How long to wait for ESD appeal hearing? Have text evidence from boss!
I just filed an appeal for my ESD disqualification yesterday and I'm freaking out about how long I'll be waiting! My former employer claimed I quit but I have actual text messages proving he told me not to come back after I requested time off for a medical emergency. I've uploaded the text screenshots with my appeal. Has anyone gone through the appeals process recently? What's the average wait time to get a hearing scheduled with OAH? I'm down to my last $240 and rent is due in 3 weeks!!!

I went through an appeal last month. It took about 5-6 weeks from filing my appeal to getting the hearing scheduled. Then another week after the hearing to get the decision. So plan for about 7 weeks total. But having clear evidence like texts is really good - definitely better than my situation. Make sure you check your mail AND your eServices account regularly because sometimes they send notices to only one place.

I filed an appeal in November and had my hearing in January (about 8 weeks). Yours might be faster though. Just make sure you keep filing your weekly claims while waiting for the appeal! That's super important. If you win, they'll pay you for all those weeks, but only if you filed claims each week.

I was in a similar situation with text proof! Here's what worked for me - I called ESD using Claimyr (claimyr.com) and got through to an actual agent in 25 minutes instead of being on hold forever. The agent was able to tell me exactly where my appeal was in the process and gave me an estimated hearing date. The current average wait time is 4-6 weeks for an appeal hearing to be scheduled with OAH (Office of Administrative Hearings). With text evidence from your employer, you're in a strong position. Make sure you prepare thoroughly: 1. Continue filing weekly claims while waiting 2. Organize your evidence chronologically 3. Write a simple timeline of events to reference during the hearing 4. Be prepared to explain why you had a "good cause" reason 5. Check your spam folder daily for notices Appeal judges look specifically at whether you had "good cause" to leave, and medical emergencies often qualify. Text messages directly from your employer are extremely valuable evidence.

what about your monetary determination? Did you check that? sometimes that's wrong and then u dont even need an appeal. just saying cos my cousin had similar issue and she just needed to file a wage dispute not a whole appeal.

To answer your question about backpay - yes, you'll get paid for all weeks you claimed during the appeal period IF you win. That's why it's super important to keep filing weekly claims even though they'll show as "disqualified" until the appeal is resolved.

•This isn't always true... my appeal took 9 weeks and I won but they only paid me for 6 weeks because they said I didn't do enough job searches for 3 of the weeks. Make sure you document EVERYTHING.

A doctor's note would absolutely strengthen your case. Medical documentation supporting your need for time off that led to the separation will directly address the "good cause" requirement. I'd recommend getting that documentation as soon as possible and submitting it as additional evidence for your appeal. You can submit additional evidence up until the hearing date, but earlier is always better.

ER discharge papers are excellent documentation and will definitely help your case. If possible, also get a brief note from your doctor stating that the condition required you to request time off. For the hearing itself, be prepared to clearly explain: 1) You had a medical emergency (kidney infection requiring ER treatment), 2) You requested time off for this legitimate reason, and 3) Your employer responded by telling you not to return (which your text messages prove). This creates a very clear narrative supporting that you had good cause and did not quit voluntarily.
