Waiting for ESD hearing decision - How many days until I know the result?

I just finished my unemployment appeal hearing with the OAH yesterday morning. The judge said they'd mail their decision, but I'm freaking out about how long this is going to take. My bills are piling up, and I need to know whether I'll be getting backpay or if I need to figure out another plan. The hearing itself was super stressful - I got laid off from my restaurant job after a disagreement with the new manager, but ESD denied my initial claim saying I quit voluntarily. Has anyone gone through an appeal hearing recently? How many days did it take to get your decision? The suspense is killing me!

I went through an appeal hearing in February for a similar situation. In my case, it took exactly 14 days to receive the written decision in the mail. The judge told me it would take 7-10 business days, but it was a bit longer. If you have access to your SecureAccess Washington account, sometimes the decision shows up there before you get the physical mail. Check under the 'Decisions' tab on your appeal case. Good luck!

Thank you!! I'll check my SAW account daily then. Did your decision show up online before you got the physical letter? I'm literally checking my mailbox 3 times a day.

23 days?? 😱 Ugh I don't know if I can handle waiting that long. Did you call them to check on the status or did you just wait?

The Administrative Procedure Act requires OAH to issue decisions within 30 days of the hearing, but most unemployment appeal decisions come much sooner - typically 10-14 business days. Make sure you're continuing to file your weekly claims during this waiting period, even though they'll show as "pending" or "disqualified" status. If your appeal is successful, you'll receive all eligible backpay for properly filed weekly claims. Also, double-check that your mailing address is current in both your ESD and OAH profiles.

Thank you for this information! I've been filing my weekly claims faithfully even though they all say "disqualified" right now. I didn't know about the 30-day legal requirement - that makes me feel better knowing there's a maximum wait time at least.

mine only took 8 days but that was back in 2020 when they were moving faster i think. the judge told me right at the end of the hearing that i won though so i already knew before getting the letter. did the judge give you any indication?

The judge didn't give me ANY hint about how it was going. She just thanked me for my testimony and said they'd mail the decision. I'm so stressed because my former employer had their HR person there with all these documents.

THE WHOLE SYSTEM IS DESIGNED TO MAKE US SUFFER!!! They intentionally drag these decisions out hoping you'll give up. I waited 19 days for my decision and it was WRONG so then I had to request ANOTHER hearing which took 2 MORE MONTHS to schedule. They don't care that people have bills and families. The adjudicators barely even listen to your case and just side with employers. I'm still fighting my case from DECEMBER!!

I work as an employment attorney and deal with ESD appeals regularly. Currently, decisions are averaging 12-15 business days, though individual outcomes vary. If it's been more than 3 weeks, you can contact OAH directly at 1-800-583-8271 to check on your decision status. One thing that might help while you're waiting - if you're having trouble reaching ESD to check on your claim status or understand what happens next after your decision, I've had clients use a service called Claimyr (claimyr.com) that gets you through to an ESD agent without spending hours on hold. They have a demo video at https://youtu.be/7DieNd3C7zQ?si=26TzE_zGms-DODN3 that shows how it works. Many of my clients found it helpful when they needed direct answers during this stressful waiting period.

Thank you for the information! I might try that Claimyr service if I don't hear anything by next week. I definitely need to talk to a real person about what happens next depending on the decision. The waiting and uncertainty is the worst part.

Just wanted to check in - have you received your decision yet? Mine came exactly on day 14 like I mentioned, but I know others who got theirs sooner.

No decision in the mail yet, but I got an update on my SAW account this morning!! It says "Decision: ALLOWED" and shows my benefit amount! I'm literally crying with relief right now. Thank you everyone for helping me through the wait. Now I just need to figure out how long until the backpay actually hits my account.

Congratulations on your successful appeal! Once the decision shows as "ALLOWED" in your account, ESD typically processes backpay within 3-5 business days. You might receive separate deposits for each week claimed, or a single lump sum payment. Make sure your payment method (direct deposit or debit card) is properly set up in your ESD account to avoid further delays. Also, don't forget to continue filing your weekly claims according to the regular schedule.

Thank you! Yes, I have direct deposit set up and I've been filing claims every week even when they were getting denied. I'm so relieved this nightmare is almost over. Really appreciate everyone's help and advice!
