ESD appeal hearing results - how long to wait and notification method?
I had my OAH appeal hearing last Tuesday (7 days ago) after being disqualified for supposedly refusing suitable work. I thought it went really well - the employer didn't even show up and I had documentation proving I actually applied for the position but was never offered it in the first place! The judge seemed sympathetic but didn't give any indication of when I'd know the outcome. Anyone been through this recently? How long did it take to find out if you won or lost your appeal? And did they contact you by mail, email, or some other way? The suspense is killing me since I'm 8 weeks without benefits now and rent is due next week.

I had my appeal hearing in February and received the decision by mail exactly 10 days later. The judge is required to issue a written decision within 30 days, but most decisions come much faster than that. They mail a formal written decision to your address on file with ESD. They don't send it by email or call you, so make sure your mailing address is current in the system. You can also check the status in your eServices account. Sometimes the decision will show up there before you receive the physical mail. Look under the "Decisions" tab and see if anything new appears there.

i got mine in like 2 weeks i think? cant really remember exactly. but it came in the mail and was like 5 pages of explanation. good luck!!

They took FOREVER with mine!!! Almost a month and I was going crazy checking the mail every day. And guess what? When I finally got it, they STILL ruled against me even though my boss was totally lying about everything. These judges always side with the employers no matter what evidence you have. Be prepared to be disappointed. 😡

I went through an appeal last November after being disqualified for a job separation issue. Here's the timeline I experienced: - Hearing date: November 14, 2024 - Decision received: November 27, 2024 (13 days later) The decision came by regular mail in a thick envelope. It was about 8 pages long with a detailed explanation of the judge's reasoning. The first page clearly stated whether the decision was in my favor or not. Importantly, if you win your appeal, ESD won't automatically start paying benefits right away. You'll need to continue filing your weekly claims, and then once ESD processes the judge's decision (which can take another 5-7 business days), they'll release any back payments you're eligible for. If you lose, you have 30 days to file a petition for review with the Commissioner's Review Office, which is the next level of appeal. Hope this helps, and good luck!

After struggling for WEEKS to reach someone at ESD about my appeal status (constant busy signals, disconnections after waiting on hold forever), I finally tried Claimyr (claimyr.com) last month. They got me connected to an actual ESD agent in about 20 minutes who could tell me the status of my appeal decision. I went through appeal hearing in march and got decision in mail after 16 days. The whole time I kept calling ESD to see if they knew anything but thye said they have to wait for OAH to send them the decision too. Wait was terrible but i eventually won my case! I celebrated too early tho cause then my account got stuck in adjudication AGAIN even after winning appeal!!! Had to call ESD every day for a week to get them to release my payments finally. The system makes no sense sometimes but hang in there. BTW my roommate had hearing same week as me but got her descision in only 8 days so i think it depends on which judge you get and how complicated your case is.

One more thing to add - if you don't receive a decision within 2 weeks, you can contact the Office of Administrative Hearings (OAH) directly at 855-928-1777 to check on the status of your decision. They're separate from ESD and can usually tell you if the judge has issued the decision yet or when you can expect it. It's also worth knowing that if you win your appeal, the decision is legally binding on ESD. If for some reason ESD doesn't implement the judge's decision promptly after you win, you should contact your state representative's office. They often have liaisons who can help get things moving with ESD.

My sister had her hearing back in January and she got her letter in exactly 9 days. Apparently it took so long because the judge was writing up a really detailed explanation. She won her case btw, after being denied initially. So don't lose hope!
