How long does ESD take to schedule unemployment appeal hearing? Stuck in limbo

I got disqualified from unemployment benefits last week because ESD says I didn't report some income from a side gig (I honestly forgot about it). I filed an appeal immediately through eServices the same day I got the determination letter, but haven't heard anything back. The letter just said something about OAH handling appeals. My rent is due in 3 weeks and I'm freaking out about how long this whole process takes. Has anyone gone through the appeal process recently? How long before they actually schedule a hearing? Do they contact you by mail or email? I'm checking my portal obsessively but nothing's changing.

Thank you, this is really helpful. I did get an auto-email saying they received the appeal but nothing else yet. Do you know if I can still file weekly claims while waiting? The determination letter wasn't clear about that.

I went thru this last yr and it took forever!!!! First they said 3 weeks but then it was rescheduled TWICE and ended up taking almost 3 MONTHS total before I finally got a hearing. I was so stressed I couldn't sleep. The judge was nice tho and ruled in my favor right on the call. Make sure u have ALL ur evidence organized and dated. Also the OAH website has a status checker that's more updated than the ESD one sometimes.

Yep had to keep doing weekly claims even tho I wasn't getting paid. Borrowed $ from family and maxed out credit cards tbh. It was awful but at least they backpaid everything when I won. Just be prepared for a wait and have a backup plan for money if possible.

Your talking about two different things here. The appeal FILING is different from getting a HEARING DATE. Once OAH gets your appeal they send confirmation in like 5-7 days usually. Then the actual hearing date could be a month or more away depending on backlog. My neighbor is a paralegal and says their super backed up right now because of all the overpayment stuff going on.

Yeah exactly. First just confirmation then later a scheduled date and time. You can call and request an expedited hearing for financial hardship but from what I heard that only speeds it up a little bit maybe a week or two faster.

Have you tried calling ESD directly to check on the status? I was in a similar situation last month and spent 3 days trying to get through their phone system with no luck. I finally used a service called Claimyr (claimyr.com) that got me connected to an ESD agent in about 15 minutes. The agent was able to see that my appeal had been received but was sitting in a queue. she had emails showing when she worked and bank statements. judge was impressed she was so organized. make sure u have everything in order by date!
