How long after ESD appeal hearing until decision arrives? Still waiting after 3 weeks
I had my unemployment appeal hearing with the OAH judge on March 2nd (about 3 weeks ago) and still haven't received any decision. The judge said something about 'mailing the decision within a reasonable time,' but didn't give a specific timeframe. My benefits have been on hold since January when ESD initially denied my claim saying I didn't meet the job search requirements (I definitely did!). I've checked my eServices account daily but there's nothing new. The financial stress is really getting to me - rent is due next week and I'm running out of options. How long does it typically take to get a decision after an appeal hearing? Is 3 weeks normal or should I be concerned something went wrong?

I went through an appeal last year and got my decision in about 2 weeks. The judge told me it could take up to 30 days though, so I think you're still within the normal timeframe. Did you check your regular mail? Sometimes they send the decision by regular post even if you're signed up for electronic notifications.

•Thanks - I've been checking my mail every day too. Nothing there either. I'm going to give it another week before I really start panicking. Just hate being in this limbo.

•SIX WEEKS?! Oh my god, I can't wait that long. Did they backpay you for all the weeks once they finally approved it?

The Office of Administrative Hearings (OAH) typically issues decisions within 2-4 weeks after the hearing, though their official guideline is "within a reasonable time" which can sometimes extend to 6 weeks. They're required by law to mail you a written copy of the decision regardless of whether you have electronic communications set up. A few things that might help: 1. Check if your mailing address is correct in both your ESD account and what you provided at the hearing 2. Look in your spam folder if you're expecting an email notification 3. You can call OAH directly at 855-928-1253 to inquire about the status of your decision If the judge rules in your favor, ESD will process any back payments you're entitled to, usually within 7-10 business days after receiving the decision from OAH.

•Thank you for the detailed response! I didn't realize I could contact OAH directly - I've only been calling ESD. I'll try calling OAH tomorrow morning. And yes, I double-checked my mailing address is correct in both systems.

Im in a similiar boat, my hearing was Feb 28 and still nothing. Judge said 2-4 wks but its been over 4 now. The waiting is the worst part! Did u have a lawyer for ur hearing? I didnt and now I'm worried that was a mistake...

•No, I didn't have a lawyer either. The hearing wasn't as formal as I expected - the judge just asked me questions about my job search activities and why I thought the denial was incorrect. I had all my job search logs organized with screenshots of applications and emails, which seemed to help. But now I'm worried too!

After trying to call ESD for TWO WEEKS straight with no luck (always disconnected after waiting forever), I finally used Claimyr.com to get through to an actual person. They connected me to an ESD agent in about 15 minutes when I was dealing with a similar situation waiting on appeal results. The agent was able to see notes in my file that my decision had been made but was still in processing. Saved me another week of anxiety! They have a video demo here if you want to see how it works: https://youtu.be/7DieNd3C7zQ?si=26TzE_zGms-DODN3

•I've never heard of this service, but at this point I'm desperate enough to try anything. The ESD phone system is absolutely maddening. Did the agent give you any indication of when your payment would actually arrive once they saw it was in processing?

•Yes - once they could see it was approved, the agent told me exactly when to expect the payment. It was processed 3 days later. Without that call I would've been anxiously checking my account non-stop for who knows how long.

I remember when my cousin went through this last year - it took almost 5 weeks for his decision! But then when it finally came, it was in his favor AND he got all the backpay at once. Was like $7,800 dropped into his account overnight. So sometimes the wait, while totally stressful, ends up working out. Finger crossed for you! The fact that you had documentation of your job searches is really good. That's often the deciding factor in these cases.

•Thanks for the encouragement! I'm trying to stay positive. It's just hard when you're watching your bank account dwindle and bills are piling up. I hope mine gets resolved soon like your cousin's did.

•While it's reasonable to be concerned after 3 weeks, the OAH decision timeline can sometimes extend to 4-6 weeks, especially if they have a high caseload. But you're right that calling to check on status is a good next step.

Just an update for anyone in a similar situation: I've seen appeal decision timelines vary significantly over the past year. The official OAH guideline is that decisions should be issued within 30 days of the hearing, but system backlogs can extend this timeline. Some factors that might affect your timeline: 1. Complexity of your case (simple eligibility issues tend to be faster) 2. Whether additional evidence was submitted after the hearing 3. Current OAH caseload and staffing 4. Whether the judge needed to research specific legal precedents If you reach the 30-day mark, I would definitely recommend contacting OAH directly rather than just ESD. Their contact info is on the hearing notice you received.

•This is really helpful context, thank you. My case seemed pretty straightforward - just proving I did my job searches properly. But maybe there's a backlog right now. I'll definitely call OAH if I don't hear anything by the 30-day mark.

UPDATE: I followed the advice here and called OAH directly. The representative was actually really helpful! She checked my case and said the decision was made yesterday and is being mailed out today. She couldn't tell me what the decision was, but at least I know it's coming soon. Such a relief to know it's not lost in the system somewhere. Thanks everyone for the support and advice!

•Great news! This is why I always recommend contacting OAH directly when waiting for appeal decisions. They generally have more specific information about where your case stands in the process than the general ESD agents. Please let us know the outcome when you receive it!
