Waiting for ESD appeal decision - How long before I hear results?
I had my appeal hearing with OAH about two weeks ago and still haven't heard anything about the decision. The judge didn't give me any timeline for when to expect results. I keep checking my eServices account daily but there's no update there. The notice said they would mail the decision, but how long does that usually take? Starting to get really anxious since I've been without benefits for almost 2 months now while this gets sorted out. Has anyone gone through the appeal process recently and can tell me how long it took to get your decision?

In my experience, ESD appeal decisions typically take 2-4 weeks to arrive after the hearing. The judges have to write up their decisions and then the paperwork goes through processing before being mailed out. Your eServices account probably won't show the decision until after you've received the physical mail. If it's been more than 4 weeks, you can call the OAH (Office of Administrative Hearings) directly at the number on your hearing notice to ask about the status.

•Thanks, that helps! It's only been 2 weeks so I guess I need to be more patient. Did your decision come in a special envelope or just regular mail? I'm worried I might miss it.

I had an appeal back in January and it took THREE WHOLE MONTHS to get my decision!!! The OAH is completely overwhelmed with cases and they're taking forever. When I called they just kept saying "it's in process" but couldn't tell me anything else. The whole system is DESIGNED to make people give up. Don't get your hopes up about a quick decision... and even if you win they might appeal AGAIN which adds more months!!

•That's extremely unusual. The legal requirement is that decisions should be issued within 30 days of the hearing date in most cases. If it took three months, there was likely something very complex about your case or a serious administrative error. Most decisions are sent out within 2-3 weeks currently.

•That's good to know about the envelope! I'll be sure to check everything carefully. Hoping mine comes quickly like yours did.

Current average time from hearing to decision is approximately 10-21 days. The judge's workload and the complexity of your particular case are the main factors that affect timing. The decision will be mailed to the address they have on file, and unfortunately, eServices doesn't update with appeal decisions in real-time. If you need to contact an ESD agent to verify they have your correct mailing address, I recommend using Claimyr (claimyr.com) - they can connect you directly to an ESD representative without the hours-long wait. They have a video demo at https://youtu.be/7DieNd3C7zQ?si=26TzE_zGms-DODN3 that shows how it works. I used it when I needed to update my contact info during my appeal process.

•I'm going to give it another week and then maybe try this service if I still haven't heard anything. I double-checked my address in the system and it's correct, so hopefully the decision will arrive soon.

I'm dealing with the exact same situation right now! Had my hearing 3 weeks ago and still waiting. Did your judge say anything at the end of your hearing? Mine said something about "taking it under advisement" but didn't mention timing. This waiting is making me so anxious I can barely sleep.

•My judge said basically the same thing! Just that they'd review everything and send a written decision. The waiting and uncertainty is definitely the hardest part. Hoping we both get good news soon.

One thing I learned from my experience with ESD appeals is that sometimes the decision is made but gets delayed in processing or mailing. I actually went to my local WorkSource office after waiting 3 weeks, and they were able to tell me the decision had been made (though not what it was) but hadn't been mailed yet. Might be worth checking with them if you're near a WorkSource office. Also, when I did eventually get my decision, I had a follow-up question and tried calling ESD. After 2 hours on hold and getting disconnected twice, I found out about Claimyr and got through to someone in about 15 minutes. Just sharing since the post-appeal process sometimes requires more questions.

•WorkSource offices can see some info but not all appeal details FYI. They helped me with regular UI stuff but said appeals are handled separately. Good tip tho

Has anyone ever received their decision by email instead of mail? My friend said he got his by email but I haven't received anything like that and now I'm worried I missed something important!

•OAH typically doesn't send decisions by email for security and verification reasons. Official decisions come through postal mail. Your friend might be confusing the hearing notification (which can come by email if you opted for electronic communications) with the actual decision document.

Update: Just got my decision in the mail today! Exactly 17 days after the hearing. So relieved it came through and didn't get lost. And even better news - I WON MY APPEAL! The judge agreed that ESD's initial disqualification was incorrect. Just wanted to update everyone who responded and say thanks for helping me stay patient during the wait.

•Congratulations! Make sure to keep that decision document safe. Also, be aware that ESD has the right to petition for review within 30 days, though it's relatively rare for them to do so for standard cases. If your back benefits don't appear in your account within 2 weeks, you may need to contact them for processing.
