weeks you properly claimed.

Thanks for the detailed explanation. I've definitely been continuing to file my weekly claims even though they're all showing as "disqualified" right now. I'm hoping the decision comes sooner rather than later because this waiting is driving me crazy.

ESD IS THE WORST!!!!! I had to wait FORTY-TWO DAYS after my hearing for the decision to show up on my account!!! And this was AFTER waiting 12 weeks just to get a hearing date in the first place!!! Their system is BROKEN and they don't care about people suffering while they take their sweet time. I ended up having to take out a payday loan while waiting which cost me hundreds in interest. RIDICULOUS!!!

That's awful! Did you try reaching out to your state rep? I've heard they can sometimes help speed things up when ESD is dragging their feet. Worth a shot maybe?

Had my hearing in February and waited 17 days for the decision to appear online. Nobody from ESD ever contacted me - it just showed up one day when I checked. If you're desperate to know the status, have you tried calling ESD? Obviously their phone lines are a nightmare, but I had good luck using Claimyr (claimyr.com) to get through to an actual agent. The agent I spoke with was able to see notes in the system about my appeal that weren't visible in my online account, including that a decision had been made but was still being processed. I hadn't heard of that service before! I'll check it out. I've been trying to call ESD directly but never get through - either busy signals or disconnects after waiting forever. At this point, I'd do anything to just know what's going on with my case.

Something important to note - OAH decisions and ESD decisions are handled differently. The Office of Administrative Hearings (OAH) issues the initial appeal decision, which then gets transmitted to ESD. ESD then has to process that decision in their system, which can add a few extra days before it appears in your online account. Typically, the total timeline looks like this: 1. Hearing date 2. Judge reviews case and writes decision (7-30 days) 3. Decision transmitted to ESD (1-3 days) 4. ESD processes the decision in their system (1-5 days) 5. Decision appears in your online account 6. Paper copy arrives in mail (2-5 days after appearing online) If your hearing was just last Thursday, you're still well within the normal timeframe. The most important thing is to continue filing your weekly claims while you wait.

This might sound weird but try checking your account late at night. For some reason my decision showed up at like 11:30 PM on a Tuesday. I think they must run some kind of batch update to the system overnight.

One thing I learned during my appeal process - the decision might not automatically trigger payments even if you win. If you win your appeal, you may need to contact ESD directly to ensure they process any back payments owed to you. In my case, I won my appeal, but had to call several times before they released my back payments for the 9 weeks I was initially denied. Just something to keep in mind once you do get your decision.
